Dear Mr. Elmore:
The Wilmington Regional Office received your application, for a CAMA Major Permit from the Division of
Coastal Management on August 23, 2006, to construct a new bulkhead, finger piers, floating docks, boat lifts, and
to perform maintenance dredging. Construction of the new bulkhead will result in the filling of 45 square feet of
Open Water, and the maintenance dredging will result in the excavation of 18,800 square feet of Open Water.
You are authorized to proceed with your project as proposed under General Water Quality Certification (WQC) #
3490 (enclosed). This Certification allows you to use the CA11A Major Permit when the Division of Coastal
Management issues it. Written concurrence from the Division of Water Quality (DWQ) is not required provided
that you can meet all of the conditions of the General Water Quality Certification.
If at anytime during construction of your project you determine that you cannot meet these conditions or if there
are any additional impacts to wetlands or water quality not described in your application, you must contact
this office immediately.
If the US Army Corps of Engineers determines that an Individual Permit is required for the proposed activities, an
Individual Water Quality Certification will also be required and the attaclied Certification is no longer valid.

This permit, issued on December 22, 2006 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Marina Reconfiguration
1) The permittee shall provide two copies of an as-built survey of the completed project, including pre-
existing and new dock structures and post-project hydrographic survey, within 30 days of project
completion to the Wilmington Regulatory Field Office. A copy of this survey shall also be provided to
the Division of Coastal Management.
2) Prior to the occupancy of any new slips authorized under this permit, a marine pumpout sewage disposal
facility shall be installed and operable, and maintained for the life of the marina.
3) Prior to the occupancy of any slips authorized by this permit, the permittee shall meet on-site with a
representative of the Division to ensure that the required pumpout facility is in place and operable.
(See attached sheets for Additional Conditions)
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2009

ADDITIONAL CONDITIONS
4) The marina shall display a sign showing the location of the onsite pumpout facility, including other
appropriate waste disposal information, at the entrance and exit from the main pier(s).
5) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
marina. Any sewage discharge at the marina shall be considered a violation of this permit for which the
permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence
of the permitted structure.
6) This permit authorizes only the docks; piers, and other structures and uses located in or over the water
that are expressly and specifically set forth in the permit application. No other structure, whether
floating or stationary, shall become a permanent part of this marina without permit modification. No
non-water dependent uses of structures shall be conducted on, in or over public trust waters without
permit modification.
7) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
8) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
9) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
10) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors should be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
11) This permit authorizes a maximum of twenty-one boat slips.
12) Should either adjacent property be sold prior to the initiation of construction, the permittee shall be
required to obtain a signed riparian corridor waiver from the new property owner prior to the placement
of any structures within the 15-foot riparian corridor.
NOTE: Due to the proximity of the AIWW, boats utilizing the docking facility will be subject to
frequent wavewash from passing vessels. The issuance of this permit does not relieve the
permittee from taking all proper steps to ensure the integrity of the structure and the safety of
moored boats. The permittee shall not hold the State of North Carolina or the United States
liable for any damage to the structure or moored boats.

13) The authorized alignment of the bulkhead shall be staked by the permittee and approved on-site by a
representative of the Division of Coastal Management within a maximum of 30 days prior to the start of
any construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse
weather conditions, shall require the alignment to be restaked by DCM within a maximum of 30 days
prior to the new expected start of construction.
14) The bulkhead shall be constructed prior to any backfilling activities.
15) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the
structure.
16) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other
suitable materials approved by department personnel. No excavation is permitted except for that which
may be required for the construction of the bulkhead wall, riprap, deadmen cables, etc.
17) The fill material shall be clean and free of any pollutants except in trace quantities.
18) All fill material shall be obtained from a high ground source and confined behind the permitted
bulkhead.
19) No backfill material shall be placed within 30 feet of the normal high water line, except that which will
be used to backfill the area behind the permitted bulkhead.
Excavation
20) In order to protect juvenile finfish resources, no excavation or filling activities will be permitted between
the dates of April 1 and September 30 of any year without the prior approval of the North Carolina
Division of Coastal Management and the U.S. Army Corps of Engineers.
21) Excavation shall not exceed -8 feet below the normal low water level. In no case shall the depth of
excavation exceed the depth of connecting waters.
22) No vegetated wetlands shall be excavated or filled, even temporarily, without permit modification.
23) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not
authorized.
24) No excavation shall take place outside of the area indicated on the attached workplan drawings.

