This permit, issued on August 21, 2006 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Upland Development 1) Unless specifically altered herein, this permit authorizes only the grading and other land disturbing activities associated with the development of the property located off Radio Island Dr. in Carteret County adjacent to the conflux of the Newport River and Bogue Sound, including the demolition of all existing structures, the development of all roads, parking areas, infrastructure, utilities, and 20 town homes, all as expressly and specifically set forth in the attached permit application forms and drawings. Any additional land disturbing activities and/or construction may require a modification of this permit. Contact a Division of Coastal Management representative at (252) 808-2808 for this determination. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit shall be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Tide Lines, LLC Permit # 142-06 ti Page 2 of 5 ADDITIONAL CONDITIONS Marina 2) Prior to the occupancy of any new slips authorized under this permit, a marine pumpout sewage disposal facility shall be installed and operable, and maintained for the life of the marina. 3) Prior to the occupancy of any slips authorized by this permit, the permittee shall meet on-site with a representative of the Division to ensure that the required pumpout facility is in place: and; operable. 4) The marina shall display a sign showing the location of the on-site pumpout facility, including other appropriate waste disposal information, at the entrance and exit from the main piers. _5)___ Unless-specifically altered- herein, this permit--authorizes the removal of the existing, docking facilities, and the development of the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the attached permit application and workplan drawings. No other structure, whether floating or stationary, shall become a permanent part of this marina facility without permit modification. No non-water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. NOTE: Should the adjacent property located to the east be sold prior to the initiation of construction, the permittee shall be required to obtain a signed riparian corridor waiver from the new property owner prior to the placement of any structures within the 15-foot riparian corridor. 6) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the marina. Any sewage discharge at the marina facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 7) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 8) The permittee shall maintain the authorized work in good condition and in conformance with the terms -and conditions of this permit: The permittee is- not relieved- of this requirement if he abandons the permitted activity without having it transferred to a third party. 9) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury that may be caused from existing or future operations undertaken by the United States in the public interest. 10) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 11) This permit authorizes a maximum of 28 boat slips. Tide Lines, LLC Permit # 142-06 Page 3 of 5 ADDITIONAL CONDITIONS NOTE: Due to the proximity of the Newport River and Morehead City Channel, boats utilizing the marina shall be subject to frequent wavewash from passing vessels. The issuance of this permit does not relieve the permittee from taking all proper steps to ensure the integrity of the structure and the safety of moored boats. The permittee shall not hold the State of North Carolina or the United States liable for any damage to the structure or moored boats. Shoreline Stabilization 12) The alignment of the permitted bulkhead and riprap shall adhere to the alignment depicted on the attached workplan drawings. This alignment shall be staked by the permittee and approved on site by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of any construction. - 13) The bulkhead shall be constructed prior to any backfilling activities. 14) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 15) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other suitable materials approved by department personnel. 16) The riprap material shall be free from loose dirt or any pollutant. It shall be of a size sufficient to prevent its movement from the approved alignment by wave or current action. 17) The riprap material shall consist of clean rock or masonry materials such as but not limited to granite, marl, or broken concrete. 18) The backfill material shall be clean and free of any pollutants except in trace quantities. 19) All backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. 20) There shall be a minimum of a 5 ft. separation between the riprap and any adjacent coastal wetlands. 21) The riprap sill shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor, which is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge Excavation 22) Unless specifically altered herein, the dimensions of the area to be dredged shall not exceed that which is set forth in the attached permit application and workplan drawing 4 of 5 dated 3/29/06. Any proposal to change the area to be dredged shall require permit modification. 