Division of Water Quality 401 Oversight and Express Permits Unit Attn: Cyndi Karoly 2321 Crabtree Boulevard,, Suite 250 Raleigh, NC 27604-2260 Re: Letter of Refinement for Heritage North, Phase 11 Sewer, Wake Forest, NC On September 22, 2006, Heritage Wake Forest, Inc. was authorized to proceed with 22 linear feet of temporary stream impact and 0.004 acres of temporary wetland impact for the purpose of installing a sanitary sewer line for the Heritage North Phase lI Development (USACE Action ID 200640560-292). Additionally, on August 28, 2006, NC Division of Water Quality (DWQ) approved Heritage Wake Forest, Inc. to proceed with 3,106 square feet (1,874 square feet in Zone 1 and 1,232 square feet in Zone 2) of protected Neuse Riparian Buffer Impacts for the purpose of installing the sanitary sewer line (DWQ No. 06-1339). The existing sewer line that the developer was proposing to connect to is actually Vitrified Clay Pipe (VCP) rather than Ductile Iron Pipe (DIP), a discovery made when the existing sewer line (approximately 20 years old) was uncovered. The City of Raleigh will not allow this connection to be made unless the entire length of VCP is replaced. The replacement of approximately 400 linear feet of VCP line would not only be costly, but would also incur greater environmental impact as the line is located entirely within the 100 year floodplain. The attached plans outline a different alternative that would allow for the sanitary, sewer line to connect directly into an existing manhole, an activity which would be allowed by the City of Raleigh. The following changes are proposed (please see attached revised overall site plan and impact maps): a) Impact WS 1- 0.004 acres of temporary wetland impact; 1,054 square feet of Neuse Buffer (632 SF Zone 1 and 422 SF Zone 2) "exempt" impacts. (no change from original application submittal) b) Impact WS 2 - 231inear feet of temporary impacts to a UT to Smith Creek (perennial); 1,849 square feet of Neuse Buffer (1,313 SF in Zone 1 and 536 SF in Zone 2) "exempt" impacts. (please note the angle of the proposed sewer crossing is 103.5 degrees) The new impact totals are 0.004 acres of temporary wetland impact (no change from original submittal), 23 linear feet of temporary stream impacts (an increase of 1 LF of temporary channel impact) and 2,903 square feet of Neuse Buffer (1,945 square feet in Zone I and 958 square feet in Zone 2) "exempt" impacts (a reduction of 203 square feet of Neuse Buffer "exempt" impact) associated with the sewer crossings. We are requesting a revised 404 Approval that reflect these changes of impact totals. Because the impacts to the Neuse River Buffer are "exempt", no written authorization is required from the DWQ for these impacts or for the use of General Water Quality Certification No. 3374. Diffuse Flow An additional condition is that all stormwater shall be directed as diffuse flow at non-erosive velocities through the protected stream buffers and will not re-concentrate before discharging into the stream as identified within 15A NCAC 2B.0233(5). 3. The text of the sample deed notification may be modified as appropriate to suit to this project. Any disputes over determinations regarding this Authorization Certificate (associated with the approved buffer impacts) shall be referred in writing to the Director for a decision. The Director's decision is subject to review as provided in Articles 3 and 4 of G.S. 150B. This Authorization Certificate shall expire five (5) years from the date of this letter. Describe the existing conditions on the site and general land use in the vicinity of the project at the time of this application: Heritage Phase II Sewer(NWP 12) - The sewer along Smith Creek and Austin Creek currently exists The applicant proposes to tie the Heritage North Page 2 of 9 Phase II Subdivision sanitary sewer into the existing City of Raleigh (Town of Wake Forest) sewer line. The proposed impacts have not yet occurred. The undisturbed areas within the alignment of the proposed sewer easement are currently wooded. 10. Describe the overall project in detail, including the type of equipment to be used: Sewer Crossing (NWP 12): The project includes the installation of a sanitary sewer line. The proposed sewer line will cross a small wetland finger and impact the eastern stream side buffer of a UT to Smith Creek in the first location and will cross a UT to Smith Creek in the second location. The project will use equipment typically used in the construction of sewer systems. The proposed impacts are temporary and will comply with all of the conditions of NWP12 and GC3374. 11. Explain the purpose of the proposed work: Sewer Crossing (NWP 12): The purpose of the proposed work is to provide sewer service to this portion of the Heritage North Phase II subdivision. IV. Prior Project History If jurisdictional determinations and/or permits have been requested and/or obtained for this project (including all prior phases of the same subdivision) in the past, please explain. Include the USACE Action ID Number, DWQ Project Number, application date, and date permits and certifications were issued or withdrawn. Provide photocopies of previously issued permits, certifications or other useful information. Describe previously approved wetland, stream and buffer impacts, along with associated mitigation (where applicable). If this is a NCDOT project, list and describe permits issued for prior segments of the same T.I.P. project, along with construction schedules. A site visit was conducted with Ms. Jennifer Burdette of the Raleigh Regulatory Field Office of the USACE on June 22. 2004 (AID No. 200421082). To our knowledge, no permits have been requested or obtained for the Heritage North Subdivision in the past. On-site determinations with the NC DWQ were not requested in that the applicant does not dispute the applicability of the Neuse River Buffer Rules as they pertain to the surface waters within the proposed impact locations. V. Future Project Plans Are any future permit requests anticipated for this project? If so, describe the anticipated work, and provide justification for the exclusion of this work from the current application. No future permits are expected to be required. VI. Proposed Impacts to Waters of the United States/Waters of the State It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to wetlands, open water, and stream channels associated with the project. Page 5 of 9 Sewer Crossing (NWP 12)• The impacts to the wetlands and streams have been minimized to one stream crossing (22 feet) and one wetland crossing (0.004 acres). All impacts to these waters will be temporary and will comply with all of the conditions of NWP12 and GC3374. The sewer line has been located outside of the buffer and as far from the stream as possible, except for the necessary crossing VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on January 15, 2002, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal.
