This permit, issued on December 11, 2006 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subiect to fines, imprisonment or civil action; or may cause the permit to be null and void. 1) Unless specifically altered herein, all development shall be carried out in compliance with the attached list-of workplan drawings: sheets 5 through 7 of 9 dated 4/10/06, sheets 8 and 8a of 9 dated 4/20/06, sheet 9 of 9 dated 4/26/06, drawing no. H05-5082 dated 11/15/05, sheets Append 1 and Append 3 dated 7/14/06, sheet Append 2 dated 6/29/06, and the project narrative dated "received Wilmington 7/31/06". 2) In accordance with commitments made by the permittee in the project narrative dated "received Wilmington" 7/31/06, and in order to comply with 15 NCAC 07H.0209(10) which states that no `.`non- water dependent" development shall take place within 30 feet of the normal high water level, the "Tot Lot", which includes any fence or mulch material used in the creation of the "Tot Lot", shall be located entirely landward of the 30-foot setback. Any reference to the "Tot Lot" in the attached workplan drawings delineating the "Tot Lot" waterward of the 30-foot set back is hereby null and void. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit shall be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Tidewater Landing, LLC, c/o Nat Smith Permit It 203-06 Page 2 of 4 ADDITIONAL CONDITIONS Upland Development 3) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the development of the property located adjacent to Virginia Creek, off of Watts Landing in Surf City, including the paving of the existing dirt roads and the installation of utilities within the subdivision, the 55 ft. x 25 ft. "Tot Lot", the 20 ft. x 20 ft., gazebo located a minimum of 30 feet from the normal high water level, the 6 ft. x 70 ft. wooden walkway which includes the bridge elevated 'a minimum of 3 feet above the coastal wetland substrate, and the. 10 ft. wide walking path, all as expressly and specifically set.forth in the attached permit application forms and drawings. Any additional land disturbing activities and/or construction may require a modification of -this permit. Contact a Division of.Coastal Management representative at (910) 796-72.15 for this determination. Docking Facility 4) Unless specifically altered herein, this permit authorizes the 6 ft. x 40 ft. access walkway extending from the authorized gazebo, the 6 ft. x 125 ft. fixed pier, the 6 ft. x 157 ft. floating dock, the four 4.25 ft. x 20 ft. finger piers, and the 8 boat lifts and associated mooring pilings, all expressly and specifically set forth in the permit application and attached workplan drawings. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non- water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. 5) hi order to prevent any unauthorized docking, a handrail shall be constructed on the east end of the floating pier and on the east side of slip # 8. 6) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 7) All portions of the pier located over coastal wetlands shall not exceed a width of 6 feet and shall be elevated a minimum of 3 feet above the marsh substrate as measured from the bottom of the decking. 8) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 9) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. At'a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 12) - This permit authorizes a maximum of eight boat slips. Sedimentation and Erosion Control 13) The N.C. Division of land Quality approved this project under Permit No. Pende--2006--402 on 5/9/06. Any violation of the permit approved by the DL,Q shall be considered a violation of this CAMA permit. 14) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 15) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.). Stormwater Management 16) The N.C. Division of Water Quality approved this project under stormwater management rules of the Environmental Management Commission under Stormwater Permit No. SW8060428 on 8/18/06. Any violation of the permit approved by the DWQ shall be considered a violation of this CAMA permit. Deed Restrictions 17) In accordance with commitments made by the permittee, a deed restriction shall be placed on lot 3 dedicating the entire shoreline of this lot to the proposed community access facility. The deed restriction shall further state that no piers or docking facilities shall be constructed off of Lot 3 in the future, for as long as the permitted access facility is in place. This deed restriction shall be recorded with the Pender County Register of Deeds, and copies of the recorded deeds provided to the Division of Coastal Management, prior to the initiation of construction of the docking facility facility. Shellfishiniz Closure 18) The waters adjacent to the permitted project are classified as "Conditionally Approved-Closed." The construction and/or operation of the authorized facilities shall not directly result in a permanent closure of these conditionally approved waters. Any such permanent closure directly attributable to the authorized facility shall require that the permittee undertake remedial actions to remedy the situation. Such actions may include, but are not limited to, a removal of any unauthorized slips or mitigative measures to reduce or eliminate the cause(s) of the closure. Permit # 203-06 Page 4 oi' 4 ADDITIONAL CONDITIONS General 19) The permittee understands and agrees that., if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized. by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the. state of North Carolina. No claim shall be made against the. United States or the state of North Carolina on account of any such removal or alteration. 20) No vegetated wetlands or open water areas shall be excavated or filled, even temporarily. 21) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with. T15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers is not authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required, including but not limited to any access permits required by the NC Department of Transportation. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: The N.C. Oho - 1 3c)S 01--f F Reference the application of Mr. Nat Smith of Tidewater Landing, LLC dated Juy26, 2006 and received by this office on August 11, 2006, for Department of the Army (DA) authorization to construct an 8-slip docking facility with boatlifts, four finger piers, an access pier, gazebo, and fenced play area for the Tidewater Landing development located off Watts Landing Road, adjacent to Virginia Creek, in Surf City, Pender County, NC. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: 1. All work authorized by this permit must be performed in strict compliance with the attached plans, which are a part of this permit. Any modification to these plans must be approved by the US Army Corps of Engineers (USACE) prior to implementation. 2. Except as specified in the plans attached to this permit, no excavation, fill or mechanized land-clearing activities shall take place at any time in the construction or maintenance of this project, in such a manner as to impair normal flows and circulation patterns within waters or wetlands or to reduce the reach of waters or wetlands. 3. Except as authorized by this permit or any USACE approved modification to this permit, no excavation, fill or mechanized land-clearing activities shall take place at any time in the construction or maintenance of this project, within waters or wetlands. This permit does not authorize temporary placement or double handling of excavated or fill material within waters or wetlands outside the permitted area. This prohibition applies to all borrow and fill activities connected with this project. 4. The authorized structure and associated activity must not interfere with the public's right to free navigation on all navigable waters of the United States. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work for reason other than safety. 5. If the permittee discovers any previously unknown historic or archeological remains while accomplishing the authorized work, he will immediately notify the Wilmington District Engineer who will initiate the required coordination procedures. 6. The permittee shall require its contractors and/or agents to comply with the terms and conditions of this permit in the construction and maintenance of this project, and shall provide each of its contractors and/or agents associated with the construction or maintenance of this project with a copy of this permit. A copy of this permit, including all conditions, shall be available at the project site during construction and maintenance of this project. 7. The permittee shall employ all sedimentation and erosion control measures necessary to prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit area. This shall include, but is not limited to, the immediate installation of silt fencing or similar appropriate devices around all areas subject to soil disturbance or the movement of earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project must remain in full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statutes Chapter 113A Article 4). 8. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not considered significant. 9. The permittee, upon receipt of a notice of revocation of this permit or upon its expiration before completion of the work will, without expense to the United States and in such time and manner as the Secretary of the Army or his authorized representative may direct, restore the water or wetland to its pre-project condition. 10. PROJECT SUMMARY: The applicant is proposing to construct an 8-slip docking facility with boatlifts, 4 Finger piers, access pier, a gazebo and fenced play area for the Tidewater Landing development. I. Tidewater Landing Page Three ANTICIPATED IMPACTS: The project would disturb approximately 3007 square feet of high ground area for the "Tot Lot" and the walking path. The areas proposed to be paved for subdivision roads would be in areas of existing dirt roads. The proposed dock and pier would incorporate approximately 2682 sq ft. of Estuarine Waters and Public Trust Area and would result in the shading of approximately 90 sq. ft. of Coastal Wetlands. The projecl is likely to increase turbidity levels during construction, but no long-term adverse impacts are anticipated. Due to shallow water depths, some bottom disturbance, or "kicking", may result at low tide from prop-wash. The proposed docking facility would extend approximately 250 feet into the waterbody, which measures approximately 2000 feet across. This distance conforms to the '/4 width rule. As proposed, the facility would not encroach into the channel of Virginia Creek. Tidewater Landing Page Two 9. PROJECT DESCRIPTION: The project site is located adjacent to Virginia Creek, at the end of Timber Creek Lane, in Pender County. To get to the site from Wilmington take US Highway 17 N to NC Highway 210 East. Travel about 1 mile to Watts Landing Rd. Drive about 1 mile down Watts Landing Rd. until you reach Howe Hill Rd. on the right. Travel approximately 2 miles down Howe Hill Rd. to Kingfisher Lane on the right. You will find the property of interest at the end of Kingfisher Lane on the right. The planned Tidewater Landing development would cover approximately 16 acres, consisting of 23 single- family lots. The applicant states the shoreline of Lot 3, extending 10' landward of Normal High Water, would be deeded to the common area, and therefore would not have riparian rights (see Narrative and Note 1 on Sheet 5a of 9). The total shoreline frontage of the common area is about 463' and averages approximately 