(see attached overall map). We also request written concurrence from the North Carolina Division of Water Quality that the project complies with the 401 Water Quality Certifications associated with Nationwide Permit 14and the Neuse River Basin Buffer Rules. A Pre-construction Notification Application (PCN) is attached as well as an agent authorization form. The proposed project consists of impacts from the construction of an access road to serve a proposed residential development. The proposed project is located on the north side of Hilltop- Needmore Road (SR 1393), at the intersection of Hilltop-Needmore Rd. and Old Mills Rd. (SR 1421). The site is approximately 73 acres in size and consists primarily of pasture, and mixed pine/hardwood forests. Please refer to the attached USGS map (Figure 1) and Soil survey Map (Figure 2), which displays the location of the proposed project. S&EC performed a detailed wetland delineation and buffer evaluation on the property and on February 5, 2002 Mr. Steve Mitchell of the NC-DWQ made a buffer determination. A copy of T' Mr. Mitchell's buffer letter is attached. The applicant requested a detailed wetland delineation and buffer evaluation on the property prior to site plan development in order to avoid jurisdictional wetlands and waters and riparian buffers to the maximum extent practicable. The applicant plans to construct a road crossing over an unnamed tributary of Middle Creek (feature C) in order to access the entire site from the north and south, and the project engineer has located the crossing south of the perennial portion of the stream channel in order to minimize impacts. The proposed roadway will impact approximately 0.027 acres of jurisdictional wetland, 160 linear feet of intermittent channel, 10,251.89 square Charlotte Office: 236 LePhillip Court, Suite C Concord, NC 28025 Phone: (704) 720-9405 Fax: (704) 720-9406 Environmental Consultants, PA Road • Raleigh, North Carolina 27614 • Phone: (919) 846-5900 • Fax: (919) 846-9467 Greensboro Office: 3817-E Lawndale Drive Greensboro, NC 27455 Phone: (336) 540-8234 Fax: (336) 540-8235 Hickory Office: 622 Coon Mountain Lane Taylorsville, NC 28681 Phone ;(828) 635-5820 Fax: (828) 635-5820 feet of Zone 1 and 3,809.78 square feet of Zone 2 of the Neuse Buffer. These impacts are elaborated upon within the attached PCN form and are shown on the attached inset impact maps. The USACE's current policy requires applicants to avoid and minimize wetland and stream channel impacts to the maximum extent practicable and may require further compensatory mitigation to offset unavoidable losses of waters of the US when impacts exceed the requirements for notification (0.10 acre). The proposed road is needed to access the eastern and western portions of the property, and ties into Wiltree Drive (SR 4781). Because the applicant has minimized impacts by aligning the crossing to avoid the perennial portion of the channel to the north, and because the applicant must cross feature C in order to access high ground on the eastern and western portion of the property, S&EC believes further compensatory mitigation should not be required by the USACE. NC-DWQ's current policy does not require wetland or stream mitigation for perennial stream channel impacts below 1 acre and 150 linear feet per project. Because we are not proposing any permanent impacts to perennial channels, and only 0.027 acres of wetlands impacts are proposed, we believe neither wetland nor stream mitigation should be required by NC-DWQ. Please note that following construction the site will contain less than 15% impervious surface. According to the project engineer, following construction impervious surface will be less than 15%, therefore, we do not believe that this project requires a pre-approved stormwater management plan. NC-DWQ's current policy does not require riparian buffer mitigation for road crossings that impact less than 1/3 acre and 150 linear feet of buffer per crossing. Because the proposed impacts are below this threshold, S&EC believes buffer mitigation should not be required by DWQ. Please call if you require any additional information or have any questions. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. The USACE's current policy requires applicants to avoid and minimize wetland and stream channel impacts to the maximum extent practicable and may require further compensatory mitigation to offset unavoidable losses of waters of the US when impacts exceed the requirements for notification (0.10 acre >150ft). The proposed road is needed to provide access to the property from the existing Wiltree Drive (SR 4781) to the eastern portion of the property. Because the applicant has minimized impacts by aligning the crossing to avoid the perennial portion of the channel to the north and because the applicant has no choice but to construct the crossing to access the eastern portion of the property, S&EC believes further compensatory mitigation should not be required by the USACE. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of Page 5 of 8 aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.nc.us/ncwetlands/strmgide.html. 