DWQ Project #20061397, 401 Water Quality Certification PROJECT: Ocean Isle Development Subdivision COUNTY: Brunswick The subject project as proposed in the revised site plan received by the Wilmington Regional Office on September 15, 2006, does not require a 401 Water Quality Certification from the Division of Water Quality provided that bridges are installed to provide access to lots 52, 60, 61, 64, 65, 68, 69, 73, and 74. The Division of Water Quality requests that the Division of Coastal Management include the following conditions in the CAMA Major Permit: Deed Restrictions that prohibit the filling ofjurisdictional wetlands and require the construction of an elevated and supported bridge to provide access must be recorded for lots 52, 60, 61, 64, 65, 68, 69, 73, and 74 prior to the sale of these lots. The following deed notifications or similar tltechanlstn must be recorded prior to beginning land disturbing activities for all other lots with jurisdictional wetlands and waters in order to assure compliance for fixture wetland and water impact. "A portion of this lot has been determined to meet the requirements for designation as a wetland, stream or protected stream buffer. Airy subsequent fill or alteration of this area shall conform to the requirements of the state rules adopted by the State of North Carolina in force at the time of the proposed alteration. The intent of this provision is to prevent additional wetland, stream or buffer filling or draining, so the propertyowner should not asstane that a future application for filling or draining would be approved. The propertyowner shall report the name of the subdivision in any applicationu pertaining to said rules. This covenant is untended to ensure continued compliance with all rules adopted by the State of North Carolina and therefore the State of North Carolina may enforce benefits. INTRODUCTION Morehead City DCM The applicant, OIB East Developing Company, proposes to construct a residential subdivision with 194 single-family lots and associated roads within the ninety-one acre project area, located at the east end of Ocean Isle Beach, NC. In addition, the applicant plans to create a walking trail with elevated pedestrian bridges that will connect several upland islands located in common areas. II. EXISTING CONDITIONS The 91-acre project area is located at the east end of Ocean Isle Beach in Brunswick County, North Carolina. It is bound by Second Street to the south, Lee Street to the west, Shallotte Boulevard to the east, and Shallotte Sound to the north (Sheet 1). The tract is located within an Ocean Hazard Area of Environmental Concern (as is the entire island of OIB). Existing high ground elevations are 2' to 7' above MLW (Sheet 2). Freshwater and coastal wetlands exist along the northern property boundary (Sheet 3). Coastal wetlands are vegetated by Spartina alterniflora, S. patens, and Juncus romerianus and freshwater wetlands contain Chantaecyparis thyoides and Myrica cerifera. Uplands have been mostly cleared of vegetation and contain a variety of graminoids. Soils consist of Bohicket silty loam in the coastal wetlands, Corolla fine sand in the freshwater wetlands, and Newhan fine sand in the uplands (Sheet 4). The CAMA Land Use Plans for Ocean Isle Beach classify this area as conservation and urban transition and it is zoned residential by the Town of Ocean Isle Beach. 1 BEN 8 - 2006 Morehead City pCM III. PROJECT DESIGN AND OBJECTIVES The applicant proposes to construct a residential subdivision with 194 single-family lots and associated roads within the tract (Sheets 5 - 10). These lots will range between 0.11 acre and 0.77 acre in size. Nine of the lots are comprised of uplands islands (Lots 52, 60, 61, 64, 65, 68, 69, 73, and 74). The applicant proposes to provide access to these isolated uplands by constructing piling- supported wooden bridges. The bridges will be 13'-6" wide. Utilities to these lots will be provided by directionally drilling under wetlands. Furthermore, the applicant plans to create a trail with elevated wooden bridges that will connect several upland islands that are located in common areas. Twenty-eight pedestrian bridges will be constructed with a total length of approximately 1600 feet. Each bridge will be five feet wide and will be at least three feet above the wetland substrate (Sheet 11). IV. POTENTIAL ENVIRONMENTAL IMPACTS The proposed project will have minimal environmental impact. No wetland impacts are proposed. Utilities to lots located within the uplands islands will be directionally drilled under wetlands to avoid impacts. Access to isolated upland islands located within the tract will be provided by elevated piling-supported bridges. Silt fences will be used around the construction area to reduce the potential of secondary impacts to wetlands from erosion during construction. In addition, logging mats will be used when construction equipment crosses freshwater wetlands. The extension was first permitted several years ago (1986) and continuously kept in permit #208-86. Bald Head Island Limited has an active Corps of Engineers Letter allowing this jetty extension, dated January 28, 2004 and expiring on December 31,2008, based on the 10th renewal to the CAMA Permit. Per conversations, you wanted updated information on the Cape Fear River Shipping Channel . This submittal is a replacement for my March 16, 2006 minor mod submittal(s) that included channel deepening and marina deepening to -12 MLW as well as providing details for extending the jetty and including a 6' "jetty walk" with a fishing deck at the end. After discussing your comments about dredging the channel to the spoil island (required from station 8 eastward into the marina) with Mr. Mitchell, it seemed too for in advance of the next scheduled marina basin dredging project. Of course, one hurricane can change the timing sequence of any purported schedule. The barge