Charles Taylor, Whiskey Creels Overlook Subdivision Pale 2 9. PROJECT DESCRIPTION: 'The project site is located at 231 Trails End Road, adjacent to Whiskey Creek, in New Hanover County. To locate the property traveling south on College Road, take a left onto Mohican Trail and travel approximately 1.3 miles. Turn left onto Masonboro Loop Road and travel north approximately 1 mile. Turn right onto Trails End Road and travel east for approximately 0.2 miles and until you reach the property of interest located on the left. Existing structures on the property include a gravel driveway and an abandoned two story single-family house overlooking Whiskey Creek. 'The property has approximately 600 feet of shoreline and averages approximately 15' above mean sea level. Highground vegetation of this tract consists of grasses and shrubbery. Other upland vegetation includes mixed hardwood and other species including: Oak, Dogwood and Pine. Waterward of the highground towards Whiskey Creek, tine elevation of tine property drops off substantially. The vegetation at this elevation transitions into an area approximately 10-15' in width consisting primarily of Smooth Cordgrass (Spartina altern, lora). There also exists a narrow band of Smooth Cordgrass (Spartina alternilora) approximately 40' in length by 10' in depth located on the western side of the existing pier. Waterward and surrounding the low marsh are several areas of oyster reefs visible in the mud flat at low water. An existing walkway runs down the steep bank and leads to an existing private pier. The pier terminates into an "L-head" platform with floating docks located on the northern side and eastern side of the platform (See Sheet 2 of 3). The New Hanover County Land Use Plan classifies the adjacent waters as Conservation, and the adjacent high ground portion of the project area as Resource Protection. In the project area, the waters of Whiskey Creek are classified as SA by the NC Division of Water Quality, and they are CLOSED to the harvest of slnellfisll. These waters are designated as a Primary Nursery Area (PNA), by the NC Division of Marine Fisheries. PROPOSED PROJECT: The applicant proposes the construction of a private 7-slip community dock into Whiskey Creek, which would accommodate 7 new lots within the Whiskey Creek Overlook subdivision. The application states that all proposed highground development would be located landward of the 75' Estuarine Shoreline Area of Environmental Concern (AEC). The 2.9 acre tract is approximately 500' in depth from Trails End Road to Whiskey Creek and averages approximately 150'in width, which would be subdivided into 7 lots averaging approximately 0.3 acres each. There would be a common area located at the eastern side of the entrance approximately 0.2 acres in size. A 20' private driveway within a 40' right-of-way would terminate in a cul-de-sac, which would access the proposed lots from Trails End Road. The application states that a 10' community easement between Lots 2 and 3 would be the location of the proposed community private pier into Whiskey Creek (See Sheet C 1). This area is approximately the location of the existing private pier, which would be demolished for the new community pier. An access pier would extend into Whiskey Creek a distance of 104' in length by 6' in width. The access pier would then terminate in a platform 152' in length by 6' in width, which would run parallel to the shoreline and the established channel of Whiskey Creek. Tine platform would create a "T-head" configuration designed to follow the landward edge of the established channel. The applicant also proposes a gazebo 12' in length by 12' in width, which would be located on the eastern side of the access pier creating a "L-head" configuration. The application indicates that current water depths are -2' relative to Mean Low Water (MLW) within the area of tine proposed 7 slips, which would be located on the Waterward edge of the proposed platform (See Sheet 3 of 3). The application states the appropriate Special Use Permit through the New Hanover County Planning and Zoning would be submitted for the community dock. Charles Taylor, Whiskey Creek Overlook Subdivision Page 3 10. ANTICIPATED 1IMPACTS: The proposed upland development for the subdivision ,vould not be located within the 75' Estuarine Shoreline AEC. The proposed community dock would incorporate 1,056 sq. ft. of Public Trust Area and Estuarine Waters and shade approximately 120 sq. ft. of Coastal Wetlands. Minor increases in turbidity should be expected during construction. The applicant does not request slips on the landward side of the proposed platform, however due to the limited amount of water located on the landward side of the proposed platform, approximately +0.5' (MLW) as shown on Sheet 3 of 3, there would be potential for bottom disturbance and displacement of the substrate "kicking" by vessel propellers if used. The proposed pier and platform would extend approximately 115' into a waterbody, which measures approximately 520 feet across on the eastern end of the property. The 40'section of the proposed platform would extend approximately 6'into a waterbody, which measures approximately 260' on the western end. These proposed distances would conform to the 1/4 width n?le. Submitted by: Robb L. Mairs Date: 6/2/2006 Office: Wilmington Form DCNI-NIP-1 .APPLICATION (To be completed by all applicants) b.
