This permit, issued on Angust 8, 2006 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Docking Facility
1) This permit authorizes only the docks, piers, and other structures and uses located in or over the water
that are expressly and specifically set forth in the permit application. No other structure, whether
floating or stationary, shall become a permanent part of this expanded docking facility without permit
modification. No non-water dependent uses of structures shall be conducted on, in or over public trust
waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
expanded docking facility. Any sewage discharge at the docking facility shall be considered a violation
of this permit for which the permittee is responsible. This prohibition shall be applied and enforced
throughout the entire existence of the permitted structure.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2009

ADDITIONAL CONDITIONS
3) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
4) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
5) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public

6) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
7) This permit authorizes a maximum of two (2) new boat slips, resulting in a total of three (3) slips on-
site, all as referenced in the attached workplan drawing dated 3/10/06.
NOTE: The permittee is cautioned that this permit does not authorize the placement of tie piles in
association with the docking facility. Furthermore, boats utilizing the docking facility will be
subject to frequent wavewash from passing vessels. The issuance of this permit does not relieve
the permittee from taking all proper steps to ensure the integrity of the structure and the safety of
moored boats. The permittee shall not hold the State of North Carolina or the United States
liable for any damage to the structure or moored boats.
General
8) The permittee understands and agrees that, if future operations by the United States requires the
--removal,-relocation, or-other alteration of-the structure- or-work.authorized-by this permit, or if, in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon
due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions
caused thereby, without expense to the United States or the state of North Carolina. No claim shall be
made against the United States or the state of North Carolina on account of any such removal or
alteration.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non-water
dependent activities are not authorized within 30 feet of the normal high water level.

9. PROJECT DESCRIPTION:
The project site is located at 16 Saltmeadow Road on Figure Eight Island, adjacent to Banks Channel and Middle
Sound, in New Hanover County. The island is accessed from the mainland at the end of Edgewater Club Road (SR
1402), by private bridge over the Atlantic Intracoastal Waterway (AIWW) and an earthen causeway, which
traverses Middle Sound. Heading east on the causeway, turn right on Beach Road South and travel south
approximately 1 mile. Turn right onto Saltmeadow Road and continue until you reach the property of interest,
which would be located on the right. The applicant maintains a two story single-family residence and a below
ground swimming pool, which border Banks Channel. Upland vegetation consists of ornamental shrubbery and
lawn grass. The lot is approximately 1/3 acre in size and averages 6 feet above mean sea level. The 100 feet of
shoreline frontage is stabilized by an existing wooden bulkhead. Waterward of the mean high water (MHW) is an
intertidal strip of sand, which is approximately 10 feet wide. Located on the southern end of the property, there is
an isolated area of coastal wetlands located just waterward of the intertidal strip of sand consisting primarily of
Smooth Cordgrass (Spartina alterniora). Waterward of the bulkhead is a private pier structure extending in Banks
Channel measuring (36' in length by 6' in width), which terminates to a "L-head" platform (12' in length by 12' in
width). An access ramp leads from the "L-head" platform into a floating dock (16' in length by 8'in width), which
runs in the same alignment as the fixed pier. There is an existing boatlift (12' in length by 12' in width) located on
the southern side of the floating dock.
The New Hanover County Land Use Plan classifies adjacent waters and high ground portion at the property as
Conservation. The waters of Banks Channel and Middle Sound are classified SA-ORW by the Division of Water
Quality. They are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they
are OPEN to the harvest of shellfish.
PROPOSED PROJECT:
The applicant proposes to construct a floating dock and floating jet dock at an existing pier system in Banks
Channel. A 20' in length by 6' in width floating dock would be placed on the northern side of the existing floating
dock. The proposed floating dock, once combined with the existing floating dock, would run parallel to the
shoreline and create an L-shape. A 9' in length by 6' in width jet dock would be installed within the proposed L-
shape configuration, landward of the proposed floating dock. The proposed structures would provide docking
space for up to three (3) vessels. Water depth in the area of the proposed structure would be approximately -4 feet
at mean low water (MLW).
10. ANTICIPATED IMPACTS:
The proposed floating dock and jet dock construction would incorporate 174 sq. ft. of Estuarine Waters and Pubic Trust
Area. Minor increases in turbidity should be expected during construction. The proposed floating dock would extend
approximately 75 feet into a waterbody, which measures approximately 600 feet across. This distance would conform
with both the 1/4 rule and the established pier lengths.

only high quality copies will be accepted. 'Blue-line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the

• A Stormwater Certification, if one is necessary.
• A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners and
