This permit, issued on August 14, 2006 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility 1) Unless specifically altered herein, this permit authorizes only' the access pier terminating in a 6 ft. x 40 ft. platform which will result in the addition of 1 slip to an existing 6-slip facility, all as expressly and specifically set forth in the permit application and attached workplan drawings. No other structure, whether floating or stationary, shall become a permanent part ' of these docking facilities without permit modification. No non-water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. NOTE: The permittee is advised that the scaled dimensions of the permitted structures on the attached workplan drawings appear to differ from dimensions authorized in condition No. 1 of this permit. The authorized structure shall not exceed the dimensions authorized in Condition No. 1. (See attached sheets for Additional; Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit shall be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work shall cease when the permit expires on December 31, 2009 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee The Sea Vista Subdivision c/o The Dolphin Co. and Walter Brown Permit # 97-06 A Page 2 of 3 ADDITIONAL CONDITIONS 2) The authorized docking facility shall not extend any further waterward than the existing docks on either side of the authorized structure. 3) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 4) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent southern property owner's riparian access corridor. This corridor is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the-shore at the-point-where, the upland. property line meets the water's edge. , NOTE: Because of inconsistencies of measured distances on the workplan drawings, the permittee is encouraged to re-establish the upstream property line prior to the initiation of construction to ensure compliance with the riparian corridor set back requirement. 5) The authorized structure shall not extend more than '/a of the width of the waterbody, as measured from the waterward edge of the marsh on both sides of the man-made canal immediately in front of the project site. 6) In order to ensure compliance with Condition Nos. 4 and 5 of this permit, an as-built survey showing the authorized docking facility, the distance to the neighboring property line, and the distance across the man-made canal shall be performed on the docking facility, and copies of the survey shall be provided to the Division of Coastal Management, within 60 days of completion of construction. NOTE: Failure to provide the survey required in Condition No. 6 may result in a violation of this permit. 7) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Tire-permittee-shall maintain-the authorized work-in-good-condition-and in conformance-with the-terms- and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 9) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury that may be caused from existing or future operations undertaken by the United States in the public interest. 10) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. Therefore, in accordance with T15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation within the PNA shall be permitted. Dredging in any manner,'including "kicking" with boat propellers, is not authorized. 12) This permit authorizes the addition of 1 boat slip to the existing 6-slip facility for a total of 7 slips. NOTE: The permittee is cautioned that this permit does not authorize the placement of tie piles in association with the docking facility. Furthermore, due to the proximity of Whittaker Creek and Broad Creek, boats utilizing the docking facility may be subject to frequent wavewash from passing vessels. The issuance of this permit does not relieve the permittee from taking all proper steps to ensure the integrity of the structure and the safety of moored boats. The permittee shall not hold the State of North Carolina or the United States liable for any damage to the structure or moored boats. General 13) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 14) The permittee and/or his contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division of Coastal Management at (252) 808-2808 prior to the commencement of any such activity for this determination. The permittee is further advised that, in accordance with the rules of the Environmental Management Commission, many non-water dependent activities are not authorized within 50 feet of the normal water level or landward edge, of any coastal wetlands, which ever is furthest. PROJECT SUMMARY: The applicant proposes to construct 1 additional slip at an existing 6-slip community docking facility. r _ FIELD INVESTIGATION REPORT: THE SEA VISTA SUBDIVISION PAGE #2 9. NARRATIVE DESCRIPTION: Project Setting The site is located in the Town of Oriental, Pamlico County. To access the site, head east on Hwy 55 and enter the Town of Oriental, then turn left onto Ragan Road. Head southeast for approximately 0.25 miles and turn left onto Norman Circle: The project is at the terminus of Norman Circle on lot 20 of the Sea Vista subdivision. The site is a community lot that has been designated for water access for 21 lot owners in the Sea Vista subdivision. The lot encompasses 0.33 acres and is adjacent to a man made canal that flows into Whittaker Creek. The lot is located at the end of a peninsula where the canal splits and terminates 600' beyond the lot in both directions. The property has an elevation of approximately 4' - 5' above the NWL. The majority of the lot is covered with sod grass, however, there are a few loblolly pine and cedar trees along the shoreline. The canal banks are steep and drop off immediately into open water with no wetlands along the shore. The property is approximately 308 feet in length along the shoreline. Current development on the HOA property is six docks which were constructed prior to 1984 and are visible in DCM 1984 aerial photos. Each dock was built for