Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility 1) Unless specifically altered herein, this permit authorizes only the addition of the single pile boatlift, the 4' X 20' floating dock, and 6' X 9' jet dock to the existing docking facility, including any uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this modified docking facility without permit modification. No non-water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. 2) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 3) This permit authorizes a maximum of two (2) new boat slips, for a total of three (3) boat slips. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. x 5) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 6) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the } docking facility. -Any _sewage._dischmge-at-the-dockin-facility -shall be-considered a violatim of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 7) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor. This corridor is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. General 8) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. Jim Crumpton Page 2 9. PROJECT DESCRIPTION: The project site is located at 21 Sandy Point Road on Figure Eight Island, adjacent to Banks Channel and Middle Sound, in New Hanover County. The island is accessed from the mainland at the end of Edgewater Club Road (SR 1402), by private bridge over the Atlantic Intracoastal Waterway (AIWW) and an earthen causeway, which traverses Middle Sound. Heading east on the causeway turn right on Beach Road South and travel south. Turn right onto Sandy Point Road and continue until you reach the property of interest, which would be located on the left. The applicant maintains a two story single-family residence, which border Banks Channel. Upland vegetation consists of ornamental landscaping, pines, and lawn grass. The lot is approximately 1/3 acre in size and averages 6 feet above mean sea level. The 121 feet of shoreline frontage is stabilized by an existing wooden bulkhead. Waterward of the bulkhead is an area approximately 40' in width of coastal wetlands consisting primarily of Smooth Cordgrass (Spartina alterniiora), along with Glasswort (Salicornia sp.), Sea Lavender (Limonium sp.), and Salt Meadow Hay (Spartina patens). Waterward of the bulkhead is a private pier structure extending in Banks Channel measuring 104' in length by 5' in width, which terminates to a "L-head" platform 16' in length by 12' in width. An access ramp leads from the "L-head" platform into a floating dock 16' in length by 8'in width, which extends in an easterly direction of the "L-head" platform parallel to the shoreline. There is also an existing boatlift 12' in length by 14' in width located on the landward side of the floating dock. The application states that the water depth in the area of the existing structures is approximately -6 feet @mean low water (MLW). The New Hanover County Land Use Plan classifies adjacent waters and high ground portion at the property as Conservation. The waters of Banks Channel and Middle Sound are classified SA-ORW by the Division of Water Quality. They are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are OPEN to the harvest of shellfish. PROPOSED PROJECT: The applicant proposes to construct a single pole boatlift, a new floating dock and jet dock at an existing pier system in Banks Channel. The new 9' in length by 6' in width boatlift would be placed on the northern side of the fixed pier, just landward of the "L-head" platform dock. A floating dock 20' in length by 4' in width would be placed on the eastern side of the pier, which would run in the same alignment as pier. A Jet dock 9' in length by 6' in width would be located adjacent to the proposed floating dock. The proposed structures would provide docking space for two additional vessels at the existing facility. 10. ANTICIPATED EIAPACTS: The proposed boatlift, floating dock, and jet dock construction would incorporate 188 sq. ft. of Estuarine Waters and Pubic Trust Area. The proposed boatlift would not encroach into the adjacent 15' Riparian Corridor Setback Area. The existing docking facility extends approximately 100' into a waterbody, which measures approximately 600 feet across. This existing distance conforms with the 1/4 width rule and the established pier lengths. Minor increases in turbidity should be expected during construction.
