I have also reviewed the revised As -Built Report received on October 2. There are inconsistencies with the credit assets provided in the report. Therefore, I have attached additional, more detailed comments along with my notes on each figure/survey (DWR notes -Benton). Prior to a credit release, DWR needs RS to provide a response to these additional comments. There may be other inconsistencies that I did not catch, so please make sure all of the figures, tables & survey match prior to submitting a final response. Another copy of the full As -Built report is not being requested at this time. Please let me know if you have any questions. As a result of my review, I found that the report lacked in a few details as well as clarity of work actually done on the site. This information will be necessary for DWR to approve the report. Comments regarding the report are provided below: 1. Section 2.0 a. doesn't provide any status of where the project stands with regards to the USACE. Was it constructed the way it was approved to be constructed? Any As -built report submitted or approved? Etc. This information is important to us, because we cannot approve this report without knowing whether the stream & wetland mitigation was completed and approved by the USACE. b. Details regarding stream restoration efforts are not provided. Please indicate if all of the stream restoration or enhancement work (see Figure 6 of BPDP) was done in compliance with permits and corresponding mitigation plan. If any changes occurred from what was proposed in the BPDP, please acknowledge those. c. On the Summary page RS acknowledges that the E&SC plan from Land Quality was approved. However, no plan is provided in the report and RS doesn't provide information on how they implemented the approved plan. This is important to us, considering a large portion of this site was created during construction and earth movement could lead to substantial sediment loss into streams. 2. Section 3.0 Mitigation amounts changed slightly (see Table 1) from what was provided in the BPDP. Please explain why the mitigation amounts changed. If this change was a result of streams or wetlands not being constructed as proposed, please provide a figure showing a comparison between the As -Built Figure 5 and the BPDP Figure 6. b. Please note: the Enhancement and Preservation credits need to be on the same credit ledger (see page 4 bottom of page) 3. Section 4 a. This section states that 20 plots were installed. However, only 11 plots were noted in the BPDP as proposed to be installed. Please explain the need for more plots and provide a Figure showing which of the 20 plots are intended to be used for monitoring of buffer & nutrient offset credit areas. b. 4.4—This paragraph describes what RS intends to do to mark the boundaries. Section 2.0 doesn't provide any status of where the project stands with regards to the USACE. Was it constructed the way it was approved to be constructed? Any As -built report submitted or approved? Etc. This information is important to us, because we cannot approve this report without knowing whether the stream & wetland mitigation was completed and approved by the USACE. Section 2 was updated and includes the following text, "Project construction and planting was completed between February 14 and March 14, 2018. The project was constructed in accordance with mitigation plan for the Benton Branch Stream and Wetland Mitigation Bank and the Stream and Wetland Umbrella Mitigation Banking Instrument, both approved by the Interagency Review Team on July, 6th 2017. In addition, the project was constructed in accordance with the issued Section 404 permit, the Section 401 Water Quality Certification, and the approved Sediment & Erosion Control Plan (Appendix H). A Baseline Document and As -Built Report, prepared for the Benton Branch Stream and Wetland Mitigation Bank, was submitted to the USACE on April 2018 and was approved by the USACE on May 2, 2018 (Appendix I - Credit Release Letter)." Riparian buffer and nutrient offset credit amounts changed slightly due to a shift in the easement and the addition of wetland mitigation within the old pond beds. The easement shift was a result of the final, post construction surveyed easement and did not result in any changes to the stream and wetland credits as proposed in the mitigation plan and constructed. Additionally, there was an oversight in the BPDP where all riparian buffer restoration and enhancement was given full credit (rather than 50%) for buffer areas 101- 200 ft. During as -built, it was decided to pursue nutrient offset credit in the areas 101-200 ft. where buffer vegetation was restored. b. Please note: the Enhancement and Preservation credits need to be on the same credit ledger (see page 4 bottom of page) "and preservation" was added to the text about credit ledgers below Table 1. 3. Twenty-five vegetation plots were installed at the project for the Stream & Wetland Mitigation Bank. Of the plots installed, 20 of the 25 plots are located within planted buffer and nutrient offset credit areas (providing —2.0% coverage of planted and nutrient offset credit areas). The number of vegetation plots estimated in the BPDP document was only based on the area of buffer restoration and didn't include the total planted acreage for buffer and nutrient offset. 4.4 — This paragraph describes what RS intends to do to mark the boundaries. However, since this is an As -Built, please indicate what RS actually did to mark the boundaries. Section 4.4 was changed as follows "Easement boundaries were identified in the field to ensure clear distinction between the Parcel and adjacent properties. Boundaries were identified with fencing and NCWHF signage. Boundary markers disturbed, damaged, or destroyed will be repaired and/or replaced on an as needed basis." Section 3.0, Table 1, Survey, Figures 8A & 8B a. Table 1, the Survey, and Figures 8A & 8B do not correspond. b. Nutrient Offsets- 0 ffsets— ■ When looking at the survey, which is not consistent with Figures 8A & 8B, some areas proposed as nutrient offset credit (dark blue) exceed 200' from TOB. These areas are not viable to generate nutrient offsets (or buffer) and need to be removed from the credit totals. ■ Figure 8A shows UT2 and where credits from TOB — 200' are being utilized. Figure 8A shows an area 101-200' proposed as "Enhancement via cattle exclusion" (orange), which is in-line with the BPDP proposal. However, the survey shows this area being utilized for generating Nutrient Offset (dark blue) and not buffer enhancement credit. Nutrient Offset is not viable in cattle exclusion areas. Please explain. ■ Figure 8B shows UT1 and where credits from TOB -200' are being utilized. Figure 8B shows an area 101-200' proposed as "Nutrient Offset credit" (purple). However, the survey shows this area being utilized for generating Buffer Restoration (green) and not nutrient offset credit. Neither the "Construction Legend" on the survey nor Table 1 in the report provides a measurement for Buffer Restoration credits generated in widths 101-200'. Please explain. c. Buffer Credits — ■ When looking at the survey, the "Construction Legend" says the red represents Enhancement (via cattle exclusion) within widths of 101-200'. This does not seem to be the case near UT -2B where areas are within TOB - 100. The Legend does not provide TOB -100' as a measurement for this. Please explain. ■ Restoration credits between TOB -100' are represented as "Green" on the survey. However, there are some areas in "Green" that are >100' from TOB and should not be included in the ft2 for buffer restoration credits measured from TOB -100'. Page 1 of 2 ■ Some restoration credits on the survey are shown where widths are >100' from TOB. But neither Table 1 in Section 3.0 nor the Construction Legend on the survey show where this width is accounted for w/ 33% full credit. Please explain. ■ Some restoration credits (green) are shown on the survey where widths are >200' from TOB. These areas are not viable to generate buffer or nutrient offset credits and should be removed from the credit totals. Figure 8A & 8B do not show credits being generated in these areas. Comment# 4 provided by RS in response to DWR comment on the placement of 20 vs 25 plots DWR response to RS Comment #4 and the corresponding Revised As -Built Report dated October 2018 is as follows: 2. DWR is supportive of installing additional plots than may be necessary to account for the riparian buffer & nutrient offset credit areas. However, based on the AsBuilt Walkthru w/ Worth Creech, DWR only assessed the condition of 11 plots. DWR was under the assumption that the other plots were installed for purposes of meeting separate performance standards for the stream mitigation component. No further comment from RS is required for this item. Restoration Systems needs to provide a response to each item above and provide DWR with supporting figures, along with a signed survey, that all support the credit assets being proposed.
