The wetland impacts proposed are for the purpose of constructing a single-family residence in the Dolphin Ridge subdivision. You are authorized to fill 0.01 acres of Section 404/401 Wetlands under General Water Quality Certification (WQC) # 3402 (enclosed). The U.S.A.C.O.E. has flagged the wetlands in question. Prestige Land Surveying, P.A. has surveyed and mapped the wetlands and the U.S.A.C.O.E. has signed off on the survey as enclosed in package he U.S.A.C.O.E. has advised that this action should be covered under the nationwid4 permitting process. These wetlands were originally surveyed and approved by the U.S.A.C.O.E. in May 15,1990 and again in September 5, 1991. This wetland survey has expired so the wetlands on this lot were reflagged and surveyed on October 4, 2005. This plan is to fill a small portion of the wetlands that exist on Lot 18, Dolphin Ridge subdivision. The fill is necessary due to the limited building area that exist as a result of the odd shape of this lot along with the Town of Emerald Isle minimum building setback lines as shown on the enclosed plat. Also the Septic area takes up a good portion of the lot. The plan is to install a retaining wall of wood or masonry construction and then back fill the 420.0 square feet of wetlands that is requested. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. updated 11/112.005 Page 9 of 12 USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide; Permits, published in the Federal Register on January 15, 2002, mitigation will be required wllell necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include;, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. It is in areas of dredge spoil deposited on islands, marshes, and low marine terraces mainly along Bogue Sound and the Intracoastal Waterway during construction and maintenance of channels. Mapped areas are irregular in shape and range from 5 to 300 acres. Typically, the soil is layers of light brownish gray fine sand and light gray fine sand and sand to a depth of 80 inches.
