Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: A delineation of surface waters and wetlands was completed prior to designing a site plan to avoid and minimize impacts to these resources to the maximum extent practicable. Weathers Creek bisects the subject project area from access to the site from Crosstie Lane making the proposed road crossing unavoidable. Alignment of this crossing has been designed to cross as close as 90 as possible. The proposed sanitary sewer crossing has been located at an existing crossing to minimize impacts to the stream channel. It is important to note that construction of Street (Road) D will stop prior to the stream located on the adjacent property. See the plan and profile (P- 11) for this section of road attached at the end of the PCN application. 1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques: The proposed culvert will be buried 12 inches below the stream bed to maintain aquatic life passage and has been designed to maintained the dimension, pattern and profile of the existing stream. A 4 x 3 -foot box culvert is proposed on each side of the stream culvert to accommodate high flows anticipated from Weathers Creek without widening the stream channel dimension at the crossing. Proper sedimentation and erosion control methods will be utilized during all phases of construction and installation as described in the Erosion Control Plan sheet reviewed and approved by the NC Division of Land Quality and Town of Troutman. All work will take place during dry conditions and can be facilitated from high, non -jurisdictional, stable ground. The contractor shall install silt fence, inlet protection, sediment traps, diversion ditches, tree protection, clearing only as necessary to install devices. All erosion and sediment control measures will be checked for stability and operation following every runoff producing rainfall, but in no case less than once every week. Any needed repairs will be made immediately to maintain all measures designed. An erosion control inspections report is required and will be kept by the owner's representative. Temporary seeding and permanent seeding plans are included to restore impacted areas. The project will meet all relative requirements of Best Management Practices and Engineered Stormwater Control Structures as outlined through State and Local Stormwater Rules. 2. On September 11, 2018, McAdams requested a species list from US Fish and Wildlife (USFWS) and potential occurrences information from the NC Natural Heritage Program (NC NHP) for the project area. USFWS identified the following protected species that may occur within the boundary of the proposed project and/or affected by the proposed project: northern long-eared bat (Myotis septentrionalis) — T and dart -flowered heartleaf (Hexastylis naniflora). NC NHP reported that there were no element occurrences of these species or other federally protected species on or within one mile of the project area. On September 11, 2018, Bryon Hamstead was contacted regarding the survey requirements for these species. Mr. Hamstead indicated that a survey for dwarf -flowered heartleaf would be necessary due to the potential presence of sutiable habitat along Weathers Creek in the area of the proposed greenvay. The project occurs in location where any incidental take of northern long-eared bat would be exempt under its 4(d) rule. On September 19, 2018, Jennifer Burdette with McAdams conducted a survey of the greenvay alignment and didn't find any of above species present. The standards outlined in article 3.6.24 of the Town of Troutman Unified Development Ordinance (UDO) states that no encroachments, including fill, new construction, substantial improvements and other developments shall be permitted unless: (1) it is demonstrated that the proposed encroachment would not result in any increase in the flood levels during the occurrence of the base flood, based on hydrologic and hydraulic analyses performed in accordance with standard engineering practice and presented to the Floodplain Administrator prior to issuance of floodplain development permit, or (2) A Conditional Letter of Map Revision (CLOMR) has been approved by FEMA. A Letter of Map Revision (LOMR) must also be obtained upon completion of the proposed encroachment.