23) Excavation shall not exceed -4 feet below the normal low water level. In no case shall the depth of excavation exceed the depth of connecting waters. Tide Lines, LLC ADDITIONAL CONDITIONS Spoil Disposal Permit # 142-06 Page 4 of 5 24) All excavated materials shall be confined to the area indicated on the attached workplan drawing 4 of 5 dated 3/29/06 and shall be confined behind adequate dikes or other retaining structures to prevent spillover of solids into any coastal wetlands or surrounding waters. Sedimentation and Erosion Control NOTE: An Erosion and Sedimentation Control Plan shall be required for this project. This plan shall be filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this plan to the Department of Environment and Natural Resources, Land Quality Section, 127 Cardinal Drive Extension, Wilmington, NC 28405. _ 25) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,- diversion swales or berms, etc.). At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. Stormwater Management 26) The N.C. Division of Water Quality approved this project under stormwater management rules of the Environmental Management Commission under Stormwater Permit No. SW8051050 on 7/18/06. Any violation of the permit approved by the DWQ shall be considered a violation of this CAMA permit. General 27) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or-the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 28) The West Indian manatee (Trichechus manatus), which is listed as a federally endangered species, has been reported in the tidal waters of Carteret County. In order to protect the West Indian manatee all work should be done during the period from November 1 to May 31. If work must be done during the period from June through October the enclosed guidelines, entitled "Precautions for General Construction in Areas Which May Be Used by the West Indian Manatee in North Carolina" shall be followed. 29) No vegetated wetlands shall be excavated or filled. . 30) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not authorized. Tide Lines, LLC Permit # 142-06 Page 5 of 5 ADDITIONAL CONDITIONS NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 808-2808 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: The N.C. Division of Water Quality has authorized the proposed project under General Water Quality'Certification No. 3400 (DWQ Project No. 060818), which was issued on 7/18/06. NOTE: The U.S. Army Corps of Engineers has assigned the proposed project COE ORM No. SAW- 2006-32911-016. NOTE: The permittee is advised to contact the NC Department of Transportation prior to the initiation of construction to determine of any permits may be necessary for the proposed project. NOTE: The permittee is advised that the State Ports Authority intends to construct a commercial breakbulk cargo terminal on Radio Island. Klimek, P.E. Director Division of Water Quality DWQ Project # 060818 Carteret County You have our approval, in accordance with the attached conditions and those listed below, to dredge 32,400 square feet of Open Water for the purpose of constructing a private boat basin with 28 boat slips adjacent to the proposed townhomes and fill 8270 sq feet of shallow bottom habitat (of this 4590 sq ft is behind the new bulkhead and 3680 sq ft is for the proposed rip rap sill), as described within your application dated March 3, 2006and received by the Division of Water Quality (DWQ) in the Wilmington Regional Office (WiRO) on May 16, 2006. After reviewing your application, we have decided that the impacts are covered by General Water Quality Certification Number 3400 (WQC 3400). The Certification allows you to use the CAMA Major Permit when issued by the Division of Coastal Management. In addition, you should obtain or otherwise comply with any other required federal, state or local permits before you go ahead with your project including (but not limited to) Erosion and Sediment Control, Non-discharge, and stormwater regulations. Also, this approval to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon expiration of the 404 or CAMA Permit. This approval is for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). This approval requires you to follow the conditions listed in the attached certification and any additional conditions listed below. The Additional Conditions of the Certification are: 1. The construction of this project or any portion of this project shall not cause additional closure to shellfish waters. If modifications are required to avoid shellfish closures the applicant will modify the project as necessary and send a copy of the modified plan to DWQ at the address at the bottom of this page. If no modifications are done and the project does close shellfish waters, this certification is voided and the applicant will have to reapply for a certification with a modified plan that will not close additional adjacent waters to shellfishing. Erosion & Sediment Control Practices Erosion and sediment control practices must be in full compliance with all specifications governing the proper design, installation and operation and maintenance of such Best Management Practices in order to protect surface waters standards: a. The erosion and sediment control measures for the project must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control Planning and Design Manual. b. The design, installation, operation, and maintenance of the sediment and erosion control measures must be such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the project. c. For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Surface Mining Manual. d. The reclamation measures and implementation must comply with the reclamation in accordance with the requirements of the Sedimentation Pollution Control .Act. 4. No Waste, Spoil, Solids, or Fill of Any Kind No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of the impacts depicted in the Pre-Construction Notification. All construction activities, including the design, installation, operation, and maintenance of sediment and erosion control Best Management Practices, shall be performed so that no violations of state water quality standards, statutes, or rules occur. No Sediment & Erosion Control Measures w/n Wetlands or Waters Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade restored within six months of the date that the Division of Land Resources has released the project. 