Mulch or pine needles (6" deep) shall be used to help reestablish the buffer upon completion of the project. 3. All stormwater shall be directed as diffuse flow at non-erosive velocities through the protected lake buffers and will not re-concentrate before discharging into the lake as identified within 15A NCAC 2B.0243(5). 4. Upon completion of all work approved by this 401 Water Quality Certification, and any subsequent approved modifications, the applicant is required to return the attached certificate of completion form to the 401 Oversight/Express Review Permitting Unit, North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650. Mourne, NC 28123 Subject: Notice of Violation and Notice of Recommendation For Enforcement Incident #200601636 NOV-2006-CV-0007 NCAC 02B.0243(4) and 21-1.0500 Lakeway Estates S/D, Lot #7 Iredell County, NC Dear Mr. Wynn: On May 31, 2006, Mr. Barry Love of this office conducted an investigation at the subject construction site located at 184 Roundstone Road in Iredell County. Based on the investigator's observations, this letter is being issued as a Notice of Violation and Notice of Recommendation For Enforcement for violations of 15A North Carolina Administrative Code (NCAC) 02B .0243 (4) (pursuant to NCGS 143-214.1) and NCAC 2H.0500. During the investigation Mr. Love observed that Zone 1 of the Catawba River Buffer had been mostly cleared of trees while areas adjacent to the lot had dense forest growth. The Catawba River Buffer Rule requires that Zone 1 of the buffer shall consist of forested area that is undisturbed. More specifically the soils must remain undisturbed and no trees larger than 3 inches may be removed. The investigation also revealed that the shoreline stabilization project had already been carried out. Although an application for a 401 certification had been submitted, the stabilization is not approved until you have received the Certification. This is a violation of NCAC 2H .0500 for failure to obtain a 401 Water Quality Certification. If you have an explanation for the noted violations that you wish to present, please respond in writing within fifteen (15) days following the receipt of this notice. Your explanation will be reviewed and if an enforcement action is still deemed appropriate, your explanation will be forwarded to the Director of the Division of Water Quality with an enforcement recommendation for his consideration. Please note that these violations and any future violations are subject to civil penalty assessments of up to $25,000.00 per day for each violation. The following information is requested: • Please explain why the stabilization project was carried out before the appropriate 401 Water Quality Certification had been secured. • Please provide your plans for restoring the buffer. In Zone 1, three-inch (3") caliber (minimum), eight (8) foot tall (minimum) native species trees must be planted at a rate of 320 trees/acre, with measures taken to insure their survival to the next growing season. The buffer restoration should be completed by July 8, 2006. Please note that pursuant to 15A NCAC 2H.0507(h) your 401 Application will be placed on hold until the above measures have been completed.
