Alternate Force Main Pipeline 1) At least two weeks prior to the onset of any construction, the permittee shall inform the Division of Coastal Management, the Division of Water Quality, and the US Army Corps of Engineers in writing of the site chosen for the pipeline (referred to as Preferred Discharge Point #1, or Alternate Discharge Point #2 on the attached workplan drawings). NOTE: Should Alternate Discharge Site #2 be chosen, a modification to The Division of Water Quality (DWQ) National Pollutant Discharge Elimination System (NPDES) Permit No. N00021849, .which was issued on 2/5/02, may be necessary. Contact DWQ directly for this determination. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. NOTE: The NC Division of Marine Fisheries and the NC Wildlife Resource Commission recommends that the Town of Hertford utilize Alternate Discharge Point #2 because this area of the river is wider and "more dynamic" than Preferred Discharge Point #1. The wind and wave action would provide better mixing of the discharge with the adjacent waters. Easement 3) Should Alternate Discharge Point #2 be selected, prior to the installation of the discharge pipe underneath and within the Perquimans River, the permittee shall apply for and receive an Easement from the Department of Administration's State Property Office, and a Utility Easement from the appropriate railroad company, if necessary. Sedimentation and Erosion Control 4) The permittee shall implement the "Planned Erosion and Sedimentation Control Measures" outlined in the project narrative submitted with the permit application submitted for this project. General 5) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 6) The authorized structure and associated activity shall not cause an unacceptable interference with navigation. 7) This modification shall be attached to the original of Permit No. 105-04, and copies of both documents, shall be readily available on site when Division personnel inspect the project for compliance. 8) All conditions and stipulations of the active permit remain in force under this modification, unless specifically altered herein. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. After reviewing your application, we have determined that the Division of Water Quality (DWQ) General Water Quality Certification Number 3400 covers these water impacts. This Certification allows you to General Permit No. 198000291 when issued by the US Army Corps of Engineers (USACE). In addition, you should get or otherwise comply with any other federal, state and local requirements before you go ahead with your project including (but not limited to) erosion and sediment control regulations and CAMA. PROJECT SUMMARY: The Town of Hertford wastewater treatment plant is located at the end of Meads Circle (SR 1109), Hertford, and on the west side of Perquimans River, Perquimans County. The applicant was authorized under CAMA Major Permit #105-04 to construct a 2,525-ft., 10-inch maximum diameter force main pipeline (route #1), from the existing wastewater treatment plant heading northeast adjacent to an existing ditch to Perquimans River with the outfall located west of the Perquimans River railroad track crossing. The applicant is now requesting, under a major modification, to have the option to instead construct an alternate 3,855-ft., 10-inch maximum diameter force main pipeline (route #2) from the wastewater treatment plant heading east, across spray irrigation fields and the railroad tracks to Perquimans River, with the outfall located southeast of the Perquimans River railroad track crossing. The applicant is seeking authorization to choose between these two routes, route #1 authorized under CAMA Major Permit #105-04, or route #2 currently being proposed, pending upon contractor bids. PROJECT SETTING The project site is the existing wastewater treatment plant for the Town of Hertford, located off Center Hill Rd. (SR 1110), approximately one-third of a mile down Meads Circle (SR 1109), in the northwest section of Hertford, Perquimans County, adjacent to the western shore of Perquimans River. The plant is located on a one and one-half acre lot that has an elevation of approximately 13-feet above normal water level (NWL). The tract contains indigenous weeds and grasses and has AltaVista soils. The Town of Hertford owns 166.5 acres, which includes the plant lot, adjacent farm fields, and bottomland hardwood forest classified as Section 404 Wetlands. The fields were historically planted with row crops, and are currently overgrown with native weeds and grasses, and are the sites of future spray irrigation area for the wastewater treatment plant. The proposed alternate route #2 will require the crossing of Norfolk- Southern railroad tracks to the east and maple, gum, and cypress swamp fringe owned by Phillip and Mitzi Francis prior to entering Perquimans River. The applicant is currently obtaining a utility easement for the proposed alternate route #2. The authorized route #1 was in a northerly