This permit, issued on August 3, 2006 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. 1) Unless specifically altered herein, all development shall be carried out in compliance with the attached list of workplan drawings: sheet 1 through 4, 6 and 8 of 13 dated 11/29/06, sheet 5 of 13 dated 2/17/06, sheet 7 of 13 dated 2/7/05, sheet 9 of 13 dated 2/27/06, sheet 10 fo 13 dated 2/25/06, sheet 11 of 13 dated 2/24/06, sheet 12 of 13 dated 3/14/06, & sheet 13 of 13 dated 4/9/06 and the AEC Hazard notice dated 2/23/06. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit shall be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work shall cease when the permit expires on December 31, 2009 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Permit # 121-06 } Page 2 of 4 ADDITIONAL CONDITIONS Ocean Hazard Area Development 2) Prior to the initiation of construction within the Ocean Hazard AEC, the permittee shall stake, and a Division representative shall approve, the first line of stable, natural vegetation and the corresponding small and large structure setbacks. These setback determinations shall replace those done at the time the permit application was processed and approved. Construction shall begin within sixty days of this determination or the measurement is void and shall be re-established. In the case of a major shoreline change within that period, a new setback determination shall be required before construction begins. 3) Unless specifically altered herein, this permit authorizes the demolition of the existing structures and the - excavation-and grading" of the lots all as-expressly-and- specifically set-forth-in-the-attached application- and workplan drawings. 4) The two pools and associated structures shall be located entirely landward of the 90-foot small structure development setback line referenced in Condition No. 2 of this permit. 5) The foundation pilings, and any other foundation or support structures for the two 18,462 square foot 52-unit condominium buildings, as well as the 61, 789 square foot parking area, the engineered sewage treatment system with septic field, and the stormwater management areas, shall be located entirely landward of the 180-foot large structure development setback line referenced in Condition No. 2 of this permit. 6) Dune disturbance shall be allowed only to the extent necessary for development and if the dune's protective value is not weakened or reduced. All disturbed areas shall be immediately stabilized with vegetation. 7) All buildings in the Ocean Hazard AEC shall be on pilings not less than 8 inches in diameter if round, or 8 inches to a side if square. 8) All foundations and structures shall be designed to be stable during applicable fluctuations in ground elevation and wave forces during a-100=year storm.--Cantilevered-decks-and walkways- shall-rneet- this -- standard or shall be designed to break-away without structural damage to the main structure. 9) All building pilings shall have a tip penetration greater than eight feet below the lowest ground elevation under the structures. For those structures so located on the primary dune or nearer to the ocean, the pilings shall extend to five feet below mean sea level. 10) All construction within the Ocean Hazard AEC shall comply with all applicable requirements of the N.C. Building Code and the local flood damage prevention ordinance as required by the National Flood Insurance Program. If any provisions of the building code or a flood damage prevention ordinance are inconsistent with any AEC standards, the more restrictive standard shall apply. w Sea Gull Motel, Inc. ADDITIONAL CONDITIONS Permit # 121-06 Page 3 of 4 11) Any structure within the Ocean Hazard AEC shall be relocated or dismantled when it becomes imminently threatened by changes in shoreline configuration. The structure(s) shall be relocated or dismantled within two years of the time when it becomes imminently threatened, and in any case upon its collapse or subsidence. However, if natural shoreline recovery or beach renourishment takes place within two years of the time the structure becomes imminently threatened, so that the structure is no longer imminently threatened, then it need not be relocated or dismantled at that time. This condition shall not affect the permit holder's right to seek authorization of temporary protective measures allowed under the Rules of the Coastal Resources Commission. NOTE: In accordance with 15A NCAC 7H.0308(a), no new seawall or riprap revetments shall be allowed in the future should any structure become threatened from erosion. NOTE: In order to protect hatchling loggerhead sea turtles, all lights on building