This permit, issued on November 2, 2006 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. 1) Based on the request received by the permittee's authorized agent, the proposed pier and gazebo is hereby removed from this project. Any reference to the pier and gazebo in the permittee's application, including any reference in the workplan drawings, is hereby null and void. Shoreline Stabilization 2) The alignment of the permitted bulkhead, return wall, and riprap shall be staked by a representative of the Division of Coastal Management within a nlaxinuull of 30 days prior to the start of any construction. Failure to initiate COnStRIChOn within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the alignment to be restaked by DCM within a maxinlwn of' 30 days prior to the new expected start of construction. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit shall be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work shall cease when the permit expires on December 31, 2009 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. No excavation or other land disturbing activities is permitted except for that which may be required for the construction of the bulkhead wall, riprap, dcadnlen cables, etc. This permit does not authorize any excavation waterward of the approved allgnliiclit. 6) The backfill nlaterial shall be clean and free of any pollutants except in trace quantities. 7) All backfill material shall be obtained from a high ground Source and confined behind the permitted bulkhead. 8) The alignment of the approved riprap shall not extend more than 5 feet front the normal water level at any point along its alignment. 9) The riprap shall be positioned so as not to exceed a maxilllllill Of SIX Inches abOUt the CICVatIOIl Of the adjacent wetland substrate. 10) The riprap nlaterial shall be free from loose dirt or any pollutant. It shall be of a size sufficient to prevent its i-novelllellt from the approved alignment by wave Or CUrrent action. 11) The riprap material shall consist of clean rock or masonry materials such as but not limited to granite, Illarl, or broken concrete. Sedimentation and Erosion Control 12) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.). At a minimum, a silt fence shall be properly installed inlnlediately landward of the bulkhead cap and, irri mcdiately waterward of the fill adjacent to the bulkhead and return wall, inlnlediatcly following completion of backfilling activities. 13) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion within thirty days of project completion. After reviewing your application, we have determined that the Division of Water Quality (DWQ) General Water Quality Certification Number 3400 covers these water impacts. This Certification allows you to General Permit No. 198000291 when issued by the US Army Corps of Engineers (USACE). In addition, you should get or otherwise comply with any other federal, state and local requirements before you go ahead with your project including (but not limited to) erosion and sediment control regulations and CAMA. PROJECT SUMMARY: The applicant's are proposing to construct a retaining wall and bulkhead, second pier and gazebo, and walkway over water on the east side of the Tale of the Whale, an existing waterfront restaurant in Nags Head. Tale of the Whale June 27, 2006 Page 2 PROJECT SETTING Tale of the Whale is a local Nags Head restaurant located adjacent to the Roanoke Sound along US 64/264, also referred to as the Nags Head Causeway, in Nags Head, Dare County. Structures on the property include the restaurant, a paved parking lot, septic, a bulkhead, riprap along the eastern corner of the bulkhead, a waterward walkway, pier/platform, and gazebo. In 1987 the restaurant was located an average of 36' landward of normal water level (NWL). Due to ongoing erosion a bulkhead was constructed on the south side of the restaurant piling system, which is now located at NWL. Prior to February of 2003 the property consisted of 43,300 square feet with approximately 64.4% impervious lot cover, and approximately 82% of impervious lot cover within the 75' Estuarine Shoreline AEC. In February of 2003 the owners of the Tale of the Whale, Daniel and Kathy Bibey, purchased the adjacent lot to the east and recombined it with the restaurant property creating a 1.41-acre tract. Impervious lot cover within the Estuarine Shoreline AEC on the newly recombined lot is approximately 69.7%. There is little vegetation on the property with the exception of a wetland fringe to the east of the restaurant, in the gravel parking area, and where the septic system is located in front of the restaurant. Wetland vegetation includes smooth cord grass (Spartina alterniflora), salt meadow hay (Spartina patens), bulrush (Scirpus sp.), black needlerush (Juncus roemarianus), broomsedge (Andropogon virginicus), and annual marshelder (Iva annua). Vegetation in the parking gravel lot, and over the septic system, is predominately domestic grass. A 10' (including cantilevered bench seats) x 66' pier/platform with a 631 sf gazebo extends into the Roanoke Sound on the south side of the restaurant, and includes a 6' wide walkway over the water along the back of the restaurant leading