Director Division of Water Quality DWQ Project #06-1417 County: Wake Subject Property: Pullen Park Proposed Greenway and Geothermal Duct Crossing [030301, 28-29-6, C, NSW] NO WRITTEN CONCURRENCE NEEDED Dear Mr. Little: You have our authorization of exemption from the Neuse River Riparian Buffer Rules [I 5A NCAC 2H.0233] for the purpose of constructing the proposed greenway and for the installation of the geothermal duct crossing as described in submittal dated June 22, 2006 and received by the Division of Water Quality (DWQ) on June 28, 2006. After reviewing your information and based on a meeting with you on June 16, 2006, we have decided this impact is an exempt activity in accordance with the Neuse River Buffer Rules [15A NCAC 02B .0233] and does not require written authorization. This authorization is only valid for the purpose and design that you described in your June 22, 2006 submittal. If you change your project, you must notify us and you may be required to send us a new application. Requests for appeals of this decision shall be made to the Office of Administrative Hearings. If you do not accept any of the conditions of this approval, you may ask for and adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699-6714. Attached is a drawing showing the existing greenway, the proposed greenway, and the proposed geothermal duct crossing both zones of the Neuse River buffer. At the meeting you advised that this proposed greenway work is exempt from North Carolina's Neuse buffer rules. You also advised that the proposed geothermal system crossing of the Neuse Rover buffer is exempt since it is classified as a non- electrical utility crossing of less than forty feet width. With both of these proposed improvements being exempt, it is my understanding that neither Neuse River buffer permits nor 401 water quality certifications will be required for their construction. I would appreciate your confirmation of these exemptions by a written response or by signing and returning one copy of this letter in the space provided below.
