The Site consists of three parcels located at 2100-2106 Ralph Stephens Road and 1621 Little Moccasin Lane in Folly Springs, Wake County, North
Carolina. The western and eastern portions of the Site consists primarily of undeveloped wooded land, and the central portion of the Site consists
primarily of fallow agricultural field. Residential use is to the south and east, active construction is to the west, and forested land is to the north.

E. Impact Justification and Mitigation
1. Avoidance and Minimization
1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project:
Avoidance
The proposed development is located at 2100 Ralph Stephens Road, 2106 Ralph Stephens Road, and 1621 Little Moccasin Lane in Holly Springs,
Wake County, North Carolina. The Site consists of three tax parcels (Parcel #s 0648949728, 0658043671, and 0658049799) that total apprommately
41.5 acres.
H&H reviewed State and Federal Threatened and Endangered Species databases for the Site and conducted a screening survey of the Site and
surrounding area for Federal Threatened and Endangered Species, and none were identified. H&H also reviewed the National Registry of Historic
Places (NRHP) for Sites located in Wake County, North Carolina; the North Carolina State Historic Preservation Office (NC SHPO) GIS viewer; and the
Site and surrounding area via visual reconnaissance for the potential presence of historic, cultural, and/or archeological sites. Although the Jeff
Stephens/Alsey J. and Missouri Stephens House and farm complex are located in the eastern portion of the Site and were determined eligible for the
NRHP in 1997, the NC SHPO determined that the structures have since lost the structural and architectural integrity required to meet the eligibility
requirements. Therefore, the removal of these structures during the development of the proposed project will not have an adverse effect on a historic
property. Furthermore, NC SHPO determined that distance and vegetative barriers create an acceptable buffer between the Site and the NRHP-
eligible Richard L. Adams Farm located to the southeast of the Site, and therefore, the proposed project will not affect this historic property. H&H
requested comment on the Site from the United States Fish and Wildlife Service (FWS), North Carolina Wildlife Resources Commission (WRC), and
NC SHPO. Agency responses are included in Appendix D.
In regards to Site alternatives, the prospective developer has considered and evaluated other potential properties in the area for development of the
proposed commercial project. However, properties or property assemblages of this size are difficult to find and purchase along the frontage of major
road intersections. Additionally, the Site is ideally zoned as community business. The building footprints and access roadways have been designed to
primarily occupy upland areas to avoid on -Site Waters of the US to the ma>amum extent practicable. Furthermore, the wetlands, stream, and pond
located in the western portion of the Site will be completely avoided by the proposed development. Furthermore, Wetland 'B', Wetland 'C', and Pond
'2' in the eastern portion of the Site will also be completely avoided by the proposed development.
Minimization
To minimize Site impacts, the proposed Site plan was designed to avoid Waters of the US to the mapmum extent practicable. Site buildings, parking,
and stormwater management areas have been designed to occupy upland areas. The Site plan proposes two ingress/egress roadways into the Site,
which are required by the Town of Holly Springs in accordance with a traffic study. Of the 2.197 acres of wetlands on -Site, the developer is proposing
to impact only 0.022 acre of wetlands. Furthermore, of the 1,403 linear feet of streams located on -Site, the developer is proposing to impact only 121
linear feet of stream.
A previously designed preliminary Site plan prepared by Freeland & Kauffman, Inc. dated May 21, 2018 indicates that the developer originally
proposed a 103,000 -square foot Lowe's store, additional parking in the northeastern portion of the Site, and 12,000 -square feet of additional shops in
the northern portion of the Site. The development of the preliminary Site plan would have resulted in approximately 0.5 acre of wetland impact and 297
linear feet of stream impact. The Site developer has redesigned the Site plan to further reduce the impacts to on -Site streams and wetlands by
removing the parking spaces in the northeastern portion of the Site and removing the 12,000 -square feet of additional shops in the northern portion of
the Site. Furthermore, the Lowes store has been reduced from 103,000 square feet to 94,000 square feet. The preliminary Site plan is included in
Appendix F, and the current Development Plan is included in Appendix B.
To further minimize Site impacts, the proposed roadway in the east -central portion of the Site was redesigned to cross SCB at a perpendicular angle.
Furthermore, the impacts to Wetland 'D' are to the northernmost and upgradient portion of the wetland allowing the majority of Wetland 'D' to remain
intact. In addition, during Site development, good erosion and sediment control practices will be followed. Extensive silt fencing will be used on the
construction Site perimeter and along stream and wetland boundaries.

Mitigation is typically required by the USACE Nationwide Permit 39 for impacts greater than 0.1 acre of wetlands and/or 150 linear feet of stream. Due to the planned impacts of 0.022
acre of wetlands and 121 linear feet of stream, compensatory mitigation for wetland and stream impact is not proposed. According to the Table of Uses of the Neuse Buffer Rule, a
roadway crossing that impacts greater than 40 linear feet but equal to or less than 150 linear feet or one-third of an acre of riparian buffer is allowable without mitigation. Therefore,
compensatory stream buffer mitigation is not proposed.

Wil occur at a later date, the Site will be pad -ready for that construction. The current plans for the grocery store construction are included on the plans
provided in Appendix B. The construction of the grocery store at a later date will not result in additional impacts to streams, wetlands, or stream
buffers.