faces, including balcony lights on the ocean side of all structures, should be eliminated. Where ocean side lighting is required, alternatives including shading, screening, or replacing fixtures with modern alternative light sources should be utilized. Parking lots, streets, walkways, dune crossovers, and other areas requiring lights should be illuminated with light fixtures located close to the ground to minimize casting direct light on the beach and dunes. For more information on the proper design of ocean side lighting, contact the N.C. Wildlife Resources Commission at (919) 729-1359. Erosion and Sedimentation Control NOTE: An Erosion and Sedimentation Control Plan shall be required for this project. This plan shall be filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this plan to the Department of Environment and Natural Resources, Land Quality Section, 943 Washington Square Mall, Washington, NC 27889. 12) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, sand fence, etc.). Stormwater Management 13) The N.C. Division of Water Quality approved this project under stormwater management rules of the Environmental Management Commission under Stormwater Permit No. SW7050316 on 8/3/06. Any violation of the permit approved by the DWQ shall be considered a violation of this CAMA permit. General NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. PROJECT SUMMARY: The applicant proposes to demolish an existing small two-story hotel and construct two, five story, 52 unit condominium buildings with associated parking areas; two pool decks each containing a pool, hot tub, and tiki bar; an engineered sewage treatment system with septic field, two storm water management basins, and three underground storm water management areas. PROJECT SETTING This project is located at 56839 and 56883 NC Highway 12 on two adjacent ocean front lots in Hatteras Village in Dare County. The eastern parcel (56839 NC 12) is a 67,836 SF lot (1.56 acres) that formerly contained the General Mitchell Motel, and the western parcel (56883 NC 12) is a 160,680 SF lot (3.69 acres) that currently contains the Sea Gull Motel. The General Mitchell Motel was severely damaged by Hurricane Isabel and was demolished under Minor Permit 2005-76 issued by Dare County on July 5, 2005. The Sea Gull Motel is a small two- story 4,550 SF structure with associated parking areas, septic system, and pool. Although these two parcels are ocean front lots, an unnamed creek that connects to the Pamlico Sound is located approximately 650 feet to the northwest and the sound is located approximately 1,700 feet to the northeast. The northern boundary of the property borders NC Highway 12, while the southern property boundary is comprised of a man-made frontal dune bordering the Atlantic Ocean. No erosion escarpment exists. The frontal dune is part of the large dune structure that was constructed by FEMA along the entire Hatteras Village oceanfront after Hurricane Isabel in 2003. The dune is approximately 60 feet wide and has been planted with beach grass (Ammophila breviligulata) and irrigated to promote plant growth. The dune contained beach grass approximately three-feet tall, pennywort (Hydrocotyle bonariensis), and other small weeds, but in September 2005 Hurricane Ophiela relocated approximately one-foot of sand from the FIELD INVESTIGATION REPORT: Seagull Motel, Dare County Page 3 of 5 adjacent beach onto the front and top of the dune, burying the low-lying vegetation. The DCM Field Representative has monitored this site since September and has determined that the beach grass not only survived the hurricane's effects, but is thriving, as evidenced by the large number of lengthy new rhizomes that have appeared this spring. A man-made secondary dune is located immediately landward of the frontal dune. The secondary dune structure is approximately 45 feet wide and is vegetated with beach grass (Ammophila breviligulata), pennywort (Hydrocotyle bonariensis), Spanish bayonet (Yucca aloifolia), isolated patches of sea oats (Uniola paniculata), weeds, and other grasses. The remaining portions of the Sea Gull Motel parcel are also vegetated with beach grass (Ammophila breviligulata), pennywort (Hydrocotyle bonariensis), Spanish bayonet (Yucca aloifolia), panic grasses (Panicum species), patches of sea oats (Uniola paniculata), weeds, and other grasses. No other vegetation remains on the former Mitchell Motel lot due to the recent demolition activities. The lot east of the subject property contains the Hatteras Cabanas, which consists of 48 single-room elevated cabanas. The lot east of the Hatteras Cabanas is also vacant, but a major permit has been issued to Durant's Station to