Atlas Environmental, Inc. is submitting this package in response to Sue's email dated
October 16, 2018 in which she attached an additional information letter that included the
following:
1. If the U.S. Army Corps of Engineers requests a response to any comments received
as a result of the Public Notice, please provide the Division with a copy of your
response to the USACE. [15A NCAC 02H .0502(c)]"
Atlas Response to Corps Public Notice:
The U.S. Army Corps of Engineers public notice ends at 5 pm on November 19, 2018.
Atlas will copy the Division on any response to any comments received during the
Corps public notice.
"2. Pursuant to 15A NCAC 02H.0506(a) a 401 Water Quality Certification may only be
issued upon determining that existing uses are not removed or degraded by a discharge
to classified surface waters. Based on the information provided in the application and
associated documents, all surface flow from the project is proposed to be rerouted
through multiple stormwater control measures. The outlets from the measures are
proposed to be located along a different stream channel within the property. The
rerouting of the drainage area and surface flow has the potential to remove existing
hydrology and therefore remove existing uses within the stream channel from the
impact limits to the confluence with the perennial stream channel CH -100. Please
provide a thorough analysis and any additional information relative to this issue for
further review by the Division or provide an updated application that accounts for the
secondary and cumulative impacts to the remainder of the intermittent channel CH -
200."

Atlas Response to Indirect Impacts to CH 200:
The existing flow in stream 200 is intermittent in nature. The source of flow within this
stream is from seepage through the dam, discharge from the pond outlet pipe, and
groundwater seepage along the stream. During construction all the existing springs in
the bottom of the pond as well as the groundwater seepage along stream 200 will be
located, collected, and piped to the downstream limit of impact. See the enclosed
stream 200 area of the site plan / impact map. A note was included regarding the
french drain type system that will be used to collect all drainage within the pond / stream
200 impact area. All the existing springs, seepage, and groundwater discharge that
exists within this drainage will continue to flow to stream 200. If flow within stream 200
was simply fed by stormwater the feature would more than likely not be a jurisdictional
intermittent stream.
The applicant is willing to do quarterly monitoring on stream 200 until the agencies
determine that an indirect impact has not occurred. This monitoring will include
photograph documentation with reports to the Corps and DWR. If it is determined
during the monitoring period that stream 200 has been indirectly impacted from
development an action plan to remediate the condition will be immediately submitted.