direction through a utility easement to Perquimans River, adjacent to an existing ditch through wetlands, which connects with the Perquimans River in an area that has a maximum water depth of approximately -19-feet below NWL and a width of approximately 500- feet. The existing, approximate 2,000-foot long by 25-foot wide by 2-foot deep ditch through wetlands is currently being used as the effluent discharge outfall in close proximity to existing 0.40 MGD wastewater treatment plant. The proposed alternate route #2 would connect with the Perquimans River in an area that has a maximum water depth of approximately -15-feet below NWL and a width of approximately 850- feet. The adjacent riparian properties consist of a continuation of the wooded swamp. The railroad track and trestle crossing the Perquimans River is located approximately 2,200-feet east of authorized route #1 and approximately 3,000-feet north of proposed alternate route #2 discharge point into Perquimans River. The applicant was authorized under CAMA Major Permit #105-04 on July 22, 2004, and Division of Water Quality National Pollutant Discharge Elimination System (NPDES) Permit No. N00021849 on February 5, 2002, General Water Quality Certification (DWQ Project No. 040946) on July 14, 2004, and •? No. 200411575) on July 14, 2004, to construct a 2,525-foot, 10-inch maximum diameter force main pipeline (route #1) from the existing wastewater treatment plant heading northeast through a utility easement to the Perquimans River. There was no observed presence of submerged aquatic vegetation or shellfish in the vicinity of the alternate route #2 discharge point into Perquimans River on August 29, 2006. Reviews of available information suggest that there are no known archeological sites or geologic formations associated with the applicant's property. The waters of Perquimans River at the proposed alternate route #2 are classified as SC, and the waters at the authorized route #1 are classified as C Sw by the Division of Environmental Management and are closed to shellfish harvesting. DEVELOPMENT PROPOSAL The applicant proposes to make improvements to the existing municipal wastewater treatment plant that consists of construction of an effluent force main pipeline to a discharge point approximately 13-feet below NWL in the channel of the Perquimans River. Construction will include the extension of 2,740 linear feet of 10-inch PVC (open cut) and 1,115 linear feet of 12-inch HDPE (directional bore) force main from the Town of Hertford wastewater treatment facility through utility easement alternate channel #2 to the channel of the Perquimans River. In comparison, the authorized construction under CAMA Major Permit #105-04 was for the extension of 400 linear feet of 8-inch PVC (open cut) and 2,125 linear feet of 10-inch HDPE (directional bore) force main from the plant northward adjacent to the existing ditch to Perquimans River. Construction will begin on Town of Hertford property, then alternate route #2 is proposed via directional bore with a utility easement beneath Norfolk-Southern Railway Co. and Phillip and Mitzi Francis' properties prior to directional bore under the Perquimans River. Unlike the authorized route #1, the majority of alternate route #2 will be installed by open cut across uplands. Directional bore under wetlands and the Perquimans River will also be performed, but will be approximately 1,000 linear feet less than that required for authorized route #1. A 20-foot wide corridor will be disturbed throughout the open cut section, and a minimum of 3-foot depth will be maintained during directional bore throughout the entire wetlands and under the Perquimans River for the tertiary treated wastewater pipeline. The total area that will be disturbed during construction of the effluent force main is approximately 1.26 acres of upland area (2,740-feet by 20-feet) by open cut. All areas where directional bore will take place will remain completely undisturbed, with the exception of the end of the effluent pipe at the outfall diffuser, which is estimated to be approximately 16 square feet. The pipe will enter the Perquimans River at approximately 294-feet waterward of NWL at -13-foot depth. Approximately 20-feet of pipe will extend to the diffuser, which will lie on the river bottom. The diffuser will contain eleven 4-inch flanged end valves staggered 4-inches apart and will be marked with a lighted pilon approximately 10-feet above NWL. Sedimentation and erosion control methods used will include temporary silt fencing, rock check dams, and inlet protection. Silt fence will be installed along farm ditch areas adjacent to the open cut portion of the project. Rock check dams will be installed as a temporary measure throughout the project to restrict the velocity within the disturbed roadside ditches or channels affected thereby reducing the potential of erosion. These check dams will also serve as temporary sediment traps and will be placed wherever necessary as shown on the construction