We have also reviewed the Field Investigation Report (FIR), dated June 2, 2006, of the North Carolina Division of Coastal Management (NCDCM) on the proposed actions. The applicant, the Channel Bend Homeowners Association, has applied for a Department of the Army (DA) permit to replace an existing boat ramp, construct a walkway, and construct two wooden groins in or adjacent to the estuarine waters of Banks Channel. These comments are submitted in accordance with the Fish and Wildlife Coordination Act (FWCA) (48 Stat. 401, as amended; 16 U.S.C. 661-667d). Comments related to the FWCA are to be used in your determination of compliance with 404(b)(1) guidelines (40 CFR 230) and in your public interest review (33 CFR 320.4) in relation to the protection of fish and wildlife resources. Additional comments are provided regarding the District Engineer's detennination of project impacts pursuant to section 7 of the Endangered Species Act (ESA) of 1973, as amended (16 U.S.C. 1531-1543). The Service has reviewed available information on federally-threatened or endangered species known to occur in Pender County. We have also reviewed information from the North Carolina Natural Heritage Program (NCNHP) database which contains excellent data on the special status species, both federal and state. This database can be accessed by topographic quadrangle (quad) of the U. S. Geological Survey (USGS). The project area is located in the Holly Ridge quad. Based our review and information in the PN, the Service would concur with a determination by the District Engineer that the action is not likely to adversely affect species designated as threatened, endangered, or their designated critical habitat. The Corps' requirements pursuant to section 7 of the ESA would be fulfilled. However, the Corps trust reconsider its obligations under section 7 if. (1) new information reveals impacts of this identified action that may affect listed species or critical habitat in a manner not previously considered; (2) this action is r 7 r subsequently modified in a manner which was not considered in this review; or, (3) a new species is listed or critical habitat determined that may be affected by the identified action. 2 Based on the information provided in the PN, we do not believe the action will constitute irreversible or significant adverse impacts on fish and wildlife resources under our jurisdiction. Therefore, the Service has no objection to issuance of a DA permit for the actions described in the PN and FIR. However, we reserve the right to provide additional comments within the time period given in the PN if we become aware of significant new information regarding the availability of less damaging alternatives; project designs, or construction techniques; the functions and values of the abiotic resources to be impacts; and/or the fish and wildlife resources that would be impacted by the proposed actions. The Service also reserves the right to request an extension for providing additional comments if new information requires time for thorough analysis or a site visit if it is deemed necessary to protect federal trust resources. Boat Ramp Facility 1) Unless specifically altered herein, this permit authorizes the 12 ft. x 50 ft. replacement boat ramp, the 3 ft. x 65 ft. courtesy pier, the two 45 ft. groins, and removal of the existing boat ramp, all as expressly and specifically set forth in the permit application and attached workplan drawings. No other structure, whether floating or stationary, shall become a permanent part of this facility without permit modification. No non-water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit shall be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work shall cease when the permit expires on December 31, 2009 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee E ., Channel Bend HOA Permit # 129-06 Page 2 of 3 ADDITIONAL CONDITIONS 2) Any portion of the access pier located over coastal wetlands shall be elevated a minimum of 3 feet above the marsh substrate as measured from the bottom of the decking. 3) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 4) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 5) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury that may be caused from existing or future operations undertaken by the United States in the public interest. 6) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structures in order to make it more visible during hours of darkness or inclement weather. 7) This permit does not authorize the creation of any permanent boat slips. The addition of tie-downs, pilings, or other formal mooring structures shall require modification of this permit. 8) Ground disturbing activities above and below the normal high water line shall be limited to that absolutely necessary to establish adequate ramp slope for the approved 12 ft. x 50 ft. replacement boat ramp, all as specified in the permit application and attached workplan drawings. 9) The boat ramp shall either be poured at an upland location and pushed into place once hardened, or poured entirely within a watertight containment structure. Live concrete shall not be allowed to contact waters of the State or waters that will enter waters of the State. 10) The height of the authorized groins shall not exceed 1 foot above the normal high water level. General 11) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. Permit # 129-06 Page 3 of 3 13) The West Indian manatee (Trichechus nianatus), which is listed as a federally endangered species, has been reported in the tidal waters of Pender County. In order to protect the West Indian manatee all work should be done during the period from November 1 to May 31. If work must be done during the period from June through October the enclosed guidelines, entitled "Precautions for General Construction in Areas Which May Be Used by the West Indian Manatee in North Carolina" shall be followed. