The purpose of this letter is to notify you that the North Carolina Ecosystem Enhancement Program (NC EEP) is willing to
accept payment for impacts associated with the above referenced project. Please note that this decision does not assure that
the payment will be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the
applicant to contact these agencies to determine if payment to the NC EEP will be approved.

Upon receipt of payment, EEP will take responsibility for providing the compensatory mitigation for the permitted impact::
up to a 2:1 ratio, (buffers, Zone 1 at a 3:1 ratio and Zone 2 at a 1.5:1 ratio). The type and amount of the compensatory
mitigation will be as specified in the Section 404 Permit and/or 401 Water Quality Certification, and/or CAMA Permit. The
mitigation will be performed in accordance with the Memorandum of Understanding between the N. C. Department of
Environment and Natural Resources and the U. S. Army Corps of Engineers dated November 4, 1998.

The North Carolina Ecosystem Enhancement Program (NCEEP) has received a check as indicated above as payment for the
compensatory mitigation requirements of the 401 Water Quality Certification/Section 404 Permit issued for the above
referenced project. This receipt serves as notification that the compensatory mitigation requirements for this project have
been satisfied. You must also comply with all other conditions of this certification and any other state, federal or local
government permits or authorization associated with this activity.
The NCEEP, by acceptance of this payment, acknowledges that the NCEEP is responsible for the compensatory mitigation
requirements associated with the project permit and agrees to provide the compensatory mitigation as specified in the permit.

Dear Mr. Ehlin:
You have our approval, in accordance with the conditions listed below, to impact approximately
246 square feet (ft2 ) of Zone 2 of the protected buffers to construct a screen porch at the subject
property as described within your variance request dated September 08, 2006 and received by the
Division of Water Quality (DWQ) on September 12, 2006. This letter shall act as your Minor
Variance approval as described within 15A NCAC 213 .0233(9)(b). In addition to this approval,
you should obtain or otherwise comply with any other required federal, state or local permits
before you go ahead with your project including (but not limited to) Erosion and Sediment
Control regulations.
This approval is for the purpose and design that you described in your application. If you change
your project, you must notify us and you may be required to send us a new application. If the
property is sold, the new owner(s) must be given a copy of this variance approval and is
thereby responsible for complying with all conditions. This approval requires you to follow
any conditions listed below.
The Additional Conditions of the Certification are:
1. No Zone 1 Impacts
No impacts (except for the "exempt" uses as identified within 15A NCAC 213 .0233)
shall occur to Zone 1 of the protected riparian buffers unless otherwise approved by the
DWQ. No impervious surfaces shall be added to Zone 1, unless otherwise approved by
the DWQ.

2. Buffer Mitigation (Buffer Restoration Fund)
You are required to mitigate for impacts to the protected riparian buffers. The required
area of mitigation to compensate for impacts to the protected riparian buffers will 246
square feet as required under this variance approval and 15A NCAC 213 .0233. The DWQ
understand that you wish to make a payment into the Riparian Buffer Restoration Fund
administered by the NC Ecosystem Enhancement Program (EEP) to meet this mitigation
requirement. This has been determined by the DWQ to be a suitable method to meet the
mitigation requirement. In accordance with 15A NCAC 213 .0233, this contribution will
satisfy our compensatory mitigation requirements under 15A NCAC 213 .0233(9)(C).
Until the EEP receives and clears your check (made payable to: DENR - Ecosystem
Enhancement Program Office), no impacts specified in this variance approval shall occur.
Ms. Susan Klimek should be contacted at (919) 733-5205 if you have any questions
concerning payment into the EEP. For accounting purposes, this variance approval
authorizes payment into the Riparian Buffer Restoration Fund to compensate for
369 ft2 of required riparian buffer mitigation for impacts to 246 ft2 of protected
riparian buffers; 03-04-02, 27-33-(10) river and subbasin."
The DWQ will also accept an alternative method of mitigation (including but not limited
to Buffer Restoration or Enhancement) pursuant to the Buffer Mitigation Rule (15A
NCAC 02B .0233) to satisfy this mitigation requirement. If you choose to pursue this
option, then you are required to submit in writing a mitigation plan to the DWQ 401
Oversight/Express Permitting Unit for review and approval. No impacts shall occur to
the protected buffers until the mitigation plan is approved by the DWQ.
3. Diffuse Flow(no review)
An additional condition is that all stormwater shall be directed as diffuse flow at non-
erosive velocities through the protected stream buffers and will not re-concentrate before
discharging into the stream as identified within 15A NCAC 213 .0233(5). You have stated
in your minor variance application that stormwater from the home construction will be
directed via gutters outside of the buffers and that the stormwater will not be discharged
into the buffers.
4. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or
applicable Buffer Rules, and any subsequent modifications, the applicant is required to
return the attached certificate of completion to the 401 Oversight/Express Permitting Unit,
North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC,
27699-1650.

