Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: The applicant hired S&EC, PA to delineate all potentially jurisdictional wetlands, streams, ponds and other waters within the project area and to have these areas verified by the USACE. The applicant then used this information to design their project, avoiding the vast majority jurisdictional areas to include the entire jurisdictional pond, 1,078 If of stream channel, the wetlands feeding the pond and those abutting the stream channels. The applicant could not avoid three, mostly linear wetland pockets, but has proposed mitigation to offset the losses. The applicant also hired S&EC, PA to locate any potential jurisdictional wetlands, streams and waters within the general alignment of the offsite sewer and has avoided all areas with the exception of a single stream crossing necessary to connect to an existing manhole and sanitary sewer line. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques: The applicant will obtain an erosion control permit and post -construction stormwater management plan from the City of Durham to help protected avoided onsite wetlands and waters and to ensure protection of downstream water quality. 2. Please note that this decision does not assure that participation in the DMS in - lieu fee mitigation program will be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the applicant to contact permitting agencies to determine if payment to the DMS will be approved. You must also comply with all other state, federal or local government permits, regulations or authorizations associated with the proposed activity including G.S. § 143-214.11.
