Karoly, Supervisor p R 401 Oversight and Express Permits Unit ?f Wetlands and Stormwater Branch 9 NCDWQ DO y JUN ! 9 2006 FROM: Ron Linville, Regional Coordinator Z` UENR - WATER QUALITY Habitat Conservation Program VsETUJ@-//rVSTOR1,fN:ATERERMCH DATE: June 13, 2006 SUBJECT: DWQ No. 20060860, JWSJRD, LLC, Shady Rest Campground, Sherrills Ford, Lake Norman, Catawba County The applicant is requesting 401 Water Quality Certification from the North Carolina Division of Water Quality. The NCWRC has reviewed information provided by the applicant, and field biologists on our staff are familiar with habitat values of the project area. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). The project is to install a 411 foot wall for stabilization using riprap along the existing shoreline. Based on our review of the proposal, we do not find reason to object to the project providing the project adheres to Duke Power Company Shoreline Management Plans, Federal Energy Regulatory Commission requirements, NC Department of Environment and Natural Resources, and any applicable buffer requirements. During our in-office review, the photograph included with the package indicated a plastic pipe with an outlet near the shoreline. If this pipe discharges stormwater or other wastewaters, should it be permitted? Piping stormwater through the buffer zone will diminish buffer benefits. We routinely provide the following recommendations for shoreline stabilization activities: 1. The stabilization projects should be done with minimum class I (class II preferred) riprap or rock. This size rock improves aquatic habitat structure. We do not support the use of river rock as mining river rock causes impacts to aquatic environments and destabilizes riparian ecosystems. Additionally, river rock does Mailing Address: Division of Inland Fisheries - 1721 Mail Service Center - Raleigh, NC 27699-1 i21 Telephone: (919) 707-0220 - Fax: (919) 707-0028 f ` Shady Rest Campground -Page 2 - June 13, 2006 not tend to remain in place (stabilize) or enhance aquatic habitat (void spaces) as does larger sized quarry stone. Fabric matting may be used beneath the stone to reduce erosion and turbidity. To the extent practicable, rock or stone should be placed just above the high water mark and towards the lake five (5) to six (6) feet or further to provide continuous aquatic edge habitat as lake levels rise and fall. 2. If appropriate, stabilization activities should be done from the water (by boat or barge) instead of the shore to minimize buffer impacts. Stabilization materials should be pressed into the existing buffer edge to shore up existing vegetation along the shoreline. Existing wooded buffers should be preserved. Any Large Woody Debris (LWD) should be maintained to the maximum extent practicable to provide aquatic habitat. If relocated, the LWD must be securely anchored so that it will remain where installed. 3. Stringent erosion control measures should be installed where soil is disturbed and maintained until project completion. Temporary or permanent herbaceous vegetation should be planted on all bare soil within ten (10) days of ground disturbing activities to provide long-term erosion control. 4. Where possible, rock should be placed at the edge of the eroding bank in a manner to "shore up" existing buffer and edge vegetation. Disturbed banks may be revegetated with silky dogwood (Corpus anionum), silky willow (Salix sericea), tag alder (Alnus serrulata), black willow (Salix nigra), and sycamore (Platanus occidentalis) or other native plants to provide long term bank stability and stream shading. Note that silky dogwood, silky willow and black willow can be planted as live stakes collected during the dormant growing season. Cuttings should be randomly planted and done on four (4) foot centers from the waters edge to the top of the bank. Trees should be planted on ten (10) to twelve (12) foot centers. Disturbed banks in these areas should also be seeded with an approved native wetland seed mix or temporary crop of wheat or rye. 5. As appropriate, naturally vegetated Catawba buffers should be protected and preserved permanently. Wide undisturbed shoreline buffers and natural vegetation should be maintained to the extent practicable. The provision of fencing and access trails may be needed in high use areas to protect buffers. 6. The applicant should contact local planning authorities to determine if local permits are needed for the project or for any buffer infringements or impacts. Thank you for the opportunity to review and comment on this project. If you have any questions regarding these comments, please contact me at 336/769-9453. Ec: Allan Johnson, DWQ-MRO O?O?
