Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Excavation 1) No excavation shall take place outside of the crosshatched areas indicated on the attached workplan drawings. 2) Excavation will not exceed -2 feet below the normal low water level. In no case shall the depth of excavation exceed the depth of connecting waters. 3) No marsh grass shall be excavated or filled, even temporarily, without permit modification. 4) The temporary placement or double handling of excavated materials within open waters or vegetated wetlands is not authorized. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2009 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Bayshore Marina & Racquet Club ADDITIONAL CONDITIONS u Spoil Disposal Permit #180-06 Page 2 of 2 5) The spoil disposal area shall be inspected and approved by a representative of the Division of Coastal Management prior to the commencement of any dredging activities. 6) All excavated materials shall be confined above normal high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any coastal wetlands or surrounding waters. 7) No spoil material shall be placed within 30 feet of the normal high water line. 8) -T-he -disposal- area-shall be properly-graded and provided,a ground cover_sufficient-to -restrain erosion - within 30 working days of project completion. 9) Appropriate sedimentation and erosion control devices, measures or structures must be implemented to ensure that leaking or eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.). Director Division of Water Quality DWQ Project # 061257 Onslow County You have our approval, in accordance with the attached conditions and those listed below, to dredge a 40' X 50'access channel to a depth of -2' NLW, a 40' X 100' boat basin to a depth of -2 NLW and 332' X 20' area located within the existing boatslips to a depth of -2 NLW at the subject property, as described within your application dated August 2, 2006 and received by the N.C. Division of Water Quality (DWQ) on August 3, 2006. After reviewing your application, we have decided that the impacts are covered by General Water Quality Certification Number 3489 (WQC 3489). The Certification allows you to use the CAMA Major Permit when issued by the Division of Coastal Management. In addition, you should obtain or otherwise comply with any other required federal, state or local permits before you go ahead with your project including (but not limited to) Erosion and Sediment Control, Non-discharge, and stormwater regulations. Also, this approval to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon expiration of the 404 or CAMA Permit. This approval is for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. Erosion & Sediment Control Practices Erosion and sediment control practices must be in full compliance with all specifications governing the proper design, installation and operation and maintenance of such Best Management Practices in order to protect surface waters standards: a. The erosion and sediment control measures for the project must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control Planning and Design Manual. b. The design, installation, operation, and maintenance of the sediment and erosion control measures must be such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the project. c. For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Surface Mining Manual. d. The reclamation measures and implementation must comply with the reclamation in accordance with the requirements of the Sedimentation Pollution Control Act. 3. No Waste, Spoil, Solids, or Fill of Any Kind No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of the impacts depicted in the Pre-Construction Notification. All construction activities, including the design, installation, operation, and maintenance of sediment and erosion control Best Management Practices, shall be performed so that no violations of state water quality standards, statutes, or rules occur. Installation of a sediment curtain around the dredge area is recommended. 4. No Sediment & Erosion Control Measures w/n Wetlands or Waters Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade restored within six months of the date that the Division of Land Resources has released the project. 7. Certificate of Completion Upon completion of all work approved within the 401 Water Quality Certification or applicable Buffer Rules, and any subsequent modifications, the applicant is required to return the attached certificate of completion to the 401/Wetlands Unit, North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650. PROJECT DESCRIPTION: The project site is located at the Bayshore Marina & Racquet Club Boat Basin off of West Bay Dr., adjacent Chadwick Bay, in Sneads Ferry, Onslow County. To get to the site from Wilmington take US HWY 17 N to NC Hwy 172, which is located approximately 4 miles north of Holly Ridge. Turn right onto NC Hwy 172 and travel approximately 6 miles to Sneads Ferry Rd., there is an Exxon Station at the intersection. Take a right and travel approximately 2 miles to Bumps Creek Rd. Take a right and travel approximately 0.3 miles to Bay Dr., this is the entrance to Bayshore Marina and Racquet Club. Take a left onto Bay Dr. and at the end of Bay Dr. take a right and the entrance for the marina is on the left. The property is adjacent to Chadwick Bay on the south side and residential property on the north, east and west sides. On November 30, 1982 CAMA Major Permit 151-82 was issued authorizing the maintenance excavation of the existing basin and access channel, bulkheading, piers, boat ramp and nitrification fields. The property is an existing subdivision with a 60-slip marina. The highground portion of the property is vegetated primarily with lawn grasses and shrubs. The marina is split into two sections, an upland boat basin and an open water marina. There is an entrance to the upland basin from Chadwick Bay that measures approximately 60' in width and 20' in length. The boat basin is approximately 133' in width and approximately 280' in length at this location and ranges in depth from -0.5' @ normal low water (NLW) to -2' @ MLW. There are no coastal wetlands located on the site. There is evidence of submerged aquatic vegetation in the basin area and the open water portion of the marina. The Onslow County Land Use Plan classifies the upland areas of this project as Rural. The waters of the project site are classified as SA by the NC Division of Water Quality. The NC Division of Marine Fisheries has designated this area of Chadwick Bay as a Primary Nursery Area and the upland boat basin IS NOT designated as a Primary Nursery Area, and the waters adjacent to the proposed project are open to the harvesting of shellfish, however the basin area and the open water marina area are closed. PROPOSED PROJECT: The applicant is proposing to perform maintenance excavation of a portion of an existing upland boat basin and the access channel to boat basin. The portion of the access channel to be dredged is approximately 40' in width and 50' in length and ranges in depth from approximately -1' @ NLW to -2' @ NLW. The applicant is proposing to excavate to a final depth of -2' @ NLW. The basin portion of the project is approximately 40' in width and 100' in length and ranges in depth from -0.5' @ NLW to -1.25' @ NLW. The applicant is proposing the final depth to be -2' @ NLW. The applicant is also proposing to perform maintenance excavation of the 21 boat slips located in the upland basin from -1' @ NLW to -2' @ NLW. The spoil material is to be place in the pond located north of lots 1-6 East Bay Drive. The pond is approximately 40' in diameter and averages approximately 3' in depth. The pond is located outside of the Estuarine Shoreline Area of Enviromnental Concern (AEC).