10-25' above mean sea level. A gazebo is presently the only structure on site, and the site has been cleared to prepare for development. Highground vegetation on this tract consists of grasses and shrubbery, including Giant Cane (Arundinaria gigantea) and Southern Wax-Myrtle (Myrica cerifera). Other upland vegetation includes hardwood species: Shagbark Hickory (Carya ovata), Live Oak (Quercus virginiana), Yaupon (Ilex vomitoria), Water Oak (Quercus nigra.) and Sweet Gum (Liquidambar styraciflua). There are also Loblolly Pines (Pines taeda) and Cypress (Taxodium sp) on the property. There are coastal wetlands present on the site. There is a fringe approximately 10-15' wide consisting of Salt Meadow Grass (Spartina patens), Spike Grass (Distichlis spicata), Saw Grass (Cladium jamaicense) and Bulrush (Scirpus sp.) following the erosion escarpment, which transitions waterward to Salt Marsh Cordgrass (Spartina alterniflora) and Black Needlerush (Juncus roemarianusl. A §404 Wetlands delineation has been completed and was approved on March 3, 2006 by the U.S. Army Corps of Engineers (USACOE). Waterward of the low marsh are two marsh islands vegetated with S. alterniflora. The first is located west of the southern shore and the second is located along the western riparian corridor. The Town of Surf City Land Use Plan classifies the upland areas of this project as Conservation. The waters of Virginia Creek are classified as SA by the NC Division of Water Quality. The NC Division of Marine Fisheries has designated Virginia Creek as a Primary Nursery Area, and the adjoining waters are closed to the harvesting of shellfish. PROPOSED PROJECT: The proposed dock consists of a fixed pier 125' in length and 6' in width, extending out into Virginia Creek in a westerly direction. A floating dock, 157' in length and 6' in width, would be placed perpendicularly to the pier as an L-head, extending southerly into Virginia Creek. The water depth at the floating dock would be approximately -2.0' to -2.7' @ Normal Low Water (NLW). Four (4) finger piers, measuring 20' in length by 4.25' in width, are proposed to extend westerly, perpendicular to the floating dock. This is intended to create 8 boatslips on the west side of the pier, each with a boatlift measuring 14'in length by 12.5' in width. The finger piers would each be spaced 32' apart. The applicant proposes a handrail on the remainder of the floating dock to prevent unauthorized dockage. The water depth at the finger piers would be approximately -2.6' @ NLW. The proposed upland development consists of constructing a 20' by 20' gazebo, which would be located on the edge of the Estuarine Shoreline 30' buffer. A fenced children's play area ("Tot Lot"), measuring approximately 55' in width and 25' in length, and which would be located partially inside the 30' buffer, would only contain a chipped bark ground cover, and no impervious cover. Additionally, a wooden walkway, approximately 240' in length by 6' in width, is proposed to provide access to the gazebo and dock. A 10' wide walking path would join the wooden walkway approximately 30' upland of the gazebo, outside of the 30' buffer, and would run parallel with the shoreline. F Tidewater Landing Page Three ANTICIPATED IMPACTS: The proposed dock and pier would incorporate approximately 2682 sq ft. of Estuarine Waters and Public Trust Area and would result in the shading of approximately 90 sq. ft. of Coastal Wetlands. The project is likely to increase turbidity levels during construction, but no long-term adverse impacts are anticipated. Due to shallow water depths, some bottom disturbance, or "kicking", may result at low tide from prop-wash. The proposed docking facility would extend approximately 250 feet into the waterbody, which measures approximately 2000 feet across. This distance conforms to the '/4 width rule. As proposed, the facility would not encroach into the channel of Virginia Creek. The planned Tidewater Landing subdivision is located off Watts Landing Road in Pender County, abuts Virginia Creek, and totals 15-acres in size. The property is located within the planning jurisdiction of the Town of Surf City. The subdivision will contain 23 single-family lots and a common area. Lots 1-3 and the common area are situated on Virginia Creek. All subdivision roads and grading will be located outside the 75' Coastal Shoreline AEC. Proposed work within CAMA AECs is limited to amenities within the common area. Waters of Virginia Creek at this location have been classified SA by the NC Environmental Management Commission, PNA by the NC Marine Fisheries Commission, and are presently closed to shellfishing. The community dock would be located within the riparian corridor of the common area. It is noted that lot 3 will not have riparian rights, and the shoreline along lot 3 will be deeded to the common area. A total of eight slips with lifts are proposed. All slips would serve future residents of the subdivision. Water depths within the proposed slips average -2.5' at normal low water and no dredging is proposed. Proposed upland development on the common area consists of a wooden boardwalk, gazebo, children's play area, and walking path.. A 20' x 20' gazebo will be located outside of the 30' Coastal Shoreline buffer, and a 6' wide boardwalk will provide access to the gazebo and dock. The boardwalk will be elevated over an approximately 20' wide area of coastal and "404" wetlands, so that lots to the east of the common area can access the dock. Wetland fill will not be required for either structure. A 10' wide walking path will be provided, extending approximately 236' from the road to the elevated boardwalk. The path will be left at existing grade and covered with mulch. An area for younger children to play, the tot lot, would be located outside the 30' CAMA buffer area.
