Any violation of these terms nlay be subject to fines, inlprisoil nlsnt or civil action; or may cause the permit to be null and void. Dockinf_, Facility 1) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (Sec attached sheets for Additional Conditions) This permit action may be appealed by the pcnnittec or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This pernlit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. The permittee is not relieved of this requirement if lie abandons the permitted activity without having it transferred to a third party. 5) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 6) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 7) Should either adjacent property be sold prior to the initiation of construction, the permittee shall be required to obtain a signed riparian corridor waiver from the new property owner(s) prior to the placement of any structures within the 15-foot riparian corridor. 8) This permit authorizes a maximum of ten boat slips. In order to ensure compliance with this condition, the proposed handrails oil the access pier shall be constructed in accordance with the attached workplan drawings. Furthermore, no cleats, tic piles or other formal mooring structures shall be constructed on any portion of the docking facility outside of the area(s) indicated on the attached workplan drawings. NOTE: Any proposal to add one or more additional boat slips to the authorized 10-slip facility will require that the docking facility be classified as a marina, and will therefore require a review under the N.C. Environmental Policy Act (NCEPA). General 9) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 10) No vegetated wetlands or open water areas shall be excavated or filled, even temporarily, without permit modification. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local pennits, approvals or authorizations that may be required. Director Division of Water Quality DWQ Project # 06-1351 Washington County Approval of 401 Water Quality Certification (GC3400) with Additional Conditions Dear Mr. Peangmeth: You have our approval, in accordance with the attached conditions, fill or otherwise impact 0.0334 acres of non-vegetated wetland (river bottom) to construct a pier, platform, finger piers, and mooring piles as described in your application dated May 29, 2006, and received by the Division of Water Quality (DWQ) 401 Oversight/Express Review Permitting Unit on August 21, 2006. After reviewing your application, we have determined that the Division of Water Quality (DWQ) General Water Quality Certification Number 3400 covers these water impacts. This Certification allows you to General Permit No. 198000291 when issued by the US Army Corps of Engineers (USACE). In addition, you should get or otherwise comply with any other federal, state and local requirements before you go ahead with your project including (but not limited to) erosion and sediment control regulations and CAMA. Also, this approval to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon expiration of the 404 or CAMA Permit. This approval is for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. PROJECT SUMMARY: The applicant proposes to constrict a pier, platform, finger piers and mooring piles. Blue Sun Development Group, LLC, Mr. Jeremy Peangmeth Cedar Shores Washington County Project settinV The project site is located off US SR 1315 (Breezy Banks Road) on the reserved common lot at Cedar Shores Subdivision on the Albemarle Sound near Roper in Washington County, North Carolina. The lot is approximately 0.41 acres in size. Blue Sun Development Group, III currently owns the lot. This lot is to be used as a common lot for residents of the Cedar Shores Subdivision. The Cedar Shores Subdivision has been platted but currently there are no residential structures in the development. Man-made features within the development include an asphalt road (Cedar Shores Dr.) and a metal barn. The entire 1023 linear feet of shoreline has been previously stabilized with a wooden bulkhead. The reserved common lot has ±70' of shoreline and is located between lot no. 4 and lot no. 5 near the center of the subdivision. Landward of the bulkhead the elevation gradually slopes upward to an approximate elevation of ± 15' above the normal water level. Lawn grass is the predominant vegetation to the top of the slope, which is approximately 60' landward of the bulkhead. The remainder of the lot is vegetated with cedars, pines, scattered hardwoods and other herbaceous growth. The undeveloped lots on either side of the conunon lot are of similar vegetation and elevation. The adjacent property on the downstream (east) side of the development is an established single-family residence. A bulkhead and ±50' pier with platform and boathouse exist on this lot. The lot on the upstream (west) side of the development is also developed as single-family residence which is bulkheaded and has a ±115' pier with a boatlift. The Albemarle Sound is classified as SB by the Environmental Management Commission at the project site. The Albemarle Sound is Coastal waters and is not open to shell fishing. Project description The applicant proposes to construct a±6' by ±200' pier with a±6' by ±26' T-Head platform on the terminal end. Four ±2.5' by ±10' finger piers will be located near the T-head platform to create ten fixed boat slips. Twelve mooring pilings will be installed in association with the boat slips. Anticipated impacts The project will result in localized turbidity as a result of the installation of the pier and platform pilings. Additionally, the pier, finger piers and platform will shade approximately 1,456 ft' of Sound bottom. The site covers 12.46 acres and is located off NCSR 1302, Pea Ridge Rd. The Applicant holds title to the existing subdivision. Site is subdivided into 18 building lots, improved with an asphalt road in the center of the property and has an existing bulkhead along the 1023.64 LF of shoreline. Existing structures include the bulkhead, asphalt road, a barn to be razed, and a park bench. All upland areas have been stabilized and revegetated. No land disturbance will occur in upland areas, or in the AEC to complete this activity. In order to: • promote and provide community recreational opportunities. • provide small boat access to adjacent waters the applicant proposes the following within the AEC: • construct a 200 ft.
