This permit, issued on September 27, 2006 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Shoreline Stabilization
1) The authorized alignment of the bulkhead shall be constructed in a straight line between the corners of
the two adjacent bulkheads, all as expressly and specifically set forth in the attached permit application
and workplan drawings.
2) The bulkhead shall be constructed prior to any backfilling activities.
3) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the
structure.
(See attached sheets for Additional, Conditions)
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit shall be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work shall cease when the permit expires on
December 31, 2009

4) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other
suitable materials approved by department personnel. No excavation or other land disturbing activities
is permitted except for that which may be required for the construction of the bulkhead wall, riprap,
deadmen cables, etc. This permit does not authorize any excavation waterward of the approved
alignment.
5) . The backfill material shall be clean and free of any pollutants except in trace quantities.
6) All backfill material shall be obtained from a high ground source and confined behind the permitted
bulkhead. _
Sedimentation and Erosion Control
7) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, etc.). At a minimum, a silt fence shall be properly installed immediately
landward of the bulkhead cap immediately following completion of backfilling activities.
8) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion
within thirty days of project completion.
Docking Facility
9) Unless specifically altered herein, this permit authorizes the 6 ft. x 130 ft. pier terminating in a 20 ft. x
20 ft. platform, the 14 ft. x 28 ft. boathouse, the 6 ft. x 38 ft. "L" shaped catwalk, and the 12 associated
mooring pilings, all as expressly and specifically set forth in the permit application and attached
workplan drawings. No other structure, whether floating or stationary, shall become a permanent part of
this platform without permit modification. No non-water dependent uses of structures shall be
conducted on, in or over public trust waters without permit modification.
10) The boathouse shall not be completely enclosed or have side coverage more than one half the height of
the side, from the roof waterward. The dripline of the boathouse shall not exceed 400 square feet.
11) The authorized boathouse shall be single story, and shall not be designed to allow for second story use.
12) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
13) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if she abandons the
permitted activity without having it transferred to a third party.

14) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to, the authorized structure or work, or injury
that may be caused from existing or future operations undertaken by the United States in the public
interest.
15) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
16) This permit authorizes a maximum of 5 boat slips.
General
17) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required,
upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or
obstructions caused thereby, without expense to the United States or the state of North Carolina. No
claim shall be made against the United States or the state of North Carolina on account of any such
removal or alteration.
18) No vegetated wetlands shall be excavated or filled, even temporarily.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 264-3901 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non-water
dependent activities are not authorized within 30 feet of the normal water level.

Project Setting
The site of the development proposal is a 30,492-square foot vacant lot located at 724 Small Drive
(private) off SR 1131 in Newbegun Land Subdivision, in Pasquotank County, and adjacent to the
Pasquotank River. The property is mostly flat and vegetated with indigenous grasses and a few
loblolly pines. The property has an elevation of approximately 8 feet above normal water level (NWL)
and the soils are classified as Elkton silt loam. Man-made features on the lot consist of riprap along
the 125-foot long shoreline.
The adjacent property to the north is a residential lot developed with a single-family dwelling and a
shoreline bulkhead. The adjacent property to the south is an undeveloped residential lot with a
shoreline bulkhead. The alignment of both bulkheads is approximately 19 feet waterward of the
existing riprap on the applicant's lot. The return walls for both bulkheads have experienced damage
and erosion and trash has accumulated along the applicant's shoreline. The existing riprap on the
applicant's property has experienced some damage from Hurricane Isabel and bare areas are visible.
The waters of the Pasquotank River in this area are classified as SC and are closed to shellfish taking.
Development Proposal
In order to prevent erosion and trash accumulation along the shoreline, the applicant proposes to
construct a new wood/vinyl bulkhead in line with the existing adjacent property bulkheads. The
applicant proposes to backfill the proposed bulkhead and to grade and slope the area along the current
shoreline.
In order to provide water access, the applicant proposes to construct a pier, platform, boathouse with a
catwalk, and four slips created by eight mooring pilings to be located in the approximate center of the
shoreline. The water depth in the Pasquotank River near the proposed pier head is approximately -4
feet deep. The proposed pier will be 6 feet wide and 130 feet long with a 20-foot-by 20-foot "L"
platform. A 6-foot wide and 38-foot long catwalk around a 14-foot by 28-foot boathouse with a boatlift
is to be constructed on the north side of the "U. Twelve (12) mooring pilings are proposed to create
four open slips.
Anticipated Impacts
The proposed bulkhead will result in the filling of approximately 2,312 square feet of Public Trust
Area and Estuarine Waters. Approximately 275 cubic yards of backfill material will be placed below
NWL as part of the backfill. The grading, sloping and seeding of the work area will involve
approximately 9,375 square feet of Estuarine Shoreline AEC.

The proposed pier and platform structures will result in 1,180 square feet of Public Trust Area,
Estuarine Waters AEC shading.
The proposed boathouse, boat lift and catwalk will result in 504 square feet of Public Trust Area,
Estuarine Waters AEC shading. The area of the proposed boathouse that is open water is
approximately 254 square feet and the total roofed area including overhang is 392 square feet. Total
proposed coverage is 1,684 square feet over Estuarine Waters and Public Trust Area AECs.
Temporary water turbidity will occur during construction. The pier, platform and boathouse will
provide moorings for five vessels and the four open slips will occupy approximately 960 square feet of
Estuarine Waters, Public Trust Area AECs.

PROJECT NARRATIVE
We own Lot 74 as shown on the plat enclosed with this application. As you can see fiom
the plat, our lot has suffered significant erosion as compared to the two lots immediately adjacent
to it. The prior owner of our lot placed some rock on the shoreline, but our lot is still subject to
and suffers from erosion from the pounding of the waves. Our lot has an elevation of
approximately 8 feet above the normal water level and an erosion escarpment started forming.
When the previous owner installed the existing rip-rap, the erosion of the shoreline slowed but
the bank has continued to experience erosion. Also, on the lot to our left there is continuing
erosion where the adjacent owners' bulkhead abuts our lot, which has no bulkhead.
We would like to erect a bulkhead across our lot to tie in with the existing bulkheads on
either side. We do not wish to extend any further into the water than the bulkheads on either
side. In other words, ours will sit "flush" with the adjacent owner's bulkheads. We will backfill
the eroded area after the proposed bulkhead has been constructed.
In addition to the aesthetic value of having our lot look the same as the lots on either side,
the bulkhead we propose should assist with controlling the erosion and trash build-up on our lot
as well as the bulkhead on either side.
We want to build a pier 150 feet in length with at least one boat lift. The pier will have a
"T" shape and may have a covered boat house or "gazebo" on the end. We also propose a
number of mooring pilings for additional dock space.
