Fish and Wildlife Service (Service) on the subject Public Notice (PN), dated October 26, 2006. The applicant, Robin Comer for Sunset Cove Subdivision, has applied for a Department of the Army (DA) permit to construct a pier and boat ramp in association with a proposed 18-lot subdivision. The proposed work is being considered under Regional General Permit #198000291, a permit/processing agreement for work that has been approved pursuant to the North Carolina Coastal Area Management Act (LAMA). These comments are submitted in accordance with the Fish and Wildlife Coordination Act (FWCA) (48 Stat. 401, as amended; 16 U.S.C. 661-6674). Comments related to the FWCA are to be used in your determination of compliance with 404(b)(1) guidelines (40 CFR 230) and in your public interest review (33 CFR 320.4) in relation to the protection of fish and wildlife resources. Additional comments are provided regarding the District Engineer's determination of project impacts pursuant to section 7 of the Endangered Species Act (ESA) of 1973, as amended (16 U.S.C. 1531-1543). Project Area, Proposed Activities, and Anticipated Impacts The project area, proposed work, and anticipated impacts are discussed in the Field Investigation Report (FIR), dated October 10, 2006, of the North Carolina Division of Coastal Management (NCDCM). The project area is on the mainland of Carteret County adjacent to White Oak River, southeast of the Town of Stella. The 16.72-acre tract contains vegetated uplands with a 15-foot- wide fringe of coastal wetlands along the White Oak River. The area of the river is classified as SA waters by the North Carolina Division of Water Quality (NCDWQ), but the area is not designated as a Primary Nursery Area (PNA) by the North Carolina Division of Marine Fisheries. The area is closed for shellfish harvcsting. The FIR states that shellfish resources and submerged aquatic vegetation do not appear to be present in the project area. The applicant proposes to subdivide the tract into 18 residential lots. As amenities to the subdivision, the applicant proposes to construct a 275-foot pier with five finger piers and a T- platform. Water depths at the waterward end of the pier are approximately four feet at normal low water (NLW). The applicant would also construct an elevated boat ramp and excavate 180 cubic yards of shallow bottoms to improve water depths. The excavation would increase water depths for one to three feet at NLW. 2 The FIR states that excavation would impact 2,925 square feet (ft) of estuarine bottoms. Construction of an access road to the docking facility would result in the fill and disturbance of 950 ftz and 420 ft2, respectively, of,fi'eshwater, or 404 wetlands. The proposed pier would shade 90 ft2 of coastal wetlands while the elevated portion of the ramp would shade 225 ft'`. impacts to open water of the White Oak River would include the shading and incorporation of 2,680 ft'` and 6,875 ftz, respectively. The PN does not provide a plan of compensatory wetland mitigation. Furthermore, the PN does not discuss any protective measures fur the approximately wetlands on the tract which would not be impacted by the activities discussed. Federally Protected Species The Service has reviewed available inforniation on federally-threatened or endangered species known to occur in Carteret County. We have also reviewed information from the North Carolina Natural Heritage Program (NCNHP) database which contains excellent data on the special status species, both federal and state. This database can be accessed by topographic quadrangle (quad) of the U. S. Geological Survey (USGS). Data from USGS quads provide the most project- specific information on species which should be considered in permitting this project. The project area is located in the Swansboro quad. The occurrence data of special status species within these quads can be obtained on the Internet at < httJ?:Uwww.ncsLu'ks.ncdnhp/quad.hUnl_ %. Our review indicates that the only federally listed species likely to occur near the project area is the West Indian manatee (Trichechus munutus), a federally-endangered mammal. There is a current record for this species in the Swansboro quad. The shallow waters of the project area may provide suitable habitat for manatees that move along the Atlantic Coast during summer months and are seasonal transients in North Carolina, primarily li'om June through October. Manatees may use water as shallow as one meter (3.3 feet) deep. The species moves extensively when in North Carolina waters and past occurrence records cannot be used to precisely determine the likelihood that it will be presence at a particular Construction site. While existing water depths in the proposed exaction area (- 1 foot NLW) would preclude manatee, the proposed excavation with a backhoe and the placement of pilings for the pier, T- platform, and finger piers may pose a risk to manatees. To protect manatees in North Carolina, the Service developed guidelines entitled "Precautions for General Construction in Areas Which May Be Used by the West Indlall Manatee In North Carolina.' These gLlldellnes address all types of in-water construction, except blasting, and should produce little, if any, additional expense. The guidelines are intended mainly to ensure that: (1) construction personnCI are informed that manatees may oCCI??' In the work area, (2) work should cease if a manatee 3 approaches the work area; and (3) work should not resume until the manatee leaves the work area. They also include procedures for reporting the death or injury of a manatee. These