5. Deed Notifications
Deed notifications or similar mechanisms shall be placed on all retained protective
buffers in order to assure compliance for future buffer impacts. These mechanisms shall
be put in place prior to impacting any wetlands, waters and/or buffers approved for
impact under this Authorization Certificate.
Requests for appeals of this decision shall be made to the Office of Administrative Hearings. If
you do not accept any of the conditions of this approval, you may ask for and adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a
hearing, send a written petition which conforms to Chapter 150B of the North Carolina General
Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC
27699-6714. This approval and its conditions are final and binding unless you ask for a hearing.
This Minor Variance Approval shall expire five (5) years from the date of this letter.
This letter completes the review of the Division of Water Quality under the Neuse River
Riparian Buffer Protection Rules [15A NCAC 2B.0233(9)(b)]. Please call Ms. Amy Chapman

1. Buffer Mitigation
I'm planning to provide buffer mitigation by a payment to the Riparian Buffer Restoration Fund
consistent with the size of the impacted area, i.e. 246 sgft x 1.5 x $0.96 = $354.24
2. Stormwater Management
Stormwater management will be performed in accordance with submitted drawings and description
in the application Part 2, page 3, paragraph 3, by connecting gutters on the screen porch to
existing gutter system and down spouts on the residential property.

Dear Mr. Ehlin:
On September 12, 2006, the Division of Water Quality (DWQ) 401 Oversight/Express Permitting Unit
received your Minor Variance dated September 8, 2006 regarding your request for a Minor Variance from
the Neuse Buffer Rules (15A NCAC 213 .0233) for the subject property. The Division of Water Quality
(DWQ) is required to prepare a "preliminary finding" /"finding of fact" as to whether the variance request
meets the requirements of 15A NCAC 02B .0233(9)(a). The DWQ may attach conditions to a variance
approval that support the purpose, spirit and intent of the riparian buffer protection program. Conditions
usually include stormwater management and buffer mitigation.
Additional information will be required before we can proceed with the review of your variance request.
Therefore, unless additional information is provided as described below, we will have to move toward
denial of your request per 15A NCAC 2B .0233 and will place this project on hold as incomplete until we
receive this additional information.

1. Description of proposed activity [Also, please attach a map of sufficient detail (such as a plat
map or site plan) to accurately delineate the boundaries of the land to be utilized in carrying
out the activity, the location and dimension of any disturbance in the riparian buffers
associated with the activity, and the extent of riparian buffers on the land. Include the area

Manual digging of holes to create appropriate pressure treated wood posts in concrete
footing to support porch and deck. Construction of screen porch using manual

through property. Construction area is currently an established lawn.

