Authorizing development in Craven County at adj. the Trent River, 102 Hellion Drive,

This permit, issued on November 7, 2006 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Docking Facility
1) This permit authorizes only the docks, piers, and other structures and uses located in or over the water
that are expressly and specifically set forth in the permit application. No other structure, whether
floating or stationary, shall become a permanent part of this docking facility without permit
modification. No non-water dependent uses of structures shall be conducted on, in or over public trust
waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the pen-nittee is responsible. This prohibition shall be applied and enforced throughout
the entire existence of the permitted structure.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31,1009
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program.

3) No attempt shall, be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.

4) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
5) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
6) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
7) This permit authorizes a maximum of ten boat slips.
NOTE: Any proposal to add one or more additional boat

8) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required,
upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or
obstructions caused thereby, without expense to the United States or the state of North Carolina. No
claim shall be made against the United States or the state of North Carolina on account of any sucl
removal or alteration.
9) No vegetated wetlands or open water areas shall be excavated or filled, even temporarily, without permi
modification.
NOTE: The project site is located in an area having a high probability of containing cultural resource:
such as shipwreck remains. If such materials are encountered, the permittee shall immediatel;
stop work and notify the District Engineer, Wilmington Branch, US Army Corps of Engineers a
(910) 251-4629, and the NC Division of Coastal Management at (252) 808-2808.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permit:
approvals or authorizations that may be required.

NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 808-2808 prior to the commencement of any
such activity for this determination. The permittee is further advised that any development or
land disturbing activity that is considered non-water dependent is not authorized within 50 feet of
the normal water level or landward edge of coastal wetlands unless specifically exempted by
Environmental Management Commission (EMC) Neuse River buffer regulations in place at the
time of such development.
NOTE: The permittee and/or his contractor is urged to meet with a representative of the Division prior to
project initiation.
NOTE: The N.C. Division of Water Quality has authorized the proposed project under General Water
Quality Certification No. 3400 (DWQ Project No. 061217), which was issued on 9/12/06.

Approval of 401 Water Quality Certification (GC3400) with Additional Conditions
Dear Mr. Hawkins:
You have our approval, in accordance with the attached conditions, to incorporate 0.2268 acres of Public
Trust Waters (PTA) and shade 0.0402 acres of PTA to construct a 10-slip docking facility as described in
your application dated June 8, 2006, and received by the Division of Water Quality (DWQ) 401
Oversight/Express Review Permitting Unit on July 28, 2006. After reviewing your application, we have
determined that the Division of Water Quality (DWQ) General Water Quality Certification Number 3400
covers these water impacts. This Certification allows you to General Permit No. 198000291 when issued
by the US Army Corps of Engineers (USACE). In addition, you should get or otherwise comply with any
other federal, state and local requirements before you go ahead with your project including (but not
limited to) erosion and sediment control regulations and CAMA. Also, this approval to proceed with
your proposed impacts or to conduct impacts to waters as depicted in your application shall expire
upon expiration of the 404 or CAN U Permit.
This approval is for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application. If the property is sold,
the new owner must be given a copy of this Certification and approval letter and is thereby responsible for
complying with all conditions. If total fills for this project (now or in the future) exceed one acre of
wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A
NCAC 2H.0506 (h). This approval requires you to follow the conditions listed in the attached
certification and any additional conditions listed below.
The Additional Conditions of the Certification are:

2. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or applicable
Buffer Rules, and any subsequent modifications, the applicant is required to return the attached
certificate of completion to the 401 Oversight/Express Review Permitting Unit, North Carolina
Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650.
3. Water Quality Certification
The proposed project must comply with all of the conditions of General Water Quality
Certification (GC) 3400.
Violations of any condition herein set forth may result in revocation of this Certification and may result in
criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct
impacts to waters as depicted in your application and as authorized by this Certification, shall expire upon
expiration of the 404 or CAMA Permit.
If you do not accept any of the conditions of this Certification (associated with the approved water
impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the date that you
receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the
North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center,
Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a
hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

9. Narrative Description:
The project site is located adjacent to the Trent River on the point of land in James City
where the Trent and Neuse Rivers converge south of New Bern. The subject shoreline is the
southeast side of the Trent River. This property lies between the bridges known as US 70
Bypass Trent River Bridge and US 70/17 Business Trent River Bridge. The applicant is
MMJH, LLC, who has recently constructed the Trent River Villas Condominiums landward
of any jurisdictional CAMA AEC's. There are twenty six (26) condominiums, and the
proposal is for a ten (10) slip docking facility to serve boat-owning residents.
The property is approximately 3.37 acres in size, and ranges from 5' to 9' in elevation, with a
shoreline length of approximately 578'. The shoreline is stabilized with a traditional wooden
bulkhead, and has several small "indentions" that appear to have been the locations of
previous landings of some sort. The condominiums and parking are nearing completion, and
all other associated infrastructure has been installed and constructed. The residents are
served by municipal water and sewer services.
The Trent River is in excess of 2000' across at the site location, and has a NCDWQ Water
Quality Classification of SB Sw, NSW. This area of the Trent River is not designated as a
Primary Nursery Area, and is just west of the transition between Coastal Waters, regulated
by the NCDMF, and Joint Waters, regulated by both the NCDMF and the NCWRC, putting
the proposal in Joint Waters. These waters are closed to the taking of shellfish. The
proposal lies entirely within the Public Trust and Estuarine Waters AEC's, carrying a Land
Use Classification of Conservation. The NCDWQ issued Stormwater Permit SW 7050501 on
6/14/05 for the high ground development. Additionally, the Land Quality Section of the DLR
issued Sedimentation/Erosion Control Permit CRAV-2005-056 on 5/20/05.
The proposal is to construct a 220' x 6' pier approximately 70' from the western property
line, beginning at the existing bulkhead. Extending towards the west will be 6 finger piers,
each 24' in length by 3' in width. Five (5) mooring pilings are proposed between the finger
piers, and eleven (11) are proposed 18' waterward of the fingers, or 42' west of the pier. The
fingers and associated mooring piles will create ten (10) slips. The project will terminate 31'
from the western riparian corridor, and much greater from the eastern riparian corridor.
The docking facility will be approximately 170' from the upstream Trent River Bridge, and
will terminate approximately 209' from the federal channel in -14' of water.
10. Anticipated Impacts:
The docking facility as proposed will incorporate 10,560 of Public Trust Waters, and shade
1752 sf of the same, in an area ranging from -.5' nwl at the bulkhead to -14' nwl at the
waterward end. Turbidity impacts may be seen during piling installation. There should be
no additional navigation impacts in this area of high boating use, given that the termination
point of the project will be 170' from the bridge and 209' from the channel.

The attached application has been revised per our meeting on May 9, 2006 and a
subsequent phone call from Stephen Lane on May 31, 2006. The following
changes/additions were made..
1. A letter with plans was sent certified mail to the adjoining land owner Gary
Garera to clear up any confusion over the proposed project. The "green card" and
a copy of the letter are attached.
2. A scale of 1"=90' was determined for the reduced plat.
3. The application has been properly dated.
4. "Conservation" has been checked in item 4g of form MP-1.
5. Item "a (1)" of form MP-4 has been checked "Community".
6. Item "f(1)" of form MP-4 has been checked "Community" and the 16 mooring
piles have been added to the structures.
7. Mr. Lane wanted the drawing sheets numbered sequentially. The drawings have
been numbered as Exhibits 1 thru 5. Please note the original sheet #'s have been
retained because we do not consider the attached drawings as being a single set.

other instrument under which the applicant claims title

Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the