6. Certificate of Completion Upon completion of all work approved within the 401 Water Quality Certification or applicable Buffer Rules, and any subsequent modifications, the applicant is required to return the attached certificate of completion to the 401/Wetlands Unit, North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650. Violations of any condition herein set forth may result in revocation of this Certification and may result in criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application and as authorized by this Certification shall expire upon expiration of the 404 or CAMA Permit. If you do not accept any of the conditions of this Certification (associated with the approved wetland or stream impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing. S. Fish and Wildlife Service (Service) is unable to provide detailed comments on the three, subject Public Notices, all of which were issued on June 8, 2006. We have briefly reviewed each PN and believe that with standard environmental safeguards employed by the Wilmington District and the North Carolina Division of Coastal Management, none of the proposed actions would result in significant or irreversible damage to federal trust resources. As a general comment, the Service requests that any work involving dredging in coastal water with depths greater than three feet at mean low water should be evaluated for potential impacts on the federally endangered West Indian manatee (Trichechus manatus). This species moves along the Atlantic Coast during summer months and are seasonal transients in North Carolina, primarily from June through October. If dredging would occur in water suitable for manatees, the guidelines developed by the Service to protect the species should be required as permit conditions. These guidelines, "Precautions for General Construction in Areas Which May Be Used by the West Indian Manatee in North Carolina," address all types of in-water construction, except blasting, and should produce little, if any, additional expense. The guidelines are intended mainly to ensure that construction personnel are informed that manatees may occur in the work area, that work should cease if a manatee approaches the work area, work should not resume until the manatee leaves the work area, and procedures for reporting the death or injury of a manatee. The risk to manatees could be reduced to an acceptable level by the implementation of the Service's guidelines. The risk would be further reduced by performing the work during the period of November through May. 4- 2 With regard to the work proposed by Core Creek Marine, #SAW-2006-32427-016, we recommend that you review our comments for Action ID # 200600623 (Hobby World Development) sent on April 13, 2006, and Action ID # 200600748 (Jarrett Bay Group) sent on June 19, 2006. The current applicant is in the same location and seeking authorization for similar work as the prior applicants. Relevant aspects of our previous recommendations should be applied to any Department of the Army permit issued to Core Creek Marine. The Service appreciates the opportunity to provide these limited comments. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H.0506 and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. Impact Justification (Avoidance and Minimization) This office strongly recommends that you revise the site plan to avoid some of the proposed impacts within the boat ramp area. 2. Please include the justifications for all of the proposed shallow bottom impacts. If we do not hear from you within three weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. Narrative Description: The Tide Lines project is located on the west side of Radio Island Dr, on Radio Island, Carteret County. The site lies between Radio Island Marina and the North Carolina Ports Authority properties. This area is just south of Hwy. 70. An embayment of the Morehead City Channel borders the site to the south and west at its conflux with the Newport River and Bogue Sound. The Tide Lines property on Radio Island Rd. is 2.73 acres in its entirety and varies from 0' to 2.5' in elevation above NHW. The high ground portion of the site currently has a marina building and several boat maintenance buildings. In association with these buildings are paved and gravel parking lots and boat storage facilities. The marina currently provides fueling services. There are-two boat ramps and three travel lifts present.on the site. The shoreline is bulkheaded. Existing along the shoreline is a docking facility for 23 slips. Currently the docks extend 50-1-00' into open water and encompass 23,465 ft2 of Public Trust Area. The marina is connected to an on-site septic system. On the western side of the shoreline is a. marsh area that contains Smooth Cordgrass (Spartina alterniflora) and Salt Meadow Grass (Spartina patens). The substrate in this area is mostly silt and sand. Water depths in the docking area are approximately -3' NLW. The width of the water body ranges from 230ft to 410ft. The current impervious area of the track is 61.17% within the 75' AEC. The