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. NA 2. Mitigation may also be made by payment into the North Carolina Wetlands Restoration Program (NCWRP). Please note it is the applicant's responsibility to contact the NCWRP at (919) 733-5208 to determine availability and to request written approval of mitigation prior to submittal of a PCN. For additional information regarding the application process for the NCWRP, check the NCWRP website at http://h2o.enr.state.nc.us/wry/index.htm. If use of the NCWRP is proposed, please check the appropriate box on page three and provide the following information: Amount of stream mitigation requested (linear feet): NA Amount of buffer mitigation requested (square feet): NA Amount of Riparian wetland mitigation requested (acres): NA Amount of Non-riparian wetland mitigation requested (acres): NA Amount of Coastal wetland mitigation requested (acres): NA IX. Environmental Documentation (required by DWQ) . Does the project involve an expenditure of public (federal/state) funds or the use of public (federal/state) land? Yes El No If yes, does the project require preparation of an environmental document pursuant to the requirements of the National or North Carolina Environmental Policy Act (NEPA/SEPA)? Note: If you are not sure whether a NEPA/SEPA document is required, call the SEPA coordinator at (919) 733-5083 to review current thresholds for environmental documentation. Yes ? No ? If yes, has the document review been finalized by the State Clearinghouse? If so, please attach a copy of the NEPA or SEPA final approval letter. Page 6 of 8 Yes ? No ? X. Proposed Impacts on Riparian and Watershed Buffers (required by DWQ) It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to required state and local buffers associated with the project. The applicant must also provide justification for these impacts in Section VII above. All proposed impacts must be listed herein, and must be clearly identifiable on the accompanying site plan. All buffers must be shown on a map, whether or not impacts are proposed to the buffers. Correspondence from the DWQ Regional Office may be included as appropriate. Photographs may also be included at the applicant's discretion. Will the project impact protected riparian buffers identified within 15A NCAC 2B .0233 (Meuse), 15A NCAC 2B .0259 (Tar-Pamlico), 15A NCAC 2B .0250 (Randleman Rules and Water Supply Buffer Requirements), or other (please identify )? Yes ® No ? If you answered "yes", provide the following information: Identify the square feet and acreage of impact to each zone of the riparian buffers. If buffer mitigation is required calculate the required amount of mitigation by applying the buffer multipliers. Zone* Impact (square feet) Multiplier Required Mitigation 1 8,783 3 NA 2 4,266 1.5 NA Total 8,049 NA Gone 1 extends out iu teet perpendicular trom near banK of cnannel; Gone z extends an additional 20 feet from the edge of Zone 1. If buffer mitigation is required, please discuss what type of mitigation is proposed (i.e., Donation of Property, Conservation Easement, Riparian Buffer Restoration / Enhancement, Preservation or Payment into the Riparian Buffer Restoration Fund). Please attach all appropriate information as identified within 15A NCAC 2B .0242 or .0260. NA - because the proposed riparian buffer impacts for the proposed crossing are less than 1/3 acre and 150 linear feet S&EC believes riparian buffer mitigation should not be required. XI. Stormwater (required by DWQ) Describe impervious acreage (both existing and proposed) versus total acreage on the site. Discuss stormwater controls proposed in order to protect surface waters and wetlands downstream from the property. Page 7 of 8 Because the percent impervious surface will be less than 15% following construction of the proposed project we do not believe apre-approved stormwater management plan should be required from DWQ XII. Sewage Disposal (required by DWQ) Clearly detail the ultimate treatment methods and disposition (non-discharge or discharge) of wastewater generated from the proposed project, or available capacity of the subject facility. Non-discharge - Individual septic systems XIII. Violations (required by DWQ) Is this site in violation of DWQ Wetland Rules (15A NCAC 2H .0500) or any Buffer Rules? Yes ? No Is this an after-the-fact permit application? Yes ? No XIV. Other Circumstances (Optional): It is the applicant's responsibility to submit the application sufficiently in advance of desired construction dates to allow processing time for these permits. However, an applicant may choose to list constraints associated with construction or sequencing that may impose limits on work schedules (e.g., draw-down schedules for lakes, dates associated with Endangered and Threatened Species, accessibility problems, or other issues outside of the applicant's control). Director Division of Water Quality February 20, 2003 Wayne Maudlin 1301 Broad Street Post Office Box 444 Fuquay Varina, N.C. 27826 Subject: Neuse River Basin Riparian Buffer Rules NBR 03-039 Clara Farms Subdivision Wake County Dear Mr. Maudlin: I have reviewed the information submitted for the project referenced by the Raleigh Regional Office as NBR 03-039. An evaluation of the stream features present on the property was performed on February 5, 2002 to determine whether or not the site would require compliance with the Neuse Buffer Rules. The features represented on the Wake County Soils and the Holly Springs USGS topographic maps were evaluated to determine their subjectivity to the Rule. It was determined that there are four streams represented on this property. The feature shown on the Soil map near cul de sac C is not subject to the Neuse River Basin: Nutrient Sensitive Waters Management Strategy; Protection and Maintenance of Existing Riparian Areas, Adminlstrativu Code 15A.2B.0233. The main stream feature begins off property near Hilltop Needmore Road and flanks the subdivision's eastern edge. The other feature to the west begins at two points off property and bisects the western portion of the tract. This letter addresses only those issues involving the riparian area. For information relative to other impacts, 401/404, or wetland issues, please contact Mr. John Dorney at 919-733-1786. Thank you for your attention to this matter and if this Office can be of any other assistance or if you have additional questions, please do not hesitate to contact me at 919-571-4700.
