Director Division of Water Quality DWQ Project # 06-1233 Hyde County Approval of 401 Water Quality Certification and Authorization Certificate per the Tar-Pamlico River Buffer Protection Rules (15A NCAC 2B .0259) with Additional Conditions Dear Mr. Howell: You have our approval, in accordance with the attached conditions and those listed below, to place fill within or otherwise impact 0.04 acres of wetland and 0.00 square feet of Zone 1 Tar-Pamlico River basin protected riparian buffers and 0.00 square feet of Zone 2 Tar-Pamlico River basin protected riparian buffers to construct the proposed residence at the subject property, as described within your application dated July 25, 2006, and received by the N.C. Division of Water Quality (DWQ) on August 3, 2006. After reviewing your application, we have decided that the impacts are covered by General Water Quality Certification Number(s) 3402 (GC3402). The Certification(s) allows you to use Nationwide Permit(s) NW 18 when issued by the US Army Corps of Engineers (USACE). In addition, you should obtain or otherwise comply with any other required federal, state or local permits before you go ahead with your project including (but not limited to) Erosion and Sediment Control, Non-discharge, and other regulations. Also, this approval to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon expiration of the 404 or CAMA Permit. This approval is for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h). This approval requires you to follow the conditions listed in the attached certification and any additional conditions listed below. The Additional Conditions of the Certification are: 1. Impacts Approved The following impacts are hereby approved as long as all of the other specific and general conditions of this Certification (or Isolated Wetland Permit) are met. No Waste, Spoil, Solids, or Fill of Any Kind No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of the impacts depicted in the Pre-Construction Notification. All construction activities, including the design, installation, operation, and maintenance of sediment and erosion control Best Management Practices, shall be performed so that no violations of state water quality standards, statutes, or rules occur. 3. Erosion and sediment control practices must be in full compliance with all specifications governing the proper design, installation and operation and maintenance of such Best Management Practices in order to protect surface waters standards: a. The erosion and sediment control measures for the project must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control Planning and Design Manual. b. The design, installation, operation, and maintenance of the sediment and erosion control measures must be such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the project. c. Sufficient materials required for stabilization and/or repair of erosion control measures and stormwater routing and treatment shall be on site at all times. 4. Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade restored within six months of the date that the Division of Land Resources has released the project; 5. Protective Fencing - The outside buffer, wetland or water boundary and along the construction corridor within these boundaries approved under this authorization shall be clearly marked with orange warning fencing (or similar high visibility material) for the areas that have been approved to infringe within the buffer, wetland or water prior to any land disturbing activities to ensure compliance with 15A NCAC 213 .0259 and GC 3402; 6. Diffuse Flow (No Review) All constructed stormwater conveyance outlets shall be directed and maintained as diffuse flow at non-erosive velocities through the protected stream buffers such that it will not re-concentrate before discharging into a stream as identified within 15A NCAC 2B .0259 (5). If this is not possible, it may be necessary to provide stormwater facilities that are considered to remove nitrogen. This may require additional approval from this Office. 7. Written Stormwater Management Plan (No Further Approval Needed) The final, written stormwater management plans (including a signed and notarized Operation and Maintenance Agreement), must be implemented and the stormwater management facilities shall be constructed and operational before any permanent building is occupied at the subject site. No changes to the structural stormwater practices shall be made without written authorization from the Division of Water Quality. 8. Certificate of Completion Upon completion of all work approved within the 401 Water Quality Certification or applicable Buffer Rules, and any subsequent modifications, the applicant is required to return the attached certificate of completion to the 401 Oversight/Express Review Permitting Unit, North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1.650. Violations of any condition herein set forth may result in revocation of this Certification and may result in criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application and as authorized by this Certification shall expire upon expiration of the 404 or CAMA Permit. If you do not accept any of the conditions of this Certification (associated with the approved wetland or stream impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. Our telephone conversation on August 29`" was effective in clarifying the requirements for a stormwater management plan for the proposed project. After our discussion and subsequent discussions of the proposed project with civil engineering staff here at Quible, we were able to designate an area for a stormwater management infiltration basin. The location of the basin and a