Division of Water Quality classifies this area as SA waters. This area is not a Primary Nursery Area and is closed to the taking of shellfish. Carteret County's Land Use Plan dated 1996 classifies this area as Developed and Conservation within the AFC's. There are no shellfish leases in this area. 10. Pro_lect Description: In an effort to redevelop.the property, Tide Lines proposes to construct 20 townhome units with all infrastructure. During this process the shoreline would be straitened, bulkheaded and the boat ramps would be filled.in. All existing structures will be demolished and fill will be brought to the site. Stormwater management facilities would be installed. The docking facilities at the site would be replaced and the number of slips would be increased from 23 to 28. The applicant also proposes to maintenance excavate 1204yd3 from around the marina facility. During the development process, the applicant will begin by installing 798' of bulkhead. The new bulkhead will be placed 5' waterward of the existing bulkhead except in, the area of the existing boat 'ramps and where coastal marsh exists.. In the area of the boat ramps the bulkhead will be placed approximately 62' waterward of NHW. The remaining bulkhead portion will be placed behind all coastal wetlands. Backfill in the area of the boat ramps will involve the filling of 3,850ft2(70X55) of open water of which 1,200 ft2 is over the existing concrete ramps.- Backfilling in other areas will fill 1,940ft2(388X5) of shallow bottom areas. Once the bulkhead is complete, the applicant proposes to maintenance excavate 1204yd3 within the embayment of the Morehead City channel. The excavation would occur in four sections. The dimensions would be 108X80X1.22(390yd3), 167X45X0.24(67yd3), 129X45X0.91(196yd3) and 232X45X1.43(553yd3) respectively. Current soundings in these areas range from -2.5' to -4' NLW. The final project depth would be the connecting depth of - 4'NLW. The excavated spoils would be placed 30' landward of NHW in a 271'X60' disposal area onsite. The spoils would be allowed to dry and then be used as upland fill material. After the applicant grades 2.65 acres of the site, they propose to construct 20 townhome units. These units will be broken up into four buildings. Each unit will have a private drive connecting to community roads and parking. The community parking area will provide 11 spaces. A Tide Lines Page 03 clubhouse and swimming pool will also be built for use of the residents between buildings A and B. The high ground portion of this development will be 47.81% impervious within the 75' AEC after construction is complete from a pre-project impervious area of 61.17%. Impervious area for the entire site would be 65,356ft2. Stormwater infiltration trenches will be installed to control stormwater runoff. One 43'X15' culvert will be placed under the road in order to improve drainage. A 6' wide boardwalk will extend the 675' length of the shoreline with 5' catwalks connecting to each waterfront unit and the pool area. There will be a total of 18 catwalks. The townhomes will be connected to Morehead City Sewer and water. In. order to provide docking for the town homes the applicant proposes to expand the existing marina by 25%, creating a total of 28 slips. This will be accomplished by. constructing•a 6' wide dock along the . shoreline for the length of the marina.' The dock would be expanded in 4 areas to 9.8' -wide in order to create platform sections. Three piers that are 85'X5', 40'X6', and 40'X6' would extend off of the dock. Extending off of the dock and platforms would'be 13 fingers. Nine of thQ.fingers would be 40'X4.5' and the remaining four would be 27'X3:5'. There would be 10 mooring piles placed between slips 1-20. - Boatlifts ihat are 13'X13' would be placed_twithin slips 21-28. There will be a sewage pump out facility placed at the end of the 85' pier. As a recommendation from National Marine Fisheries Service, a 230' rip rap sill will be placed 5' waterward of the marsh area. The rip rap sill will be 16' wide at the base.and have a 5' gap every 100'. The side slopes with have a ratio of 4:1. The height of the sill will not exceed 6" above NHW. The intent of this structure is to protect the remaining marsh in the project area. 11. Anticipated Impacts: The.proposed improvements at the Tide Lines project would result in 28,2702 of open water incorporated of which 4,563ft2 would be shaded by the marina. A total of 32,400ft2 would be excavated which would result in the removal of 1,205 yd3 of material. The excavated material would be placed on high ground disturbing 96,000 ft2 when graded into the site. While backfilling behind the bulkhead, 5,790ft2 of open water will be filled. An increase in turbidity will occur during this process. There should be no hazard to navigation resulting from this marina, as the overall waterward extent of the system will be 46' into the 400' waterbody. No coastal marsh would be filled or excavated during this project. The rip rap sill around the marsh should protect and/or enhance fish habitat and reduce wave energy into the marsh. The rip rap will fill 3,680ft' of shallow bottom habitat. Once the project is complete, the impervious area within 75' of NHW should decrease from 61.17% to 47.81% and the impervious area for the entire project would decrease from 72,847ft2 to 65,365ft2. The change of use at this property should provide an overall increase in water quality; however, an important public access area will be lost as many boaters use this ramp to launch their boats.