construct another large condominium project. The lots west of the subject property contain large, multi-bedroom "single family homes." This project is located in an area that has an erosion rate of three feet per year. The 100-year recession line of 70 feet yields a 250-foot Ocean Erodible Area of Environmental Concern (AEC). The small structure setback is 90 feet and the large structure setback is 180 feet. The subject property is currently in a FEMA Flood Zone marked AE, but preliminary map #3720959400J dated April 29, 2005 indicates that the area will be re-classified as VE (10). At present, the Ocean Erodible AEC extends farther landward than the High Hazard Flood AEC. As mentioned earlier, the damaged General Mitchell Motel was demolished. All construction debris has been removed except for the concrete portions of the previous structures that were pulverized into small pieces (less then 3 inches in size). Two large piles of the crushed concrete are now stored on-site and will be used for fill required for the proposed structures. A chain link fence and silt fence have been installed around the 67,836 SF Mitchell Motel parcel. PROJECT DESCRIPTION The applicant proposes to demolish the following structures: • The 4,550 SF two-story Sea Gull Motel hotel and associated septic system, • A 2,204 square-foot pool deck, • Approximately 23,675 SF (.54 acres) of parking/driveway areas, and Approximately 150 feet of wooden walkway leading to an existing dune crossover. FIELD INVESTIGATION REPORT: Seagull Motel, Dare County Page 4 of 5 The applicant then proposes to place approximately 6,585 CY of fill across the lots to achieve a final elevation of 6 - 7.5 feet and then construct the following: • Two, 18,462 SF, five story, L-shaped, 52 unit condominium buildings; • 61,789 SF (1.42 acres) of associated driving/parking areas; • Two 4,420 square foot pool decks each containing a pool, hot tub, and tiki bar; • An engineered sewage treatment system with septic field, • Two storm water management basins totaling 26,723 SF (.61 acres) in size, and • Three underground storm water management areas. The first proposed building will be constructed in the southeast corner of the property along the eastern and southern property boundaries. The L-shaped building will be five stories tall cover 18,462 square feet and contain 51 condominiums and the complex's office. The second proposed building will be built in the southwest corner of the property along the western and southern property boundaries. It will also be five stories tall and cover 18,462 square feet, but it will contain 52 condominiums. Asphalt driveways and 61 parking spaces will surround the buildings and create 61,789 SF (1.42 acres) of impervious area. Parking spaces for another 96 cars will be located under the buildings. The applicant claims the first floor elevation for each building will be 17.67 feet. The applicants propose to install two 4,420 SF pool decks ocean-ward of the proposed buildings along the property's southern boundary. These structures will be located behind the 90-foot CAMA small structure setback and in front of the 180-foot large structure setback. Each pool deck will contain a 978 SF swimming pool, a 110 SF hot tub,. and a 289 SF tiki bar. The proposed sewage treatment system will be located in the north-central portion of the property along NC 12. Sewage from the proposed buildings will flow in series through four 8,000-gallon septic tanks and then in parallel through one of three 10,000-gallon aerobic treatment units. Treated wastes will then be discharged into a 10,000-gallon clarifier and a 10,000-gallon pump unit which will pump the waste into a 15,400 SF (.35 acres) septic field located immediately south of NC 12. Two storm water management basins are proposed: a 9,491 SF (.22 acres) basin in the northwest corner of the property that will provide 14,808 cubic feet of storage and a 17,232 SF (.40 acres) basin in the middle of the property that will provide 26,904 cubic feet of storage. Each basin will be 1.73 feet deep and will accept storm water run-off from the adjacent driveway/parking areas. Finally, the applicants propose to install 297 CULTEC CONTACTOR 100 storm water management devices under the proposed driving/parking areas to further control storm water run-off. Each of the CULTEC 100 devices is 8 feet long, 3 feet wide and approximately 1 foot tall. They can be best described as a large 8-foot long perforated plastic pipe that is 6- foot in diameter that has been cut in half. The 3-foot wide "half-pipes" will be installed in a gravel bed and storm water will be piped to each of the devices to facilitate storm water infiltration.