plans. However, rock check dams will not likely be necessary Town of Hertford, WWTP Improvements, MP#105-04MM Field Investigation Report Page 4 due to flat grade of the property. Inlet protection will be provided on all existing drainage pipes and inlets on the project to ensure proper sediment containment. ANTICIPATED IMPACTS The development proposal will disturb approximately 16 square feet of Public Trust Area, Area of Environmental Concern (AEC), river bottom and approximately 54,800 square feet of upland area outside the Public Trust Shoreline AEC by open cut installation of the pipeline. The project does not appear to present a hazard to navigation in this area due to the significant water depths, width of Perquimans River, and proposal to properly mark the diffuser with a lighted pilon. Localized turbidity during construction can be expected as well as during operation. The effluent through the proposed pipeline will meet current water quality standards for existing conditions which currently discharge directly into a canal to Perquimans River. A proposed spray field area will be utilized for discharge of the effluent. Therefore, the amount of discharge into Perquimans River is expected to decrease with use of the proposed spray field in conjunction with the pipeline and diffuser discharge into Perquimans River until population pressure increases the demand for more gallons per day of treated wastewater. Site Description ' The project will be constructed on the existing wastewater treatment facility site directly northwest of the Town of Hertford. The total area that will be disturbed during ' construction of the effluent force main in the Perquimans River is approximately 0.004 acres. This disturbance includes the proposed diffuser that is to be permanently installed in the channel of the Perquimans River. The topography in the project area consists of flat wetland areas with the only significant elevation above normal water level being`at the existing wastewater treatment plant site. A 20.0 ft. wide construction corridor was used in estimation of area to be disturbed by installation of effluent force main by open- cut method. All areas where directional-bore is to take place will remain undisturbed., As a portion of the proposed Wastewater Treatment Improvements project, the Town of Hertford is constructing an alternate route of an extension of effluent force main to a discharge point deep in the channel of the Perquimans River. This alternate route reflects . a major modification to CAMA Major Permit #105-04. Construction will include the extension of 2,740 LF of 10" ? PVC (open-cut) and 1,115 LF of 12"? HDPE (directional- bore) force main from the Town of Hertford Wastewater Treatment Facility to the channel of Perquimans River. All construction, with the exception of force main buried beneath Perquimans River, will take place either on property owned by _or easements maintained by the Town of Hertford. There will be one railroad crossing on this route that will be installed in the directional bore portion of pipe required'by this project: All force main installed beneath wetlands will be by directional-bore only.: The remaining . ortion of force main in upland areas will be installed by open-cut method. A minimum Planned Erosion and Sedimentation Control Measures 1. Silt Fencing - Silt Fence will be installed as shown on the construction plans or as- deemed necessary by visual inspection. VAW005\05027\05027-CAMAnar.doc Proiect Bid Process - Base Bid and Alternate Bid for Force Main Route This project will include a base bid for the entire construction proposed. The proposed construction will include line items for construction of the effluent force main on the northerly route to the Perquimans River at the existing discharge point. In addition to the base bid items there will be an alternate bid item included below the base bid that describes the construction of the effluent force main on the easterly route to the Perquimans River and at a newly proposed discharge location. The Town of Hertford reserves the right to choose which route will be accommodated, based on the prices received on the base bid and the alternate bid for the alternate force main route. The Town will most likely choose the most economically feasible route for construction. The awarded contract will only include one (1) force -main route, depending on which route the -Town - deems most feasible. Once that route is chosen and the contract is awarded, the remaining route that was not chosen by the Town will be dropped from consideration and a CAMA permit will no longer be necessary for that location. In essence, only one route to the Perquimans River is proposed and only one route to the Perquimans River will exist in the future. Thus, the Town will only need a CAMA permit for construction of one (1) route once bids are received and the contract is awarded. The Town of Hertford merely has to decide on which route is most feasible as to which route will be constructed.
