You have our authorization of exemption from the Neuse River Riparian Buffer Rules
[15A NCAC 2H.02331 for the purpose of constructing the building and associated parking as
described in correspondence with the Division of Water Quality (DWQ) on September 26, 2006.
After reviewing your submitted information and subsequent site visit by DWQ staff, DWQ has
decided that the stream feature on your property is not subject to the Neuse River Buffer Rules [15A
NCAC 02B .0233] and does not require written authorization.
This letter completes the review of the Division of Water Quality under the Neuse River
Riparian Buffer Protection Rules [15A NCAC 2B.0233]. Please call Ms. Amy Chapman at (919) 715-

Thanks Amy. Express was concerned that the stream may have been bufferred and requested a buffer exemption letter.
We are not planning on doing any work in the stream (i.e. culvert extensions, piping, etc.) so no mitigation is necessary.
Part of the parking area is going to be within 35 feet of the channel so we needed to make sure there were no buffer issues.
Please send a buffer exemption letter with project reference Commercial Mechanical Systems, 9400 Old Poole Rd,

I need a buffer determination on a stream located in Raleigh
behind the property addressed as 5400 Old Poole Rd. The property
can be pulled up on Wake County IMAPS with Pin# 1733-23-6601. I
performed a site visit yesterday and the stream conveyance scored
a 26 on the NCDWQ Stream Classification Form. However, I
researched the most recent USGS topographical maps and the NRCS
Soil Maps, and neither indicate the conveyance as a stream.
The plans for the commercial building were being reviewed by the
City of Raleigh and were kicked out of the Express Review Process
until we receive a buffer determination from DWQ. At the project
site, I noticed a recently built residential house located less
than 25 feet from the same stream on the adjoining property.
Other commercial properties adjacent to the stream also had
parking lots and storage areas within 50 feet of the conveyance.
Since the conveyance is identified on USGS or NRCS maps, I do not
believe the buffer regulations are applicable for this
conveyance.
