Any violation of these terms may be subiect to fines, imprisonment or civil action; or may cause the permit to be null and void. Shoreline Stabilization 1) The authorized alignment of the bulkhead shall be constructed in a straight line between the corners of the two adjacent bulkheads, all as expressly and specifically set forth in the attached permit application and workplan drawings. 2) The bulkhead shall be constructed prior to any backfilling activities. 3) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit shall be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work shall cease when the permit expires on December 31, 2009 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. No excavation or other land disturbing activities is permitted except for that which may be required for the construction of the bulkhead wall, riprap, deadmen cables, etc. This permit does not authorize any excavation waterward of the approved alignment. 5) The backfill material shall be clean and free of any pollutants except in trace quantities. 6) All backfill material shall be obtained from a'high ground. source and confined behind the permitted, bulkhead. Sedimentation and Erosion Control 7) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.). At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. 8) All disturbed areas shall be properly graded and provided. a ground cover sufficient to restrain erosion within thirty days of project completion. Water Access Platform 9) Unless specifically altered herein, this permit authorizes the.16 ft. x 16 ft. water access platform, all as expressly and specifically set forth in the permit application and attached workplan drawings. No other structure,- whether floating or stationary, shall become a permanent part of this platform without permit modification. No non-water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. 10) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 11) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if she abandons the permitted activity without having it transferred to a third party. 12) This permit does not authorize the creation of any boat slips. The addition of tie-downs, pilings, or other formal mooring structures shall require modification of this permit. United States or the state of North Carolina. No claim. shall. be made against the United. States or the state of North Carolina on account of any such removal or alteration. 14) . No vegetated wetlands shall be excavated or filled, even temporarily. 15) ' If the crossing of wetlands with mechanized construction equipment is necessary, temporary construction mats shall be utilized for the areas to be crossed. The temporary mats shall be removed immediately upon completion of construction. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. PROJECT SUMMARY: The applicants proposes to construct a 108-feet long wooden bulkhead and 256 square feet shoreside dock on their property located at Lot 7 Osprey Dr., Albemarle Shores Subdivision, Drummond Point Community, Chowan County, and on the Albemarle Sound. PROJECT SETTING The property is a 63,423 square feet (1.456-acre) lot located at Lot 7 Osprey Drive (private), Albemarle Shores Subdivision, off Drummond Point Rd. (SR 1100), in Chowan County and adjacent to Albemarle Sound. The property has an elevation of approximately one to five feet above normal water level (NWL) along high ground and 0 to 0.5-feet elevation in 404 wetlands, and has Roanoke soils. Approximately half of the lot on the east side is 404 wetlands, while the other half on the west side is uplands with 66- feet of wood bulkhead along the shoreline installed in 2001. The existing bulkhead is the only man-made feature currently on the tract. Vegetation on the property consists of Loblolly Pine, native cypress trees, Juncus effuses, and other indigenous trees and lawn grasses. The 404 wetlands have not been disturbed other than from the construction of a bridge crossing for Osprey Drive adjacent to the eastern property owner's lot, John Hally. Therefore, the wetlands are heavily vegetated, while the uplands portion of the lot was cleared, resulting in sparse presence of trees. No fill was brought to the site other than that needed to install the bulkhead in 2001. The 404 wetlands located on the eastern side of the property extend from Yeopim River to the northeast, across the lot to the applicant's east, John Hally's property, then toward Albemarle Sound and terminate 20-feet landward of normal water level. (NWL). The waters of Albemarle Sound most likely extend to the wetlands during high wave or storm events, but not during normal weather conditions: The wetlands are primarily fed from the northeast from Yeopim River: There are several cypress stumps located along the water's edge in a few inches of water along the natural shoreline area, and a couple dead cypress trees also exist in the water. Adjacent property consists of similar size building lots. Both lots to the east and west have been developed with single-family dwellings on them. Both adjacent lots, including 66-feet on the western portion of the applicants' lot, are bulkheaded and the applicants' property has experienced considerable erosion along the natural portion of shoreline (approximately 185-feet). The wing wall for the adjacent bulkhead to the east has been extended approximately 20-feet landward to prevent further erosion, resulting in accelerated erosion on the applicants' lot. The property on the west side has a functioning bulkhead that ties into the applicants' bulkhead. The applicants' bulkhead has an approximate 10-feet wingwall section near the middle of the lot, which also accelerated erosion along the natural shoreline area. The applicants did not extend the bulkhead the full length across their property in 2001 because they desired a sandy beach, which existed prior to Hurricane Isabelle, and hit the shoreline in September 2003. The applicants have lost their sandy beach area in the shape of a right triangle, approximately 108- feet long, and tapers to a maximum of 22-feet wide at the eastern property line. Most of the erosion occurred during Hurricane Isabelle, and the bulkheads on both sides of the natural shoreline area accelerated erosion. The water depth close to shore ranges from 0.5-1.0 feet and gradually deepens to 1.5 feet at waterward end of proposed shoreside dock. Division of Coastal Management General Permit # 27220A was issued on April 23, 2001, for the construction of the existing bulkhead. The waters of Albemarle Sound along the area of the property are not a primary or secondary nursery area, are closed to shellfish harvesting, and are classified as SB waters by the Division of Environmental Management. Reviews of available Jerry and Jona East Field Investigation Report Page 3 information suggest there are no known archeological sites or geologic formations associated with the applicant's property. DEVELOPMENT PROPOSAL In order to prevent further erosion, the applicants propose to construct a 108-feet long wooden bulkhead to connect with the corner of the existing bulkheads to the west and east and have a straight alignment. The proposed bulkhead alignment will have a maximum distance of 22-feet from the shoreline and an average distance of 15-feet. Clean, dry fill will be used for backfill from an upland pit. The tieback area will extend approximately 10-feet landward of the bulkhead sheathing, and the bulkhead will be constructed with a silt cloth on the landward side prior to backfill. The applicants are requesting this bulkhead alignment to regain lost uplands and to prevent trash and debris from collecting in the eroded area. The applicants propose to construct a 16-feet long by 16-feet wide shoreside dock in the middle of their property adjacent to the bulkhead, approximately 78-feet from riparian neighbors. The platform will be located in approximately 1.5-feet water depth. There are no proposed slips. ANTICIPATED IMPACTS The proposed bulkhead alignment with backfill will result in the filling of .approximately: 1',188 square feet of Public Trust Area (PTA), Estuarine Waters (EW) Area of Environmental Concern (AEC). Approximately 44 cubic yards of fill material will be placed below NWL for the backfill. To match grade, approximately 270 square feet (10 cubic yards) of fill material will be placed in the upland Estuarine Shoreline (ES) AEC. There are no expected impacts to the adjacent 404 wetlands due to the connection with Yeopim River to the northeast; however, comments from the U.S. Army Corps of Engineers should be taken into consideration to determine 404 wetland impacts. The proposed shoreside dock will shade 256 square feet. There are no expected navigational impacts due to the dock structure. Temporary water turbidity will occur during construction. The use of a filter cloth behind the bulkhead will minimize future erosion and turbidity.
