This permit, issued on December 22, 2006 is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
1) In accordance with recommendations made by the NC Division of Marine Fisheries, the 4 ft. x 70 ft.
canoeikayak floating (lock and pier proposed on Glovers Creek is hereby removed from this project due
to significant adverse impacts the structure would have on fisheries resources. Any reference to the
canoe/kayak facility, including any reference in the application and workplan drawings, is hereby null
and void.
2) In order to ensure compliance and understanding of permit conditions, the permittee and/or his
contractor shall meet on-site with a representative of the Division prior to project initiation.
(See attached sheets for Additional Conditions)
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit shall be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work shall cease when the permit expires on
December 31, 2009

3) In order to ensure that the proposed pier located adjacent to the canal basin and gravel road does not
encroach into the neighboring riparian corridor, 10 feet of the pier shall be removed from the southern-
most portion of the proposed pier, making the authorized dimensions 4 ft. x 130 ft.
4) Unless specifically altered herein, this permit authorizes the 4 ft. x 130 ft. fixed dock to be constructed
adjacent to the canal basin and, gravel road, the 2 ft. x 6 ft, catwalk, and 13 ft. x 20 ft. fixed dock to be
located adjacent to the boatramp. No other structure, whether floating or stationary, shall become a
permanent part of this facility without permit modification. No non-water dependent uses of structures
shall be conducted on, in or over public trust waters without permit modification.
5) All portions of the fixed dock located over Coastal Wetlands shall not exceed a width of 6 ft. and shall
be elevated a minimum of 3 feet above the marsh substrate as measured from the bottom of the decking.
6) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout
the entire existence of the permitted structure.
7) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
8) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
9) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
that may be caused from existing or future operations undertaken by the United States in the public
interest.
10) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
11) This permit does not authorize the creation of any permanent boat slips. The addition of tie-downs,
pilings, or other formal mooring structures shall require modification of this permit.

12) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required,
upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or
obstructions caused the without expense to the United States or the state of North Carolina. No
claim shall be made against the United States or the state of North Carolina on account of any such
removal or alteration.
13) No vegetated wetlands or open water areas shall be excavated or filled, even temporarily.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required, including an access permit an encroachment
agreements for any utility connections from the NCDOT.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 808-2808 prior to the commencement of any
such activity for this determination. The pernittee is further advised that many non-water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: The N.C. Division of Water Quality has authorized the proposed project under General Water
Quality Certification No. 3400 (DWQ Project No. 061679), which was issued on 12/8/06.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project under General Permit No.
197800056 (COE Action Id. No. 200500960) which was issued on 10/31/06.

The Wilmington Regional Office received your application for a CAMA Major Permit from the Division of
Coastal Management, dated October 20, 2006, received by the Division of Water Quality (DWQ) Wilmington's
Regional Office (WiRO) on October 24, 2006, to; convert an existing private boat ramp to a commercial boat
ramp for a proposed 19 unit RV park, construct an access dock (adjacent to the boat ramp), and construct an
additional dock and platform for canoe/kayak access as described in your application. You are authorized to
proceed with your project as proposed under General Water Quality Certification (WQC) # 3494 (enclosed). This
Certification allows you to use the CAMA Major Permit when the Division of Coastal Management issues
it. Written concurrence from the Division of Water Quality (DWQ) is not required provided that you meet all of
the conditions of the General Water Quality Certifications and the additional conditions listed below.
1) This project is located in a 303(d) listed watershed. In watersheds within and draining to 303(d) listed
waters, as well as watersheds that are classified as nutrient sensitive waters (NSW), water supply waters
(WS), trout waters (Tr), high quality waters (HQW), and outstanding resource waters (ORW), the
Division shall require that extended detention wetlands, bio-retention areas, and ponds followed by
forested filter strips (designed according to the latest version of the NC DENR Stormwater Best
Management Practices Manual) be constructed as part of the stormwater management plan when site
specific stormwater management plan is required.
2) In response to the NC Division of Marine Fisheries comments to the floating dock sitting on the bottom at
low tide and to comply with 15 A NCAC 2B .0221(1) concerning best usage, DWQ would require that
the floating dock be constructed as a hybrid dock where stoppers would keep the float at twelve inches
above the substrate at low tide.
3) In response to the NC Division of Marine Fisheries comments to the increased boat activity and the
shallowness of the system and to comply with 15A NCAC .0213 .0221(3)a concerning water quality
standards, DWQ would require that the sizes and type of boats be limited to avoid the disturbing the
bottom (i.e. turbidity).

9. NARRATIVE DESCRIPTION:
Project Setting: The applicant John and Patsy Fulcher own an undeveloped 3-acre tract of land off of SR 1377
(Styron Creek Road) off of Hwy 70 adjacent to Glover's Creek and Core Sound in the community of Sea Level, Carteret
County, North Carolina, The parcel in question is surrounded by marsh and water except for on one side where it
borders Everett and Vickie Jenkins property and their single family residence and a smaller parcel owned by the
Fulchers. Up Glover's Creek, there is another undeveloped parcel owned by Michael Solono. There is a gravel road
leading towards the sound with an expansive intertidal marsh on the west side of the road and open water to the east.
The road leads to a 10-foot easement along the northern and eastern.boundary of the two aforementioned properties.
There is a riprap bulkhead revetment along this stretch of shoreline along Glover's Creek. There is also a 14'-wide X
40'-long concrete boatramp adjacent to the gravel road. The waters of Core Sound, adjacent to the property, are
classified as ORK but Glovers Creek is not. The mouth of GloversCreek is very shallow and is constantly subject to
shoaling in. According to the applicant, water depth along much of the system is approximately 2' deep with 3' depths
along the canal proper.
Project Description: The applicant proposes to develop a 19-space RV park called The Landing Resort and RV
Park. In doing so, the applicant proposes to convert the existing boatramp from private use to the commercial use for
the residents of the RV Park. This would only be a change in use only and does not involve any structural changes to
the ramp itself. Vehicles and trailers using the ramp would park in an assigned area on the high ground. To facilitate
launching and loading and unloading of boats, a 4' wide X 140' long fixed dock would be constructed adjacent to the
canal/basin area next to the gravel road. In addition, a Z X 6' catwalk would be constructed on the east side of the boat
ramp and would lead t a 13'X 20' fixed dock. A 4'X 70' floating dock would also be constructed on the main body of
Glovers Creek to facilitate the launching of canoes and kayaks. The fixed dock along the side of the canal would
terminate 15' from the Jenkin's property line and the floating dock would be approximately 200' from the Solano
property.
10. ANTICIPATED IMPACTS: As proposed, the RV Park docking project would usurp and shade some 1072
ft2 of Public Trust Area and shallow estuarine habitat. Potential impacts to the bottom habitat would be minimized as a
result of the docks being fixed structures with the exception of the kayak and canoe launching dock. One would expect
some increase in the boat usage in the area because of the conversion of the boatramp from private to commercial use
with the RV Park. Boat usage would be limited to small craft because of the shallow water, especially around the
mouth of Glovers Creek.

In addition to the completed application form, the
following items must be submitted:
• A copy of the deed (with state application only) or
other instrument under which the applicant claims title
to the affected properties. If the applicant is not
claiming to be the owner of said property, then
forward a copy of the deed or other instrument under
which the owner claims title, plus written permission
from the owner to carry out the project.
• An accurate, dated work plat (including plan view
and cross-sectional drawings) drawn to scale in black
ink on an 8 1/2" by 11" white paper. (Refer to
Coastal Resources Commission Rule 7J.0203 for a
detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the