guidelines are available on our web site at < http://nc- es fws gov/mammal/lllanatec 9uidclines.jldf The risk to manatees could be reduced to an acceptable level by the implementation of the Service's guidelines. The risk would be further reduced by perlornling the work during the period of November through May. With the inclusion of'our manatee guidelines, the Service would concur with a determination by the District Engineer that the action is not likely to adversely affect species designated as threatened, endangered, or their designated critical habitat. The Corps' requirements pursuant to section 7 of the E:SA would be fulfilled. However, the Corps must reconsider its obligations under section 7 if: (1) new information reveals impacts of this identified action that may affect listed species or critical habitat in a manner not previously considered; (2) this action is subsequently modified in a manner which was not considered in this review; or, (3) a new species is listed or critical habitat determined that may be affected by the identified action. Service Concerns and Recommendations The Service is concerned that Evening Drive and Morning Court would use a curb and gutter design rather than grassy drainage swales. While the current design appears to have stornlwatcr management features, the quality of the water draining from the subdivision to White Oak River would be enhanced by the use of grassy drainage swales. We recommend that Such swales be considered in place of the Curb and gutter design. The Service is concerned that the River Access Road and the enlarged terminus at the boat ramp would infringe on, and require fill of Ireshwatcr wetlands. Site plan indicate that a slight eastward movement of this road would CIImInatC these 1111paCtS. We recommend that the applicant consider a realignment of tlhc I-Oad alld terminus area to avoid these wetland impacts. The Service is concerned that additional wetland losses could occur within the subdivision as individual homes are constructed. The Service recommends that. after all measures for greater avoidance and nlininlization have been fully considered, the wetlands which would not be impacted should be protected by a permanent conservation casement which would be noted in the deed of each lot within the subdivision. The easement conditions should include all the prohibited and restricted activities given in Article 11, including the prohibition (Iten1 B) on constructing piers, landing, docks, or any other temporary or permanent structure or facility. Item I prohibits grading, filling, excavation, dredging, and other activities within the casement area. The conditions of the conservation casement should be noted in the decd For each lot. Such a conservation easement would eliminate OLu'concerns about SCCOndary Cnvironnlcntal impacts. Overall, the Service recognizes the relatively small nature OfthC wetland impacts associated with this developnlciit. As noted we do bel1CVC additional Consideration should be given to eliminating the curb and gutter design to improve water quality, realigning River Access Road to 4 eliminate wetland fill, and the future protection of wetlands on the site which would not be impacted by the development currently proposed. With due consideration of these issues and reasonable measures to protect the manatee, the Service does not believe the activities described in the PN and FIR would have significant adverse and/or irreversible effects on fish and wildlife resources and we would have no objection, from the standpoint of fish and wildlife under our jurisdiction, to the issuance of a DA permit for the proposed activities. Site-specific stormwater management shall be designed to remove 85% TSS according to the latest version of DWQ's Stormwater Best Management Practices manual at a minimum. Additionally, in watersheds within one mile and draining to 303(d) listed waters, as well as watersheds that are classified as nutrient sensitive waters (NSW), water supply waters (WS), trout waters Jr), high quality waters (HQW), and outstanding resource waters (ORW), the Division shall require that extended detention wetlands, bio-retention areas, and ponds followed by forested filter strips (designed according to latest version of the NC DENR Stormwater Best Management Practices Manual) be constructed as part of the stormwater management plan when a site-specific stormwater management plan is required. For streams classified as Water Supply, High Quality Waters and Outstanding Resource Waters, post-construction, on-site stormwater management shall be required as appropriate and as outlined in 15A NCAC 2B .0104(m) and 2H .1000 to .1007, respectively, in addition to that required in this General Certification. Alternative designs may be requested by the applicant and will be reviewed on a case-by case basis by the Division of Water Quality. Approval of stormwater management plans by the Division of Water Quality's other existing state stormwater programs including appropriate local programs are sufficient to satisfy this Condition as long as the stormwater management plans meet or exceed the design requirements specified in this condition. This condition applies unless more stringent requirements are in effect from other state water quality programs. Unless specified otherwise in the approval letter, the final, written Stormwater management plan shall be approved in writing by the Division of Water Quality's Wetlands Unit before the impacts specified in this Certification occur. • The facilities must be designed to treat the runoff from the entire project, unless otherwise explicitly approved by the Division of Water Quality. • Also, before any permanent building or other structure is occupied at the subject site, the facilities (as approved by the Wetlands Unit) shall be constructed and operational, and the stormwater management plan (as approved by the Wetlands Unit) shall be implemented. • The structural stormwater practices as approved by the Wetlands Unit as well as drainage patterns must be maintained in perpetuity. • No changes to the structural stormwater practices shall be made without written authorization from the Division of Water Quality. 