and ferries need to use the marina, and the slip owners sure like to use their boats. The jetty extension will provide for wave and current relief for vessels entering the harbor. The newer ferry boats are 82' long catamarans, and the 100' extension will provide an extra boat length of shelter on a flood tide or from southwesterly waves. have looked at three sources for the information in regards to the shipping channel location. GPS latitude/longitude information from one of the ferries, converted to state plane coordinates: from chart data on the channel width and buoy locations; and from 2005 McKim and Creed survey data. Green Buoy #13A appears to be at least 2100 It from the existing end of the Bald Head Island Marina jetties. From Chart Data, the shipping channel is 230 yards wide = 690'. That would put the eastern edge of the channel at 1400' from the existing channel end, or 1300' from the jetty extension end. From underwater survey data along South Beach that was gathered for the Village in 2005, it looks like the channel is closer to 1000 wide. That would put the east edge 1100 It off of the existing jetty. Presumably, the Corps of Engineers has a bit more accurate channel location. From our island map, which is based on NAD 27, 1 get the centerline of the jetty mouth as E2302933.4, N47917.8. Latitude/Longitude of N33deg52'39.5", W78deg00'06.6' is a rounded approximation. The applicant states that with the acquisition of two larger (82') catamaran ferries, the jetty extension is now warranted to provide additional wave and current protection for the ferries. Given the amount of time since the issuance of the original permit, as well as, changes in the location of the adjacent federally maintained Cape Fear River channel, staff asked the applicant to provide updated project drawings for review by applicable agencies prior to re-authorizing construction of the proposed jetty extension. The applicants propose a jetty extension of 100 feet, at .a 10-degree angle from the end of the existing south jetty. The jetty wall would be constructed of reinforced concrete sheet piles, supported by batter piles, 10 feet on center. The majority of the batter piles would be located on the north side (channel side) of the jetty, except that the last 20 feet of the jetty would be supported by batter piles on both sides of the wall. The base of the jetty extension would be further stabilized by the placement of large rock/rip rap on both sides the jetty wall. The applicant also proposes to install a new navigational light and dolphin cluster, approximately 20 feet waterward of the end of the new jetty extension. The applicant states that by their calculation, the edge of the federal channel is approximately 1100 feet from the existing jetties. This calculation is based on navigational chart data and GPS measurements taken from one of the ferries, rather than from channel survey information. PROJECT DESCRIPTION The project site is located at the east end of Ocean Isle Beach, adjacent to Second Street, between Lee Street and Shallotte Boulevard, in Brunswick County. To get to the site from Wilmington take US Hwy 17 South approximately 28 miles to Ocean Isle Beach Road SW. Turn left onto Ocean Isle Beach Road and travel approximately 4 miles to Ocean Isle Beach. Turn left onto East 2nd Street and travel approximately 4.5 miles to the intersection of Lee Street and East 2"d Street. The project site is located on the left (north) side of East 2nd Street and extends eastward to Shallotte Boulevard, and the project borders the Atlantic Intracoastal Waterway on the north side. The property consists of approximately 125.7 acres above MHW, including approximately 65.33 acres of §404 and coastal wetlands. The highground portion of the site is vegetated with various grass species including: Salt Meadow Grass (Spartina patens), Sea Oats (Uniola paniczdata), Cacti, Southern Wax- myrtle (11yrica cerifera), and sparsely wooded with Loblolly Pine (Pines taeda), Live Oak (Quercus virginiana), Yaupon Holly (Ilex vomitoria), and Eastern Redcedar (Juniperus virginiana). The highground portion of the property has an elevation of approximately 6.5 feet above mean sea level. There is an existing large dune located at the western end of the project, which has an approximate elevation of 29 feet above mean sea level but is not located within the Ocean Hazard AEC. Almost the entire length of the northern property boundary consists of jurisdictional §404 Wetlands fringed by coastal wetlands. Wetland vegetation consists primarily of Wax Myrtle (11yrica cerifera), Black Needle Rush (Juncus roemarianus), Sea Lavender (Limonium spp.), Spike Grass (Distichlis spicata), Glasswort (Salicornia sl-)p.) and Smooth Cordgrass (Spartina alternijlora). The coastal wetland areas consist of mixed high and low marsh areas of varying size and composition. The long-term average annual erosion rate for the area from Lee Street to approximately 300 feet east of Charlotte Street is 2 feet per year. The 100-year storm recession line for this area is 300 feet, creating a total Ocean Erodible AEC of 420 feet. The remaining eastern portion of the Island has an erosion rate of 4.5 feet per year. The 100-year storm recession line for this area is 300 feet, creating a total Ocean Erodible AEC of 570 feet. A portion of the project is also located within the High Hazard Flood AEC as indicated by zones V1-30 on the Flood Insurance Rate Maps of the Federal Insurance Administration. Setbacks in this portion of Ocean Isle Beach are measured from a static or fixed vegetation line. This vegetation line represents the first line of stable natural vegetation that existed prior the large-scale spoil deposition project. The vegetation line was surveyed by the North Carolina Geodetic Survey Unit on February 7, 2001. With a 2 feet per year erosion rate, small structures must be set back a distance of 60 feet landward from the surveyed first line of stable natural vegetation. Large structures must be set back 180 feet from this line. The areas which have a 4.5 feet per year erosion rate, small structures must be setback a distance of 135 feet landward from the surveyed first line of stable natural vegetation and large structures must be setback 240 from this line. The proposed development at the closest point will be approximately 210 feet from the surveyed static vegetation line. The Ocean Isle Beach Land Use Plan classifies the uplands of the project site as Conservation and Urban Transitional. The waters of Shallotte Sound adjacent to the project area are classified "SA-TI W" by the North Carolina Division of Water Quality. The area is designated as a Prima?