The contractor was working for the utility but the clearing happened in preparation for our bridge project. Per our Utility Relocation Agreement with the utility owner, no work was to begin prior to notifying NCDOT. This did not happen. Also, the clearing occurred in an area of the wetland that we were not planning to impact. Upon discovery yesterday afternoon, we had them cease work on the site until we could get our permitting secured. The area was cleared using equipment with tracked tires and no grubbing occurred. We had a project inspector visit the site today to survey the extent of the impact. Attached is a mark up showing in yellow the area of clearing. Also attached are a couple photos of the area. The disturbance to the soil is minimal and the area has been mulched. Our plan is to permit this additional area of clearing as temporary hand clearing when we provide Bryan the updated drawings showing the wetland boundaries from our JD site visit in early October. The permit drawings should be coming soon. We will also submit to DWR, so Dave can revise the 401 permit. If you have any questions or need additional information, please let me know. Thanks.