2. State reasons why this plan for the proposed activity cannot be practically accomplished,
reduced or reconfigured to better minimize or eliminate disturbance to the riparian buffers:
Existing residential house, built in 1997, is already impacting Buffer Zone 2. All
alternative placements of a screen porch would either also have an impact on the buffer

zone or significantly reduce the value of the properly (while screen porch would be placed
in an abnormal location, e.g. in front of the house).
3. Description of any best management practices to be used to control impacts associated with
the proposed activity (i.e., control of runoff from impervious surfaces to provide diffuse flow,
re-planting vegetation or enhancement of existing vegetation, etc.):
_Storm water will be collected in gutters on new screen porch and connected to existing
house gutters.
4. Please provide an explanation of the following:
(1) The practical difficulties or hardships that would result from the strict application of this
Rule.
Not being able to construct the desired screen porch would negatively impact the ability
to fully enjoy the property and desired lifestyle typical for the neighborhood. The family would
have to move to be able to enjoy a screen porch.
(2) How these difficulties or hardships result from conditions that are unique to the property
involved.
_Existing house built in 1997 is already impacting Riparian Buffer Zone 2. There is no
natural way to construct a screen porch on this property that would not impact the buffer
zone.
(3) If economic hardship is the major consideration, then include a specific explanation of the
economic hardships and the proportion of the hardship to the entire value of the project.
A significant number of comparable size houses in the neighborhood have constructed
screen porches and "oversized" decks. To ensure a consistent value of this property,
construction of a screen porch and deck extension is highly desirable. Selling the property
and moving to a different location with current higher property prices would mean a
significant economic hardship to the family while the existing property will be harder to sell.
Similar size properties with screen porches are selling for well more than $100,000 above the
amount invested in this house in 2001. Addition of the screen porch will cost $20,000 and
make the property more desirable. _
Part 3: Deed Restrictions
By your signature in Part 5 of this application, you certify that all structural stormwater best
management practices required by this variance shall be located in recorded stormwater
easements, that the easements will run with the land, that the easements cannot be changed or
deleted without concurrence from the State, and that the easements will be recorded prior to the
sale of any lot.

out the activity, the location and dimension of any disturbance in the riparian buffers
associated with the activity, and the extent of riparian buffers on the land. Include the area

roof and adjoining 9'x12' deck to connect to existing decking on residential property.
Manual digging of holes to create appropriate pressure treated wood posts in concrete
footing to support porch and deck. Construction of screen porch using manual
woodworking equipment. Corner of screen porch located 33' from intermittent stream
through property. Construction area is currently an established lawn.
Area of buffer Zone 2 Impacted: 246 sgft
2. State reasons why this plan for the proposed activity cannot be practically accomplished,
reduced or reconfigured to better minimize or eliminate disturbance to the riparian buffers:
Existing residential house, built in 1997, is already impacting Buffer Zone 2. All
alternative placements of a screen porch would either also have an impact on the buffer

zone or significantly reduce the value of the property (while screen porch would be placed
in an abnormal location, e.g. in front of the house).
3. Description of any best management practices to be used to control impacts associated with
the proposed activity (i.e., control of runoff from impervious surfaces to provide diffuse flow,
re-planting vegetation or enhancement of existing vegetation, etc.):
_Storm water will be collected in gutters on new screen porch and connected to existing
house gutters.
4. Please provide an explanation of the following:
(1) The practical difficulties or hardships that would result from the strict application of this
Rule.
Not being able to construct the desired screen porch would negatively impact the ability
to fully enjoy the property and desired lifestyle typical for the neighborhood. The family would
have to move to be able to enjoy a screen porch.
(2) How these difficulties or hardships result from conditions that are unique to the property
involved.
_Existing house built in 1997 is already impacting Riparian Buffer Zone 2. There is no
natural way to construct a screen porch on this property that would not impact the buffer
zone.
(3) If economic hardship is the major consideration, then include a specific explanation of the
economic hardships and the proportion of the hardship to the entire value of the project.
_A significant number of comparable size houses in the neighborhood have constructed
screen porches and "oversized" decks. To ensure a consistent value of this property,
construction of a screen porch and deck extension is highly desirable. Selling the property
and moving to a different location with current higher property prices would mean a
significant economic hardship to the family while the existing property will be harder to sell.
Similar size properties with screen porches are selling for well more than $100,000 above the
amount invested in this house in 2001. Addition of the screen porch will cost $20,000 and
make the property more desirable. _
