It is submitted on behalf of Bennett Village Apartments LLC for the construction of a multi -family residential development named Bennett Village Apartments, located off Piner Road in Wilmington, NC. Impacts to 0.094 acre of 404 wetlands and 0.0027 acre of jurisdictional ditches are needed for a building and for a stormwater pond, respectively. Enclosed are the PCN form, site maps, and site plan. LIVIG delineated the wetlands within the site and submitted a JD request package to your office in August. Please let me know when you would like to visit the site to review the line or if you have any other questions about the application. Thank you for your assistance with this project. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. The project engineer attempted to minimize wetland impacts within the site when developing the site plan. Buildings 1 and 3 as well as several parking spaces were shifted to reduce wetland impacts. However, one wetland pocket exists near the center of the site. Complete avoidance of these wetlands would make the site unbuildable, especially when considering the other site buffers and easements. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. Silt fencing will be used during construction to reduce sediment from eroding into jurisdictional areas. 2. Compensatory Mitigation for Impacts to Waters of the U.S. or Waters of the State 2a. Have you checked with the USFWS concerning Endangered Species Act ❑ Yes ® No impacts? ❑ Raleigh 5c. If yes, indicate the USFWS Field Office you have contacted. ❑ Asheville 5d. What data sources did you use to determine whether your site would impact Endangered Species or Designated Critical Habitat? The NC Natural Heritage Program GIS data was used to determine the known presence of federally-listed species. No federally listed species are known to occur on or near the site. The USFWS IPaC website was also reviewed. The site supports a canopy of young loblolly pine trees that appear to be too small to provide appropriate habitat for the red-cockaded woodpecker. The northern long-eared bat is known to occur within New Hanover County. The site is forested and provides appropriate summer and winter roost habitat for the species. Forested areas will be cut on site, which could affect roosting habitat of the bat. However, no roost trees are known to occur near the site and clearing would be an exempt activity under the 4(d) rule. No blasting or percussive activities are anticipated to occur during construction. 6. Essential Fish Habitat (Corps Requirement) 6a. Will this project occur in or near an area designated as essential fish habitat? ❑ Yes ® No 6b. What data sources did you use to determine whether your site would impact Essential Fish Habitat? The NOAA Fisheries Essential Fish Habitat Mapper GIS program was used to determine the presence of Essential Fish Habitat. No EFH has been designated near the project area. 7. Historic or Prehistoric Cultural Resources (Corps Requirement) 7a. Will this project occur in or near an area that the state, federal or tribal governments have designated as having historic or cultural preservation ❑ Yes ® No status (e.g., National Historic Trust designation or properties significant in North Carolina history and archaeology)? 7b. What data sources did you use to determine whether your site would impact historic or archeological resources? The NC State Historic Preservation Office HPOWEB GIS mapping resource was used to determine the presence of cultural or historic resources. No cultural or historical resources were noted within the site. One surveyed structure, Federal Point Pentacostal Church (NH3654), is located approximately 300 feet west of the site. This church is not listed as a National Historic property. B. Flood Zone Designation (Corps Requirement) 8a. Will this project occur in a FEMA-designated 100-year floodplain? ❑ Yes ® No 8b. If yes, explain how project meets FEMA requirements: 8c. What source(s) did you use to make the floodplain determination? The NC Floodplain Mapping Information System website was used to determine the boundaries of the 100-year floodpl in.