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: The N.C. PROJECT DESCRIPTION: The project site is located at the end of Channel Bend Road, adjacent to Banks Channel, in Surf City, Pender County. To get to the site from Wilmington take US Hwy 17 N to NC Hwy 210. Turn right onto NC Hwy 210 and continue to NC Hwy 50. Take a right onto NC Hwy 210/50. Travel across the swing bridge to NC Hwy 50. Take a left onto NC Hwy 50. Travel approximately 3 miles, Channel Bend Road will be located on the right side of NC Hwy 50. Turn right onto Channel Bend Road and travel to the end. The property is adjacent to residential lots on the eastern and southern sides and is adjacent to Banks Channel on the northern and western sides. The property is the common area for the Channel Bend Subdivision. The current elevation of the property ranges from 2' to 5' above mean sea level (MSL) and the property is approximately 58,000 ft.2. There is currently a damaged boat ramp and a 6' x 32' pier with an 8' x 80' floating dock. The high ground portion of the property is vegetated primarily with lawn grasses and Wax Myrtle (Alyrica cerifera). There are coastal wetlands located on the waterward side of the site and run the entire width of the property (approximately 650'). The coastal wetlands consist mainly of Black Needlerush (Juncus roemarianus), Sea Lavender (Limonhan, spp.), Salt Meadow Grass (Spartina patens), Salt Marsh Cordgrass (Spartina alterniflora) and Glasswort (Salicornia spp). The coastal wetlands vary in width from 3' to 90' transitioning into to a 5' - 10' fringe of Smooth Cordgrass marsh (Spartina alternijlora). The Town of Surf City Land Use Plan classifies the upland areas of this project as Community. The waters of the project site are classified as SA by the NC Division of Water Quality. The NC Division of Marine Fisheries has NOT designated this area of Topsail Sound as a Primary Nursery Area, and the waters adjacent to the proposed project are open to the harvesting of shellfish. PROPOSED PROJECT: The applicant is proposing to replace the existing boat ramp with a 12' x 50' boat ramp. The boat ramp is proposed to extend 40' below Normal High Water (NHW) and 10' above NHW. Also proposed are two 45' wooden groins on both sides of the boat ramp. On the southern side of the ramp the applicant is proposing to install a 3' x 65' walkway to stage boats during the loading and launching of boats from the boat ramp. The water depths at the end of the boat ramp, walkway and groins would be approximately -4' at MLW. 10. ANTICIPATED IMPACTS The construction of the boat ramp would result in the filling of approximately 480 ft.2 of shallow bottom and the disturbance of approximately 120 ft.2 of highground. The installation of the 3' x 65' walkway would result in the incorporation of approximately 195 ft.2 of open water. Lastly the installation of the 2 wooden groins would have approximately 90 ft.2 impacts to shallow bottom. Submitted by: J. W. The current boat ramp at the Channelbend subdivision is in disrepair from propeller backwash and erosion from boat wakes in Banks Channel. Also, the length of the current ramp does not provide adequate distance under mean low water level to allow for the safe launching and loading of boats from trailers. These issues currently present significant safety hazards. The Channelbend Home Owners Association proposal is two-fold, 1) install a longer reinforced boat ramp to provide sufficient depth to launch and load boats safely,at:.low., tide and to protect the ramp structure from prop wash associated with laynching? ilI)d loading boats, 2) construct groins along the sides of the boat ramp to protect the ramp from boat wakes. 'The following are the generalized details for the construction of the new boat ranip and associated protective structures: • Removing the existing 30' x 12' x 8" boat ramp and disposing of the debris in an authorized off site area. ® Constructing a new boat ramp which will involve: o Pouring a rebar and fiberglass-reinforced concrete boat slab on the upland area. o Lengthening the ramp an additional 20' to provide an adequate distance into the water to achieve sufficient depth at low tide to prevent boat trailers from dropping off the end. The proposed final dimensions are: 0' x 12' x 8". o Placing clean gravel (no fines) beneath the slab to be pulled/pushed into place. The gravel is intended to stabilize the base of the boat ramp. o Drag the pre-fabricated ramp across the gravel into position. • Building a 45'-long wood and plastic groin along the north side of the boat ramp. • Building a 45'-long wood and plastic groin along the south side of the boat ramp. o This groin will have a 3'-wide walkway along the top and will have a wood piling-supported platform that extends an additional 20' past the groin at a 45-degree angle and will be utilized as a boat tie-off point. This feature is another safety enhancement. This proposed construction will utilize a backhoe to breakup the existing ramp, a dump truck to dispose of the remains, cement truck to pour the new slab for the ramp, and a bulldozer and (possibly barge) to pusli/pull the slab into position. The proposed time frame for the project is as follows: One day for removing the existing ramp and placing clean gravel in the dimensions of the new ramp; three days to build a frame, pour the new ramp, and allow the concrete to set; one day to push the ramp into place; and two weeks to construct the protective groins, boat tie-off point, and walkway. This proposed time frame is dependent upon the accessibility of the equipment to the site and could require more time to complete depending on unanticipated variables such as weather.
