Revision to On-Site Determination for Applicability to the Neuse Riparian Area Protection Rules
(15A NCAC 2B.0233)-EXPRESS REVIEW PROGRAM
On May 30, 2006, at the request of Kevin Martin of S&EC, Inc., an on-site determination was conducted
to review stream features located on LOT 12 for applicability to the Neuse Buffer Rules (15A NCAC 2B
.0233). The features are labeled as "A, B, and C" on the attached maps, initialed by Cynthia Van Der
Wiele, Ph.D. on May 31, 2006 and on June 19, 2006.
The Division of Water Quality (DWQ) has determined that the following:
¦ Feature "A" is subject to the Neuse Buffer Rules at the S&EC start flag.
¦ Feature "B" is not subject to the Neuse Buffer Rules.
¦ Feature "C" was not examined during this time as it was previously determined to be
subject to the Neuse Buffer Rules.
This on-site determination shall expire five (5) years from the date of this letter.
Landowners or affected parties that dispute a determination made by the DWQ that a surface water exists
and that it is subject to the buffer rule may request a determination by the Director. A request for a
determination by the Director shall be referred to the Director in writing c/o Cyndi Karoly, DWQ 401
Oversight/Express Review Permitting Unit, 2321 Crabtree Blvd., Raleigh, NC 27604-2260. You must act
within 60 days of the date that you receive this letter. Applicants are hereby notified that the 60-day
statutory appeal time does not start until the affected party (including downstream and adjacent
landowners) is notified of this decision. This determination is final and binding unless you ask for a
hearing within 60 days.
This letter only addresses the applicability to the buffer rules and does not approve any activity within the
buffers. Nor does this letter approve any activity within Waters of the United States or Waters of the
State. Wake County GIS maps are not recognized by the Division of Water Quality for the purpose of
determining subjectivity to the Neuse Riparian Area Protection Rules, or for intermittent/perennial stream
determination purposes.

Cynthia with all due respect, you are setting a precedent by not using the larger scale more legible maps.
EVERY buffer letter I have ever gotten from DWQ utilized maps in addition to the USGS and Soil survey
for the simple reason that if you do not, the maps and letter you provide at the scale of USGS and Soils
survey are useless since they are not legible. Please revise your letter consistent with the way buffer
letters and maps have always been prepared. If necessary I can send you plenty of examples. I am very
disappointed that it has been 2 weeks for an express buffer call and I have yet to receive a letter that is
useable.
As far as the project name you are correct, you used the name from my initial request, but when I met
Perianne on site she informed me that you had decided that even though the areas in question were within
the same project (Ammons East park) since that were 2 lots that were not adjacent to each other there
would be 2 fees required not just the one I had paid on behalf of my client. At the meeting I advised her
that since the second lot was no rush, I would decline to do lot 1 under express and we only evaluated lot
12. Apparently that info did not make it to you. I do not necessarily agree with the decision made but it was
not worth further discussion at the time, however on reflection it seems a bit contradictory to consider the
project one project as far as permit applications go but separate as far as express review goes!
Please advise when I can receive the revised letter. Thanks Kevin

Kevin,
I prepared the letter with the project name you provided.
The stream determinations require us to use the USGS and/or the County
Soil Survey Map. The Wake Co. GIS map may indicate the stream clearer
due to scale, however, we do not recognize this legally. We can prepare
another letter for your convenience indicating the stream on this map,
but we do not wish to set a precendent with regard to the use of other maps.

On May 23, 2006, the Wetlands/401 Unit of the Division of Water Quality received a FWemail request
from Kevin Martin of S&EC, Inc., regarding a stream origin call for a project known as "Ammons East
Corp Lot 12 and l " for acceptance into the Express Review. Program. This letter advises you that your
project will be accepted into the Express Review Program once the following, items are received:
1) The fee of 5200.00 made payable to the North Carolina Division of Water Quality (for two (2) stream
determinations);
2) Five (5) complete. and collated copies of the most recent versions of the MRCS Soil Survey map and
the 1:24,000 USGS Topographic map for the site, both with the property boundaries located; and
3) A vicinity map clearly marking the location of the site.
Pleasc note that web-based versions of the MRCS. Soil Survey Map are not acceptable as they do not
include the complete data layers. Thank you for your attention to this matter.
Please mote that the clock for this project will not start until receipt of the completed application package
