Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility 1) All material resulting from the removal of the existing pier shall be placed on an approved upland disposal site. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2009 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Frank Colonna and Elizabeth Wright Permit #126-06 Page 2 of 3 ADDITIONAL CONDITIONS 3) Unless specifically altered herein, this permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. 4) The authorized structures shall not exceed the established Wrightsville Beach pier-head line. 5) The docking facility shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor to the south. 6) In order to ensure compliance with conditions 4- and 5, an as-built-survey-shall be- performed on the docking facility showing the new docking facility, the location of the adjacent property owners riparian access corridor to the south, and the Wrightsville Beach pierhead line, within 60 days of completion of construction of the docking facility. NOTE: Failure to provide the survey referenced in condition No. 6 may result in a violation of this permit. 7) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 8) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee shall not be relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 9) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. l0) The permittee shall install and maintain at his expense-any- signal lights-or signals-prescribed by the U-.Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 11) This permit authorizes a maximum of four boat slips NOTE: The permittee is cautioned that this permit does not authorize the placement of tie piles in association with the docking facility. Furthermore, boats utilizing the docking facility will be subject to frequent wavewash from passing vessels. The issuance of this permit does not relieve the permittee from taking all proper steps to ensure the integrity of the structure and the safety of moored boats. The permittee shall not hold the State of North Carolina or the United States liable for any damage to the structure or moored boats. Frank Colonna and Elizabeth Wright Permit #126-06 Page 3 of 3 ADDITIONAL CONDITIONS General 12) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: The permittee and/or his contractor is urged to meet with a representative of the Division prior to project initiation. NOTE: The N.C. Division of Water Quality has assigned the proposed project DWQ Project No. 060733. NOTE: The U.S. Army Corps of Engineers authorized the proposed project under General Permit No. 197800056 (COE Action Id. PROJECT SUMMARY: The applicants propose to replace an existing shared docking facility with a new fixed pier, floating dock, floating finger docks and boatlifts into Banks Channel. . Frank Colonna and Elizabeth Wright Page 2 9. PROJECT DESCRIPTION: The project site is located at #106 and #108Water Street, adjacent to Banks Channel, between the Atlantic Ocean and Greenville Sound. The site is located within the Town of Wrightsville Beach, in New Hanover County. To locate the property, travel east from Military Cut-Off Road (U.S. Highway 17) approximately 1 mile towards Wrightsville Beach. From the drawbridge, continue heading east on Causeway Drive (U.S. Highway 76) approximately 1 mile and proceed to cross the bridge over Banks Channel. Take the immediate right onto Waynick Blvd. (U.S. Highway 76) and travel south approximately 1 mile until you come to South Lumina Ave. Take the immediate right onto South Lumina and travel approximately 0.1 mile and take a right onto Wright Street, which will terminate onto Water Street. Turn left onto Water Street and the properties of interest will be located on the right. The two lots measure approximately 0.24 acres with 50' of shoreline frontage each. The lots average approximately 3-6 feet above mean sea level and remain vacant. An existing bulkhead stabilizes the two properties. Highground vegetation consists of shrubbery and wild grasses. There are currently no coastal wetlands on these properties. Waterward of the mean high water (MHW) is an intertidal strip of sand, which is approximately 25 feet wide. The applicants currently maintain an existing shared docking facility between the two properties. An access pier measuring approximately 75' in length by 6' in width extends in a westerly direction, and turns 90 degrees to the south for an additional distance of approximately 25'. An access ramp leads to a main floating dock measuring 60' in length by 6' in width, which extends in a westerly direction into Banks Channel. Three (3) floating finger docks measuring 20' in length by 6' in width extend from the northern side of the main floating dock approximately 20' apart, which run parallel to the shoreline. The Wrightsville Beach Land Use Plan classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Developed. The waters of Banks Channel, which are included in the Wrightsville Recreational Area, are classified SB# by the Division of Water Quality. They are NOT designated as a Primary Nursery Area by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish PROPOSED PROJECT: The applicants propose to replace an existing shared private docking facility with a new fixed pier, floating dock, floating finger docks and boatlifts into Banks Channel. A new fixed pier would extend in a westerly direction from the existing alignment between the two properties measuring 78' in length by 6' in length. The pier would then turn 90 degrees to the south a distance of 38'. An access ramp would lead to a floating dock measuring 74' in length by 6' in width, which would extend into Banks Channel in a westerly direction. Two floating finger docks measuring 40' in length by 5' in width would extend from the northern side of the main floating dock approximately 28' apart, which would run parallel to the shoreline. Four boatlifts would be installed measuring 13' in length by 13' in width, two on each side of the floating finger docks. The application states the proposed structures would be constructed to provide docking space for up to four vessels. 10. ANTICIPATED IMPACTS: The proposed pier system construction would incorporate 200 sq. ft. of Estuarine Waters and Pubic Trust Area. Minor increases in turbidity should be expected during construction. The proposed pier and floating dock would extend approximately 160 feet into a waterbody which measures approximately 1,200 feet across, which would conform with the 1/4 width rule and the established pier lengths. As proposed, the applicant's proposal would not extend beyond the Town of Wrightsville Beach Pierhead Line.