cross-section of the stormwater control measure is depicted on the revised site plan enclosed, dated September 8, 2006. The proposed housing unit footprint has decreased since the original submission for 401 Water Quality Certification, allowing a significant area on the east side of the property to be available. It is anticipated that the site plan will continue to evolve as the design goes through permitting stages (state and local), however, the footprint is not expected to increase. Prior to applying for building permits and an authorization to construct from the local municipality, other permits, such as the 401 Water Quality Certification and Nationwide 18 are required. This project proposes impacts for up to 0.04 acres (1,858 square feet) of Section 404 wetlands. Stormwater will be directed into a dry infiltration area that is to be excavated and vegetated in the location shown on the site plan. The side slopes of the basin will be established at a 3:1 slope and the depth of the basin will be 2.5 feet from the existing surface elevation. The existing season high water table is estimated at 2.5 feet below existing grade, therefore, this will be a dry infiltration system aside from times of heavy rain events. The adjacent wetlands are not subject to tidal influence as determined by NC Division of Coastal Management. Stormwater runoff collected by this basin will undergo debris and pollutant filtration by the vegetative side slopes. The vegetative slopes will consist of grasses, which will be seeded immediately after excavation of the basin. The grasses serve as a physical, biological and chemical strainer and will participate in the removal of pollutants that may be introduced into the system by the impervious surfaces proposed. A basin of this size should provide adequate temporary storage of stormwater runoff prior to infiltration. The stormwater will be disposed of in the subsurface. Due to the composition of the soils being primarily sand-dominated, the infiltration rates should remain relatively high, promoting short drawdown periods. If the scope of the proposed work (i.e. building or parking area configuration) changes, modified stormwater treatment measures will be adopted. Any modified stormwater design will be equal to or greater the treatment levels currently proposed and will adhere to BMP's established in the current NCDENR, DWQ Stormwater BMP Manual. The enclosed information addresses your department's request for additional information as described in the August 25, 2006 letter. Our telephone conversation on August 29`'' was effective in clarifying the requirements for a stormwater management plan for the proposed project. After our discussion and subsequent discussions of the proposed project with civil engineering staff here at Quible, we were able to designate an area for a stormwater management infiltration basin. The location of the basin and a cross-section of the stormwater control measure is depicted on the revised site plan enclosed, dated September 8, 2006. The proposed housing unit footprint has decreased since the original submission for 401 Water Quality Certification, allowing a significant area on the east side of the property to be available. It is anticipated that the site plan will continue to evolve as the design goes through permitting stages (state and local), however, the footprint is not expected to increase. Prior to applying for building permits and an authorization to construct from the local municipality, other permits, such as the 401 Water Quality Certification and Nationwide 18 are required. This project proposes impacts for up to 0.04 acres (1,858 square feet) of Section 404 wetlands. Stormwater will be directed into a dry infiltration area that is to be excavated and vegetated in the location shown on the site plan. The side slopes of the basin will be established at a 3:1 slope and the depth of the basin will be 2.5 feet from the existing surface elevation. The existing season high water table is estimated at 2.5 feet below existing grade, therefore, this will be a dry infiltration system aside from times of heavy rain events. The adjacent wetlands are not subject to tidal influence as determined by NC Division of Coastal Management. Stormwater runoff collected by this basin will undergo debris and pollutant filtration by the vegetative side slopes. The vegetative slopes will consist of grasses, which will be seeded immediately after excavation of the basin. The grasses serve as a physical, biological and chemical strainer and will participate in the removal of pollutants that may be introduced into the system by the impervious surfaces proposed. A basin of this size should provide adequate temporary storage of stormwater runoff prior to infiltration. The stormwater will be disposed of in the subsurface. Due to the composition of the soils being primarily sand-dominated, the infiltration rates should remain relatively high, promoting short drawdown periods. If the scope of the proposed work (i.e. building or parking area configuration) changes, modified stormwater treatment measures will be adopted. Any modified stormwater design will be equal to or greater the treatment levels currently proposed and will adhere to BMP's established in the current NCDENR, DWQ Stormwater BMP Manual. Mitigation DWQ - In accordance with 15A NCAC 2H.0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on January 15, 2002, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.ne.us/newetlands/stnuJde html. 1. Mitigation DWQ - In accordance with 15A NCAC 2H.0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on January 15, 2002, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete.