3. Erosion & Sediment Control Practices Erosion and sediment control practices must be in full compliance with all specifications governing the proper design, installation and operation and maintenance of such Best Management Practices in order to protect surface waters standards: a. The erosion and sediment control measures for the project must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control Planning and Design Manual. The design, installation, operation, and maintenance of the sediment and erosion control measures must be such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina Sediment and Erasion Control Manual. The devices shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the project. c. For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Surface Mining Manual. d. The reclamation measures and implementation must comply with the reclamation in accordance with the requirements of the Sedimentation Pollution Control Act. 4. No Waste, Spoil, Solids, or Fill of Any Kind No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of the impacts depicted in the Pre-Construction Notification. All construction activities, including the design, installation, operation, and maintenance of sediment and erosion control Best Management Practices, shall be performed so that no violations of state water quality standards, statutes, or rules occur. 5. No Sediment & Erosion Control Measures w/n Wetlands or Waters Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade restored within six months of the date that the Division of Land Resources has released the project. 6. Certificate of Completion Upon completion of all work approved within the 401 Water Quality Certification or applicable Buffer Rules, and any subsequent modifications, the applicant is required to return the attached certificate of completion to the 401/Wetlands Unit, North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650. Violations of any condition herein set forth may result in revocation of this Certification and may result in criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application and as authorized by this Certification shall expire upon expiration of the 404 or CAMA Permit. If you do not accept any of the conditions of this Certification (associated with the approved wetland or stream impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. Field Investigation Report: Sunset Cove Page 02 --------------------------- 9 Narrative Description: The Sunset Cove project is located on Wetherington Landing Road (SR l 101) near Stella in Carteret County. N.C. Hwy. 58 lies a few miles to the east of the site. The site is identifiable, by an abandoned house on a high bluff just before White Oak Bluffs subdivision. The White Oak River borders the site to the west. Sunset Cove is 16.72 acres in its entirety and varies from 0' to 34' in elevation above NHW. The high ground portion of the site is vegetated with.various upland grasses, mature Live Oaks and a tree fringe along the waterfront. A strip of Section 404 Wetlands that is approximately 100' wide runs parallel to the shoreline and into the property near the east side. The shoreline has a 15' wide fringe of coastal marsh that is both irregularly and regularly flooded. High marsh species include Cattail (Typha spp.), Black Needle Rush Quncus roemarianus), Salt Meadow Grass (Spagina patens) and Bullrush (Scirpus spp.). The regularly flooded low marsh has patches of Smooth Cordgrass (SSpartina alterniflora). The shoreline on the north west side of the proposed project is similar in nature and undeveloped. White. Oak Bluffs subdivision is south east of the proposed project and has a series of private docks. This section of the White Oak River is not a Primary Nursery Area as designated by the Division of Marine Fisheries and the Division of Water Quality classifies it as SA waters. The area in which the proposed project would take place is closed to the taking of shellfish. Carteret County's Land Use Plan dated 1996 classifies this area as Rural with Services and Conservation within the AFC's. The Division of Land Resources approved the sedimentation and erosion control plan (CA-2006166) on 12/22/05. The NCDOT driveway permit (D-2205104) was approved 12/06/05. There are no shellfish leases in the area. The substrate in the area is mainly sand and mud. It did not appear that shellfish resources or SAV's were present. 