25) All excavated materials shall be confined above normal high water and landward of regularly or
irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of
solids into any marsh or surrounding waters.
26) No spoil material shall be placed within 30 feet of the normal high water line, except that which will be
used to backfill the area behind the bulkhead.
27) Any change in the location of the spoil disposal area shall be approved bya representative of the
Division of Coastal Management prior to the initiation of any excavation activities.
Sedimentation and Erosion Control
28) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, etc.). At a minimum, a silt fence shall be properly installed immediately
landward of the bulkhead cap immediately following completion of backfilling activities, and shall
remain until the disturbed areas are properly vegetated.
29) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion
within thirty days of project completion.
General
30) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the, permittee shall be required,
upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or
obstructions caused thereby, without expense to the United States or the state of North Carolina. No
claim shall be made against the United States or the state of North Carolina on account of any such
removal or alteration.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non-water
dependent activities are not authorized within 30 feet of the normal high water level.

Dear Mr. Huggett:
Reference the application of Mr. John Elmore of Airlie Marina, LLC dated August 8, 2006
and received by this office on August 22, 2006, for Department of the Army (DA) authorization
to reconfigure the existing 22 slip marina with new floating docks, finger piers, boatlifts,
maintenance dredging of 4,700 cy, and replacement of 118 ft of bulkhead at Airlie Marina
located at 1402 Airlie Road adjacent to the AIWW, Wrightsville Beach, New Hanover County,
NC. All excavated material will be dewatered on barge and inside a dike disposal area within the
existing gravel parking area on the Airlie Marina, LLC property. The excavated material will
then be transported to a 25 acre upland disposal area.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with the
attached plans, which are a part of this permit. Any modification to these plans must be approved
by the US Army Corps of Engineers (USACE) prior to implementation.
2. The permittee will provide two copies of the as-built surveys of the completed
project, including pre-existing and new dock structures and pre-project and post-project
hydrographic surveys, within 30 days of project completion to the Wilmington Regulatory Field
office, attn: Mr. Dave Timpy.
3. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove,
relocate, or alter the structural work or obstructions caused thereby, without expense to the
United States. No claim shall be made against the United States on account of any such removal,
relocation, or alteration. The permittee shall notify NOAA/NATIONAL OCEAN SERVICE
Chief Source Data Unit N CS261, 1315 E West HWY- RM 7316, Silver Spring, MD 20910-
3282 at least two weeks prior to beginning work and upon completion of work.
4. Except as specified in the plans attached to this permit, no excavation, fill or
mechanized land-clearing activities shall take place at any time in the construction or
maintenance of this project, in such a manner as to impair normal flows and circulation patterns
within waters or wetlands or to reduce the reach of waters or wetlands.
5. The bulkhead will not be positioned farther waterward than 3 feet from the normal
water level elevation contour at any point along its alignment.
6. Except as authorized by this permit or any USACE approved modification to this
permit, no excavation, fill or mechanized land-clearing activities shall take place at any time in
the construction or maintenance of this project, within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
7. All mechanized equipment will be regularly inspected and maintained to prevent
contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic
materials. In the event of a spill of petroleum products or any other hazardous waste, the
permittee shall immediately report it to the N.C. Division of Water Quality at (919) 733-5083,
Ext. 526 or (800) 662-7956 and provisions of the North Carolina Oil Pollution and Hazardous
Substances Control Act will be followed.
8. The authorized structure and associated activity must not interfere with the public's
right to free navigation on all navigable waters of the United States. No attempt will be made by
the permittee to prevent the full and free use by the public of all navigable waters at or adjacent
to the authorized work for reason other than safety.
9. In order to protect juvenile finfish resources, no excavation or filling activities will
be permitted between the dates of April 1 and September 30 of any year without the prior
approval of the North Carolina Division of Coastal Management and the U.S. Army Corps of
Engineers.
10. The West Indian manatee (Trichechus manatus), which is listed as a federally
endangered species, has been reported in the waters in New Hanover County. In order to protect
the West Indian manatee all work should be done during the period from November 1 to May 31.
If work must be done during the period from June through October the enclosed guidelines,
entitled "Precautions for General Construction in Areas Which May Be Used by the West Indian
Manatee in North Carolina" must be followed. These guidelines are available at:

