Reference is made to your written rescission request received November 8, 2017 for the subject
closed -loop recycle system permit. On November 13, 2018, the Division of Water Resources
administratively transferred regulatory oversight of the subject facility to the Division of Waste
Management. Therefore, in accordance with your request, Permit No. WQ0003361 is rescinded, effective
immediately.
If in the future you wish again to operate the subject non -discharge system, you must first apply
for and receive a new permit. Please be advised that construction and/or operation of the subject facilities
without a valid permit is a violation of North Carolina General Statute § 143-215.1 and may subject the
owner/operator to appropriate enforcement actions in accordance with North Carolina General Statute
§ 143-215.6A-6C. Civil penalties of up to $25,000 per day per violation may be assessed for failure to
secure a permit required by North Carolina General Statute § 143-215.1.

This letter serves to document the agreement between the NCDEQ Division of Water Resources
(DWR) and Division of Waste Management (DWM) Superfund Section to formally transfer management
and oversight of the subject facilities from DWR to DWM Superfumd Section. To summarize, Oak -Bark
Corporation (formerly Wright Corporation) currently holds permits with the Nan -Discharge Branch of the
DWR for two capped and inactive lagoons (Permit No. WQ0003361) and a monofill disposal unit (Permit
No. WQ0005699). Both the Kelly Ponds and the monofill are part of the Wright Chemical Corporation
Superfumd Site (EPA ID: NCD024766719).
While the Wright Chemical Superfund Site Remedial Investigation and Feasibility Study (RI/FS)
is underway, management of both DWR pannkW facilities consists solely of monitoring and vegetation
control by the permitee. There has been no recent action towards closure by DWR on either facility because
of the pending results of the RUTS. In a meeting on October 30, 2017, DWR and DWM agreed that in order
to streamline the oversight and closure process, regulatory administration of these inactive units would be
best managed by DWM-Superfund Section. As part of this division transfer agreement, DWR understands
that DWM would manage closure of the disposal units in accordance with their policy but to standards that
meet or exceed DWR's Guidelines for the Closure of Permitted Wastewater Ponds and Lagoons (attached).
In response to guidance from DWR and DWM, Oak -Bark Corporation requested rescission of both
permits on November 8, 2017. Upon your agreement with the above proposal and signature below, permit
numbers WQ0005699 and WQ003361 will be rescinded by the Non -Discharge Branch. Moving forward,
management and eventual closure of the subject facilities will be managed by DWM-Superfund Section.