10. Proiect Description: The applicant is proposing an 18 lot subdivision (Sunset Cove) along with associated roads, drainage features and stabilization measures. As an amenity to the park the applicant is proposing a 275' pier and an elevated boat ramp. The pier would have a "T" platform and 5 finger piers creating a total of 10 slips. Proposed excavation around the pier and ramp would remove 180 yd3 in order to improve water depths. The high ground portion of this project would create 18 lots while disturbing a total of 126,585 ft2 for lot preparation and infrastructure. Three roads (510', 490'&140' respectively) leading to cul-de-sacs would be constructed along with 10 parking slips that are 10'X40' each for a total parking lot size of 135'X35'. Each road would be 20' wide with a 40' R.O.W. and each cul-de-sac would have a 70' diameter. Utilities would be placed in the road R.O.W. Road shoulders would have a 1":1' slope and road ditches would have a 3:1 slope. The cul-de-sac leading to the water would involve the filling of 950ft2 of Section 404 Wetlands. This cul-de- sac would be stabilized with a 530' retaining wall. The installation of this road and cul-de-sac could disturb an additional 420ft2 of Section 404 Wetlands. The total impervious area within 75' of NHW would be 3,100ft2. Two swales that are 20'X295' and 20'X40' would drain water from roads to the federal wetlands located between lots 4&5 and lots 1&2. They would have a 5:1 slope. Six culverts placed under roads are proposed to control drainage. Their dimensions are as follows; A-80'X1.5', B-48'X1.5', C-40'X1.5', D-26'X1.5', E- 56'X1.5', F-40'X2'. None of these are within or connect to wetlands or waters of the state. Extending from the southern most cul-de-sac would be an elevated boat ramp. The approach to the ramp would be 15'X50' and would be drip through decking, elevated 3' above marsh substrate. The concrete portion of the ramp would be 15'X35' and would slope to a pre excavation depth of -1'NLW, with a final project depth of -3' at NLW. The elevated portion of the ramp would shade 225ft2 of Coastal Marsh. Field Investigation Report: Sunset Cove Page 03 --------------------------- In an effort to improve water depths around the dock and ramp the applicant proposes to excavate an area 95' long that ranges from 15'-38' wide. This would involve the removal of 180 yd3 of silt and sand. Water depths would increase from an average of -1' at NLW to --3' at NLW. Excavation would terminate at the -3' NLW contour. Spoils would be place on the high ground portion of the project in a 60'X100' area on the western side of the property. There are no wetlands in the spoil disposal area. Adjacent to the boat ramp the applicant is proposing a 238'X6' dock extending 23 P from NIIW. Extending off the dock would be 5 fingers that are 3'X1.2' each and a 10'X40' "T" platform at the waterward.end. 17 mooring piles would be placed between fingers creating a total of 1.0 slips. The docking structure would extend 240' into the water body and would shade 90ft2 of coastal marsh. The White Oak River is approximately 2,800ft wide in this area. The developer has waived the 15' riparian setback for lots l &2. Water depths at the end of the proposed dock average 4' atNLW. There are similar piers of equal length along the same shoreline. 10. Anticipated Impacts: The proposed subdivision would result in a total of 18 lots ranging from .46 to 1.4 acres in size. One of the cul-de-sacs would fill 1,91 Oft' of Section 404 Wetlands and create 1,800ft2 of impervious area within the 75' Estuarine Shoreline for a total of 29.4%. The pier would result in a total of 10 slips. The potential exists for a large number of transient boaters to dock at this structure though the proposal is to sell the 10 slips to lot owners. Overboard discharge is possible from both permanent slips and from transient boaters. Temporary turbidity would result from the setting of the pilings and excavation. The proposed pier and ramp would shade 315 ft2 of vegetated wetlands and 2,680ft2 of open water. The pier, boat slips and ramp would incorporate 6,875 ft2 of public trust area. The project is located on Wetherington Landing Road, adjacent the White Oak River, in Stella, Carteret County, North Carolina. The project consists of construction of a ten-slip dock and boat ramp with access road and turn-around. An access channel to be excavated adjacent the boat ramp and a retaining wall are also included. The docking facility and boat ramp are being provided to meet the waterfront access and recreational needs of the subdivision, as well as the access and recreation requirements of the Carteret County Subdivision Ordinance. The dock and ramp will be located within the dedicated open space/recreation area of the subdivision. The boat slips will be sold to property owners of non-waterfront lots in the subdivision. All property owners within the subdivision will have use of the boat ramp. The ten-slip dock will be constructed of pressure treated lumber. Proposed dimensions are 231' (from NHW) x 6'. The structure will include 5 finger piers measuring 10' x 3' and 17 mooring pilings. An 8' x 16' T-platform is also included. A 98' x 15' boat ramp will be constructed of treated lumber and concrete. The elevated wooden portion of the ramp will measure 55' x 15' and the concrete portion will measure 43' x 15'. The elevated portion of the boat ramp will shade a very small fringe of coastal wetlands. A backhoe-type excavator will be used to dredge the sandy river bottom to accommodate the ramp design. Spoils will be loaded on a barge, hauled to shore, and then off-loaded and deposited in the low portion of the area of the subdivision set aside for recreation/open space. A 95' access channel associated with the boat ramp will also be excavated. The access road to the boat ramp will be graded and constructed of asphalt. In order to stabilize the sides of the access road, retaining walls will be installed. Roadway drainage will require the installation of six stormwater drainage pipes as indicated on plan drawings. None of the pipes will be installed in Areas of Environmental Concern.