11. All excavated materials will be confined landward of the mean high water level
elevation contour within adequate dikes or other retaining structures to prevent spillover of
dredged materials into any vegetated wetlands or surrounding waters.
12. A water control structure will be installed at the intake end of the effluent pipe
leading from the retention area in order to ensure maximum settlement of suspended solids.
13. Flow from the diked retention area will be confined by pipe, trough, or similar device
to a point at or below the mean low water level elevation contour to prevent gully erosion and
siltation.
14. Excavation will not exceed -8.0 feet below the elevation of mean low water (MLW).
15. If the permittee discovers any previously unknown historic or archeological remains
while accomplishing the authorized work, he will immediately notify the Wilmington District
Engineer who will initiate the required coordination procedures.
16. Approval of the structure was based on determinations that there would be no
obstruction to navigation. Under conditions existing in the Atlantic Intracoastal Waterway
(AIWW), a possibility exists that the structure may be damaged by wave wash from passing
vessels. Unreasonable slowing down of vessel traffic cannot be required because it would tend to
nullify the navigational benefits on which the AIWW was justified. Issuance of this permit
should not be construed, as relieving the permittee of taking proper steps to insure the structure
and moored boats will not be damaged by wave wash normally to be expected in the AIWW.
17. The permittee shall advise the Corps in writing at least two weeks prior to beginning
the work authorized by this permit and again upon completion of the work authorized by this
permit.
18. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.
19. The permittee shall employ all sedimentation and erosion control measures necessary
to prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit
area. This shall include, but is not limited to, the immediate installation of silt fencing or similar
appropriate devices around all areas subject to soil disturbance or the movement of earthen fill,
and the immediate stabilization of all disturbed areas. Additionally, the project must remain in

full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North
Carolina General Statutes Chapter 113A Article 4).
20. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction-related discharge. Increases such that
the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not
considered significant.
21. The permittee, upon receipt of a notice of revocation of this permit or upon its
expiration before completion of the work will, without expense to the United States and in such
time and manner as the Secretary of the Army or his authorized representative may direct, restore
the water or wetland to its pre-project condition.
22. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.

9. PROJECT DESCRIPTION:
The project site is located adjacent to Atlantic Intracoastal Waterway (AIWW)/Greenville Sound, at 1402
Airlie Rd., south of the Wrightsville Beach drawbridge, in the City of Wilmington, New Hanover County.
The property is currently operating as a commercial marina with 22-slips. Existing structures on the property
include: a dockmaster building with restrooms, an elevated roof covered deck over open water, just
waterward of an existing wooden bulkhead (approximately 118 linear feet in length). Waterward of the
existing dockmaster building is an access ramp that leads to an approximately 100' in length by 6' in width
main floating dock. The floating dock terminates in an approximately 35' in length by 6' in width "L-head"
floating dock, which is oriented towards the north. There is also an existing "L-head" floating dock located
on the southern side of the main floating dock, adjacent to the access ramp (Sheet 6 of 10).. Waterward of
the existing bulkhead on the northern end and on the southern end of the property are shared floating docks
and finger piers between adjacent property owners, which are Crocker's Landing Assoc., Inc. to the south,
and Gulf Stream Marina, Inc. to the north (Sheet 6 of 10). As a result, the current configuration does not
conform to the 15' riparian corridor setback requirement at these locations. The application states that a 1977
Army Corps of Engineer permit authorized construction of this docking facility as well as the two docks
directly to the north. The application also states that all three docks were part of a single marina at one point
in time and has since been separated. There are currently other commercial marinas adjacent to this facility
and across the waterway from the project site. The 0.2 acres of the upland portion of the property is an
existing gravel parking lot. Upland vegetation consists primarily of maintained lawn grass and ornamental
landscaping. There are currently no coastal wetlands at this location.
The waters of the AIWW/Greenville Sound are not designated by the NC Division of Marine Fisheries as
Primary Nursery in this location. The waters are classified 5139 by the NC Division of Water Quality and are
not open to shellfishing. New Hanover County classifies the area as Conservation in their Land Use Plan.
PROPOSED PROJECT:
The applicant proposes to re-configure an existing 22- slip commercial marina with new floating docks, finger
piers, boatlifts, maintenance dredging and installation of a new bulkhead. A new bulkhead would replace the
existing 118' linear feet wooden bulkhead. Approximately 15 linear feet of this new bulkhead would average
.'waterward of the existing bulkhead at the northern end of the property. The remaining 103 linear feet new
bulkhead would be located approximately 5' landward of the existing bulkhead. The agent states that this new
bulkhead alignment would allow the applicant to maximize the re-configuration of the proposed structures
(Sheet 9 of 10).
Maintenance dredging is also proposed within the existing marina footprint, as well as some minor upland
excavation where the new bulkhead would be installed, landward of the existing wooden bulkhead. Maintenance
excavation would be accomplished by a land based and barge based excavator. Dimensions of the proposed
maintenance dredging limits would be 160' in length by 117' in width to a project depth of-6' to - 8' @ Mean
Low Water (MLW). Approximately 4,700 cubic yards of material would be removed. The application states
that the excavated material would be de-watered on barge and inside a dike disposal area within the existing
gravel parking area on the property (Sheet 6 of 10). The material would then be relocated to a designated 25acre
upland site at the Tanbridge Park Subdivision, Tanbridge and Windemere Roads, in Wilmington. The
application states that silt fencing and vegetation would be used to stabilize the offsite disposal area (Sheet 1 of
1). The application does not indicate that a Sedimentation Erosion Control Plan Permit or Mining Permit has
submitted or obtained for this location.

