Shoreline Stabilization 1) The alignment of the authorized bulkhead and riprap shall be staked by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of any construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions shall require the alignment to be restaked by DCM within a maximum of 30 days prior to the new expected start of construction. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit shall be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Coulbourn, III ADDITIONAL CONDITIONS Permit 41189-06 Page 2 of 3 2) The alignment of the approved bulkhead and riprap shall adhere to the 'alignment depicted on the attached workplan drawings. 3) The bulkhead shall be constructed prior to any backfilling activities. 4) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 5) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other suitable materials approved by department personnel. No excavation or other land disturbing activities is permitted except for that which may be required for the construction of the bulkhead wall, riprap, deadmen cables, etc. This permit does not authorize -any excavation waterward of the approved alignment. 6) The riprap material shall be free from loose dirt or any pollutant. It shall be of a size sufficient to prevent its movement from the approved alignment by wave or current action. 7) The alignment of the approved riprap shall not extend more than 7 feet waterward from the approved bulkhead. 8) The riprap material shall consist of clean rock or masonry materials such as but not limited to granite, marl, or broken concrete. 9) The backfill material shall be clean and free of any pollutants except in trace quantities. 10) All backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. Sedimentation and Erosion Control 11) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.). At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. 12) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion within thirty days of project completion. General 13) No vegetated wetlands shall be excavated or filled, even temporarily. Director Division of Water Quality DWQ Project # 06-1514 Dare County You have our approval, in accordance with the attached conditions, to fill or otherwise impact 0.0249 acres of Public Trust Area (PTA), estuarine waters (EW), and 0.1067 acres of shallow water habitat, to construct the proposed bulkhead and rip rap, as described in your application dated August 21, 2006, and received by the Division of Water Quality (DWQ) 401 Oversight/Express Review Permitting Unit on September 18, 2006. After reviewing your application, we have determined that the Division of Water Quality (DWQ) General Water Quality Certification Number 3400 covers these water impacts. This Certification allows you to General Permit No. 198000291 when issued by the US Army Corps of Engineers (USACE). In addition, you should get or otherwise comply with any other federal, state and local requirements before you go ahead with your project including (but not limited to) erosion and sediment control regulations and CAMA. Also, this approval to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon expiration of the 404 or CAMA Permit. PROJECT SUMMARY: The applicant proposes to construct a bulkhead and place riprap in line with adjacent property shorelines in order to stabilize his shoreline. Field Investigation Report: Edwin T. Coulbourn, Jr. Page 2 Project Setting The site of the proposed development is a 47,986-square foot undeveloped lot located adjacent to the south side of 5552 Old Ferry Dock Road (SR 1110) and adjacent to the south intersection of US 64/264 and SR 1110 in Manns Harbor, Dare County and adjacent to the Croatan Sound. The lot has an elevation of approximately 3 feet above normal water level (NWL), has sandy soils, and is vegetated with indigenous grasses. Man-made features on the property consist of riprap return walls on each side of the property that were constructed to protect the adjacent lots and 3 wooden jetties located approximately 70 feet offshore. The adjacent riparian properties consist of lots with single-family dwellings and both shorelines are stabilized with riprap. Because of shoreline erosion on the applicant's property, the riprap shoreline of both adjacent properties is approximately 35 feet waterward of the applicant's shoreline. Shoreline erosion on the Croatan Sound is significant due to fetch and orientation. The shoreline area is sandy with an erosion escarpment approximately 10 feet landward of NWL. The near shore bottom is sandy with sparse colonies of water milfoil and duck grass submerged aquatic vegetation existing. The waters of Croatan Sound in this area are classified as SA and are open to shellfish taking and the existing water depths in the project area are approximately -2 feet below NWL. Development Proposal In order to prevent erosion and provide shoreline stabilization the applicant proposes to construct a 155-foot long wood/vinyl bulkhead an average distance of 30 feet waterward of NWL with a maximum distance of 37 feet waterward of NWL. The area behind the bulkhead will be backfilled, graded and stabilized with vegetation. The applicant proposes to place riprap in front of the proposed bulkhead to provide increased protection from wave energy. The riprap will have a 7-foot wide footprint and extend 155 feet. The proposed bulkhead and riprap alignment will be consistent with the adjacent properties. Anticipated Impacts The proposed bulkhead will result in the filling of approximately 4,650 square feet of shallow water Public Trust Area (PTA) and Estuarine Waters (EW) Areas of Environmental Concern (AEC). The proposed riprap placement will result in the filling of approximately 1,085 square feet of PTA, EW AEC. Approximately 129 cubic yards (cy) of backfill material will be placed below NWL and approximately 30 (cy) of riprap material will be placed below NWL. Field Investigation Report: Edwin T. Jennings, III Date: 09/11/06; Revised 09/14/06 k- Coulbourn - Shoreline Stabilization Project Narrative The Coulbourn Project includes the construction of bulkhead and rip-rap shoreline stabilization structure a portion of eroded shoreline of the Croatan Sound in Manns Harbor, Dare County. The Coulbourn property is owned by father Et son, Edwin T. Coulbourn, Jr. and Edwin T. Coulbourn, III. For the purposes of this CAMA Major Permit Application, the project will be referred to as the Coulbourn - Shoreline Stabilization Project. The site is located in the community of Manns Harbor in Dare County, just south of the old Croatan Sound Bridge, west of Roanoke Island and the Town of Manteo. The site consists of a 47,986 sf lot. The shoreline previously stabilized with a bulkhead structure Et wooden jetties, however, the bulkhead has long since failed Et was not repaired by the previous landowner, leaving an erosion escarpment along the shoreline that is approximately 40 ft landward of the adjacent shorelines to the north Et south. The waterward corners of the property are currently stabilized with rip rap material. The adjacent property shorelines are stabilized adjacent to the Coulbourn property with rip rap Et bulkhead structures. The land adjacent to the shoreline is upland and is 3 to 4 ft above the NWL. The property owners estimate that an average of 5 ft of shoreline has eroded away in the last year along the shoreline that is no longer stabilized. It is the intent of this application to request a bulkhead Et rip rap shoreline stabilization alignment that is consistent Et aligned with the stabilization structures directly adjacent to the Coulbourn property. This proposed alignment is similar to the remnant bulkhead alignment. The proposed bulkhead alignment will extend an average of 30 ft landward of the existing 'crescent shaped NWL', a maximum of approximately 37 ft. The existing rip rap at he property corners will only be removed enough to allow for the bulkhead wall return walls Et main bulkhead wall to be built. The backfill- tieback area will be backfilled with clean sand Et fill material from an off-site location. A rip rap rock material structure is also proposed to be placed an average of 7 ft waterward of the new bulkhead. It is proposed that the structure 'toe' extend an average of 7 ft beyond the new bulkhead wall, while the structure's height will be about one foot above the NWL, a total height of about 36 inches, allowing for a stabile rock slope. The old remnant bulkhead will be removed Et the existing wooden jetty structures will either be repaired or removed, depending upon their condition. If their repair will require permit authorization, this replacement authorization will be requested under a separate permit request.
