It's not common. They cannot issue a letter stating that verification is not needed. My guess is that the City is requesting top-of-bank verification on this project because of the floodway channel to the east, which could be interpreted as part of the stream. I'm quite sure that floodway channel is beyond what DWQ would consider "normal high flow" based on my field recon trips & training with DWQ, ACE, and NCSU staff. However, from my window it's looking like the next few days might not be so good for verifying this. I left a message for Amy Chapman (she works for Cyndi) to set up a verification visit ASAP. Hopefully she can do it next week. AMY: let's meet at the Best Western Hotel, on eastbound'New Bern Ave just outside the beltline (exit 13-B). The property is immediately west of the motel, alongside the 1-440 exit ramp. The stream length is about 2,000 feet, mature woods with a sewer ROW, easy walking -- 30 to 40 min on-site should be plenty of time. THOMAS: Please provide a letter from the OWNER authorizing RJGA as agents for regulatory permitting. ACE and DWQ agents will not enter a property without owner/agent permission. Gerald B. S-1 is beside the culvert inlet at the south end of the property, and S-73 is near the culvert outlet at the north end of the property, close to the billboard sign. Around bends the flags are 10 to 20 feet apart, and along straighter reaches they're 30 to 70 feet apart. The stream is perennial, based on DWQ methods. The questionable area where the mapped stream channel and stream buffer layers appear incongruent is due to a channel avulsion that may have occurred during a hurricane, creating an overflow channel. The active stream channel (flagged) is to the west. The apparent channel meander that protrudes eastward is a dry feature, NOT part of the "normal high water" channel and also not a jurisdictional wetland, but it does apparently flood during severe storm events. The 50' Neuse Buffer will be measured from the flagged active channel bank, not from the overflow channel meander. I examined all areas where wetlands might occur east of the stream (floodplain and upland depressions), and found none. Based on this survey there is NO jurisdictional wetland on the property east of the stream. There are a few homeless person camps on the site, in case you're not aware of these. I suggest having the stream bank flags surveyed soon, in case these "residents" find that my flags clash with their decor. Thanks again for another opportunity to serve Architektur. Gerald B. Director Division of Water Quality DWQ Project # 2006-0996 County: Wake On June 20, 2006, at your request, Amy Chapman conducted an on-site determination to review a stream feature located on the subject property for applicability to the Neuse Buffer Rules (15A NCAC 2B .0233). The feature is shown on the maps as a dashed red line and labeled as "A" on the attached map initialed by Amy Chapman on June 21, 2006. The Division of Water Quality (DWQ) has determined that the stream feature labeled as "A" on the attached maps is an ephemeral stream and is not subject to the Neuse Buffer Rule. The owner (or future owners) should notify the DWQ (and other relevant agencies) of this decision in any future correspondences concerning this property. This on-site determination shall expire five (5) years from the date of this letter. Landowners or affected parties that dispute a determination made by the DWQ or Delegated Local Authority that a surface water exists and that it is subject to the buffer rule may request a determination by the Director. A request for a determination by the Director shall be referred to the Director in writing c/o Cyndi Karoly, DWQ 401 Oversight/Express Permitting Unit, 2321 Crabtree Blvd., Suite 250, Raleigh, NC 27604-2260. Individuals that dispute a determination by the DWQ or Delegated Local Authority that "exempts" a surface water from the buffer rule may ask for an adjudicatory hearing. Applicants are hereby notified that the 60-day statutory appeal time does not start until the affected party (including downstream and adjacent landowners) is notified of this decision. DWQ recommends that the applicant conduct this notification in order to be certain that third party appeals are made in a timely manner.