the east side of the property. Shading from existing waterward structures is approximately 1,568sf. Platform area adjacent to the property is currently 3.2sf per foot of shoreline. Water depths, along the existing pier, range from 1%6" below NWL at the bulkhead, to 1'-8" below NWL at the gazebo. The property has approximately 300' of shoreline, of which 166' has a bulkhead and 16' has riprap. The remaining 118' of shoreline is unprotected, with 38' of eroding shoreline and 80' of Coastal Wetlands. Also located on the property, immediately landward of the delineated Coastal Wetlands, is approximately 263sf of delineated Section 404 Wetlands. Sparse patches of SAVs can be found near the project site, but no vegetation was found within the project area at the time of the site visit. The property is bounded on the east by a vacant lot and has no erosion control structures, and immediately to the east of the vacant lot is a mixed-use center with residential, retail and office space. Located to the west is a convenience store with a bulkheaded shoreline, and to the north across US 64/264, is a residential subdivision. The rear of the restaurant backs up to the Roanoke Sound. The Roanoke Sound is classified as coastal waters by agreement between the Marine Fisheries Commission and Wildlife Resource Commission. The Division of Environmental Management's water quality classification for Roanoke Sound, at the location in question, is SA (fishing). Tale of the Whale June 27, 2006 Page 3 Additional review indicates that there are no unusual geological formations associated with the applicant's property and no identified archeological sites on or within the immediate vicinity of the applicant's property. PROJECT DESCRIPTION The applicants are proposing shoreline and water based improvements to their property at the Tale of the Whale, a South Nags Head restaurant. Improvement include the following: Bulkhead and Retaining A 142.5' bulkhead and retaining wall will connect into the southwestern corner of the existing bulkhead adjacent to the restaurant and extend into the water an average of 14' waterward of NWL in front of an eroding pocket along an unprotected section of shoreline. As proposed the bulkhead will terminate at NWL and a retaining wall will extend along the landward side of a Coastal Wetland fringe. The bulkhead will be 61' in length and positioned an average of 14' landward of NWL, in water averaging six inches below NWL. Approximately 854sf of shallow bottom within Estuarine and Public Trust Waters will be filled in conjunction with the bulkhead. The height of the proposed bulkhead will be a 3'-9" above NWL, approximately one foot less than the average existing elevation of the property. There is no submerged aquatic vegetation (SAV) within the proposed fill below NWL. The proposed retaining wall will be 81.5' long, constructed immediately landward of the Coastal Wetland fringe, and involve the filling of a 263sf pocket of delineated Section 404 Wetlands. High Ground disturbance, including grading and fill will be approximately 3,666sf. Proposed Impacts From Fill: Shallow Bottom/Estuarine and Public Trust Fill: 854sf Section 404 Wetland Fill: 263sf High Ground Disturbance: 3,666sf Pier, Gazebo and Waterward Walkway The applicant proposes to construct a small 8' x 14.5' (116sf) walkway to an 8' wide pier that will extend from the applicant's proposed bulkhead 91.5' into the Roanoke Sound. The pier will have bench seats cantilevering two feet on each side of the pier for a distance of 20' leading from the gazebo towards the shoreline. Located at the waterward end of the pier, the applicant proposes to construct an open gazebo 631 sf in area, with railings to match the existing pier and gazebo located directly behind the restaurant. A walkway connecting the existing pier, gazebo and walkway is proposed along the waterward side of the existing and proposed bulkheads, and will be a5.5'x58.2'. The building is located on the US 64/264 highway Nags Head, NC. Please see vicinity map attached. The subject property is in the vicinity of a PWC rental facility and is consistently subjected to boat-wake wave action and subsequent erosion. The purpose of the proposed bulkhead and retaining wall is to form one continuous line of protection for the applicants' property while avoiding coastal wetland impacts. Backfill will be required as follows. The approximate amount of fill needed: Retaining wall backfill (404 wetland fill) Bulkhead backfill - below NWL Bulkhead backfill - above NWL Upland fill Total 17 CY 26.8 CY 112 CY 258 CY 413.8CY In order to enhance the property and reduce property damage caused by erosion, the applicant proposes the following: (includes construction calculations): • construct a 61 LF vinyl bulkhead connected to existing shoreline stabilization structure (bulkhead) onsite. Bulkhead backfill required below NWL is 26.8 CY. Bulkhead backfill required above NWL is 112 CY. • construct an 81.5 LF retaining wall to connect to the proposed bulkhead. In addition, the retaining wall will have a 12-foot return wall constructed at the eastern site boundary for a total of 93.5 LF. Required retaining wall backfill (404 wetland fill) is 17 CY.