The applicant proposes an access ramp waterward of the new bulkhead, which would lead to a landing platform 6' in
length by 6' in width. The landing would then terminate in a main floating dock 133'6" in length by 8' width, which
would run perpendicular to the shoreline. The main floating dock would then terminate in a "T-head" floating dock,
80'6" in length wide by 6', which would run parallel to the shoreline. The main floating dock would have six floating
finger piers, each 35' in length by 3'6" in width. There would be three finger piers on each side of the main floating
dock 45' apart, which would run parallel to the shoreline. Six additional mooring pilings, three on each side of the
main floating dock, would be installed between each floating finger pier designate the proposed twelve (12)-36' wet
slips (Sheet 8 of 10).
The applicant proposes to install four fixed finger piers 21'5" in length by 2'6" in width extending from the new
bulkhead towards the AIWW, two of which would be located on the each side of the access ramp. These finger piers
would accommodate eight 12' in length by 12'4" in width boatlifts.
10. ANTICIPATED I1\IPACTS
The proposed structures would incorporate approximately 3,743 sq. ft. of Estuarine Waters and Public Trust Area.
however much of this area is currently usurped by the existing marina facility. The application states that the proposed
structures would provide 21 slips. Approximately 525 sq. ft. of highground area would be removed for the installation of
the new bulkhead alignment. The maintenance excavation bf the marina basin would result in the removal of
approximately 18,720 sq. feet of shallow bottom within the Estuarine Waters and Public Trust Areas. Approximately
16,000 sq. ft. of hiahground area would be disturbed for the spoil site area preparation, which would contain
approximately 1,700 cubic yards of material excavated for the maintenance of the basin. The structure Nvould extend
160' into a waterbody measuring approximately 500' across, which would not extend beyond the established pier length.
The structure would extend approximately 30' waterward of the AIWW 80' setback (Sheet 5 of 10). The proposed
structures would encroach into the 15' riparian corridor setback requirement, however the application includes waivers
from both the adjacent riparian property owners. The application states that a 30' wide easement has been recorded
between the applicant and the adjacent riparian property owner to the north (Exhibit B). Minor increases in turbidity
should be expected, but if construction is timed to avoid periods of peak biological activity impacts should be minimal.

This application requests to re-configure the existing marina located at 1402 Airlie Road
in Wilmington, NC. The marina currently contains 22 slips, as designated on the
enclosed figures. A dockmaster building with restrooms and adjacent roofed deck is
currently elevated over the water, just waterward of the existing bulkhead. The roughly
0.2-acre upland portion of the property is existing gravel parking. A 1977 ACOE permit
authorized construction of this dock and the two docks directly to the north. Apparently
all three docks were part of a single marina and have since been separated. As a result,
the current dock system does not conform to the 15' riparian corridor setback at the north.
The original permit application showed 40'slips on the north side of the floating dock and
20' slips on the south side of the floating dock. The need for a CAMA Major permit to
reconfigure the dock system was triggered by the request for 36' slips on the south side
instead of 20' slips.
Re-confi-uration of the dock would provide a total of 21 slips, twelve of which would be
36'-long wet slips and eight of which would be lifts. The new dock system would abut
the established pierhead line, as defined by the Wilmington ACOE office. Enclosed is a
map provided by the Wilmington ACOE navigation office which shows a recognized
pierhead line for this section of the AIWW. A waiver from the adjacent landowner to
the south was obtained during an earlier notification and is enclosed.
New bulkhead is proposed along the property's 118 lft of shoreline.. This bulkhead
would replace existing bulkhead. New bulkheading would be located no more than 3'
waterward of the existing bulkhead at the northern property corner. The majority of new
bulkheading would be located roughly 5' landward of the existing bulkhead.
Maintenance dredging within the marina footprint is proposed as well as some minor
upland excavation where bulkhead will be installed landward of the existing bulkhead.
Maintenance dredging and excavation will result in approximately 4,700 cy of sandy
material. Material will be excavated with either a barge mounted excavator or from a
land based excavator. Spoil material will be placed within upland areas of the planned
Tanbridge subdivision in Wilmington, off nearby Eastwood and Military Cutoff Roads.
A vicinity map, survey, and ACOE approved survey for the proposed off-site disposal
area is enclosed. The applicant (John Elmore) owns the Tanbridge subdivision property.
A state stormwater management plan has been approved for the existing upland parking
area. Although no upland development is proposed, this stormwater management plan
brings the existing impervious cover into compliance to the greatest extent practicable.