one slip. They are currently dedicated use docks for the sole use of six of the lot owners within the Sea Vista subdivision. The existing docks are shore parallel, front 193' of shoreline, have a maximum width of 6', and have a total shaded area of 748 square feet. The docks on both sides of the property are single-family residential docks and are also shore parallel docks, as are almost all docks in the canal due to the narrow width of the canal. A marine pumpout unit is not available at the site, however, the existing docks are not currently utilized for live-aboard or overnight accommodations. Multiple commercial marina's are located at the mouth of the man made canal where it meets Whittaker Creek approximately 800' north of the project site. Whittaker Creek is classified SA; HQW and NSW by the EMC in the area of the proposed construction. Whittaker Creek is classified by the Division of Marine Fisheries as a Primary Nursery Area, however, it is closed to shellfishing by the Shellfish Sanitation Section of the Division of Environmental Health. Water depths in the area of the proposed boat slip range from -5.6' to -8.0' below the NWL. Whittaker Creek is 86 feet wide in the project vicinity. No SAV's were observed in the project area during the site visit. The creek bottom substrate is composed of a silty sand in the project location. The Town of Oriental Land Use Plan classifies the site as Developed with all AECs classified as Conservation. Project Proposal The applicant is the HOA, and they propose to construct a 6' x 18' access pier to a 6' x 40' shore parallel platform. The pier would project a maximum of 18' beyond the existing shoreline at any point along its alignment. The pier would create one additional boat slip in addition to the six existing boat slips on the property. The pier would be located in the last remaining area available on the lot to construct a pier and would be over 200' from the eastern riparian line and 15' from the western riparian line. The slip is proposed to serve the remaining lot owners in the subdivision on a FIELD INVESTIGATION REPORT: THE SEA VISTA SUBDIVISION PAGE #3 "first come-first serve basis" for a boat up to 40' in length. The slip could be utilized for occasional overnight dockage. The proposed slip location places the slip in waters with depths in the 5' to 6' below NWL range. Anticipated Impacts The proposed boat pier would usurp an additional 312 sq. ft. of Estuarine Waters and Public Trust Areas of Whittaker Creek and would shade 312 sq. ft. of shallow water habitat. The construction of the access to the pier would also require the disturbance of 36 square feet of the high ground. The construction of the proposed pier would result in a total of 988 square feet of platform area on the lot. The pier would not exceed the existing pier head alignment and would not extend greater than '/4 the distance into the creek, nor would it extend into the navigable channel. A localized and temporary increase in turbidity can be expected during the in-water construction portion of the finger pier and mooring pilings. No additional closures of shellfishing waters are expected in association with the proposed project. The community use of the property would remain the same. (Refer to Coastal Resources Commission Rule 71.0203 for a detailed description.) Please note that original drawings are preferred and only high quality copies will be accepted. Blue-line prints or other larger plats are acceptable only if an adequate number of quality copies are provided by applicant. (Contact the U.S. Army Corps of Engineers regarding that agency's use of larger drawings.) A site or location map is a part of plat requirements and it must be sufficiently detailed to guide agency personnel unfamiliar with the area to the Form DChi-MP-1 site. Include highway or secondary road (SR) numbers, landmarks, and the like. • A Stormwater Certification, if one is necessary. A list of the names and complete addresses of the adjacent waterfront (riparian) landowners and signed return receipts as proof that such owners have received a copy of the application and plats by certified mail. DoC,I= Appikant or amr Signature Revised 03195 t _ ?; O March 30, 2006 Sea Vista Community Dock Dock Construction CAMA Major Permit Application Narrative Morehead The permit applicant proposes to construct a 40 ft long by 6 ft wide dock along the shoreline of a man-made canal in Oriental, NC in Pamlico County. The site is a vacant lot that is used as a common area for the property owners within the Sea Vista Subdivision. Currently other dock structures are located along the shoreline and the ownership Et / or use of these structures are by individuals other than the applicant. A list of these owners, or individuals who either built, or use these docking structures, is attached with this application. The lot (Lot 20) is currently registered under the ownership of The Dolphin Company of Greenville North Carolina. Mr. Brown is the principle owner of the property and manager of property owner functions of the Subdivision. Mr. Brown has authorized the application process for a CAMA Permit, on the behalf of the Subdivision, for Bill Jones to apply for the necessary permits to construct the dock. The dock will be built by Mr. Jones who owns property in the subdivision. Mr. Jones understands that the dock structure will be built along the shoreline of a common area within the subdivision ft the structure will not be built solely for his use alone, but will be used on a `first come, first use' basis. The lot is vegetated in upland grasses and trees and is located at the confluence of two canals that connect to Whittaker Creek, a tributary to Broad Creek and the Pamlico Sound. Water depths at a distance of 12 ft waterward of the NWL are approximately 5 to 6 ft, at NWL. The proposed dock structure will be aligned parallel to the shoreline and will be connected to the shoreline with a 6 ft by approx. 6 ft long walkway with steps from the grade of the adjacent upland tot.