-y Nursery Area by the North Carolina Division of Marine Fisheries, and is open to the harvesting of shellfish. Ocean Isle Development Subdivision August 14, 2006 Page 3 PROPOSED PROJECT The applicant is proposing to create a 194-lot subdivision, elevated boardwalks and associated utilities. There would be approximately 5,529 linear feet of streets (see sheet C15 for typical cross section) and approximately 21,779 sq. ft. of sidewalks. The individual lots will range in size from approximately 0.11 acre to 0.77 acre with a proposed density of 0.26 units per acre. No individual dwelling units are proposed as part of the application package. As such, each individual property owner proposing to develop within any AEC would be required to obtain his/her own individual CAMA permit. There is no proposed development within the 75' Estuarine Shoreline AEC or the 30' Coastal Shoreline Buffer. Development on nine of the lots (Lots 52, 60, 61, 64, 65, 68, 69, 73, and 74) would be located on upland islands encompassed by §404 Wetlands. The applicant states that it will be the responsibility of these individual lot owners to obtain the proper permits to gain access to these islands. The applicant is proposing to provide the utilities to these lots by directionally drilling under the §404 Wetlands. The applicant is also proposing a walking trail comprised of twenty-eight (28) elevated pedestrian bridges with a total length of approximately 1600 feet that will connect numerous upland islands located in the common area along the northeastern boundary of the project. Each bridge will span §404 Wetlands and will be five feet in width and at least three feet above the wetland substrate. 10. ANTICIPATED IMPACTS The proposed subdivision, installation of the roads, utilities and stormwater measure would disturb approximately 44 acres of highground. The proposed elevated walkways would result in the shading of approximately 8,000 sq. ft. of §404 Wetlands. INTRODUCTION The applicant, OIB East Developing Company, proposes to construct a residential subdivision with 194 single-family lots and associated roads within the ninety-one acre project area, located at the east end of Ocean Isle Beach, NC. In addition, the applicant plans to create a walking trail with elevated pedestrian bridges that will connect several upland islands located in, common areas. H. EXISTING CONDITIONS The 91-acre project area is located at the east end of Ocean Isle Beach in Brunswick County, North Carolina. It is bound by Second Street to the south, Lee Street to the west, Shallotte Boulevard to the east, and Shallotte Sound to the north (Sheet 1). The tract is located within an Ocean Hazard Area of Environmental Concern (as is the entire island of OIB). Existing high ground elevations are 2' to 7' above MLW (Sheet 2). Freshwater and coastal wetlands exist along the northern property boundary (Sheet 3). Coastal wetlands are vegetated by Spartina alterniflora, S. patens, and Juncus romerianus and freshwater wetlands contain Chamaecyparis thyoides and Myrica cerifera. Uplands have been mostly cleared of vegetation and contain a variety of graminoids. Soils consist of Bohicket silty loam in the coastal wetlands, Corolla fine sand in the freshwater wetlands, and Newhan fine sand in the uplands (Sheet 4). The CAMA Land Use Plans for Ocean Isle Beach classify this area as conservation and urban transition and it is zoned residential by the Town of Ocean Isle Beach. PROJECT DESIGN AND OBJECTIVES The applicant proposes to construct a residential subdivision with 194 single-family lots and associated roads within the tract (Sheets 5 -10). These lots will range between 0.11 acre and 0.77 acre in size. Nine of the lots are comprised of uplands islands (Lots 52, 60, 61, 64, 65, 68, 69, 73, and 74). It should be noted that it will be the responsibility of these individual lot owners to obtain the proper permits to gain access to these islands. However, the applicant will be responsible for providing utilities to these lots by directionally drilling under wetlands. Furthermore, the applicant plans to create a trail with elevated wooden bridges that will connect several upland islands that are located in common areas. Twenty-eight pedestrian bridges will be constructed with a total length of approximately 1600 feet. Each bridge will be five feet wide and will be at least three feet above the wetland substrate (Sheet 11). IV. POTENTIAL ENVIRONMENTAL IMPACTS The proposed project will have minimal environmental impact. No wetland impacts are proposed. Utilities to lots located within the uplands islands will be directionally drilled under wetlands to avoid impacts. Access to isolated upland islands located in common areas will be provided by elevated piling-supported bridges. Silt fences will be used around the construction area to reduce the potential of secondary impacts to wetlands from erosion during construction. In addition, logging mats will be used when construction equipment crosses freshwater wetlands. Therefore, based on proposed construction measures, the direct and cumulative impacts from the proposed project are considered insignificant.
