After reviewing your application, we have determined that the Division of Water Quality (DWQ) General Water Quality Certification Number 3400 covers these water impacts. This Certification allows you to General Permit No. 198000291 when issued by the US Army Corps of Engineers (USACE). In addition, you should get or otherwise comply with any other federal, state and local requirements before you go ahead with your project including (but not limited to) erosion and sediment control regulations and CAMA. Also, this approval to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon expiration of the 404 or CAMA Permit. This approval is for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h). PROJECT SUMMARY: The applicant proposes to excavate the tip of a peninsula to widen a basin entrance to Pasquotank River and construct a 4,486-foot long vinyl bulkhead immediately east of an existing 1,185-foot long vinyl bulkhead (LAMA Major Permit #93-06) along the shoreline of a manmade canal to Pasquotank River and along the Pasquotank River shoreline on his property located on an existing farm field east of existing Grandview Estates Subdivision (Phase II) off River Road, Elizabeth City Community, Pasquotank County. This portion of subdivision has been named River Glen II and is a major modification to CAMA Major Permit #93-06 for Grandview Estates Phase II. PROJECT SETTING The location of the proposed River Glen Phase II development site is within a 126-acre tract of farmland that is being converted to a 155-lot residential subdivision with no common access area at this time, located off River Road (SR 1169) in the River Glen Subdivision east of Grandview Estates Subdivision (see sheet 1 of 5), Elizabeth City community of Pasquotank County. Individual lots vary in size from 15,000 square feet to 25,000 square feet. The development site is located on the northern shoreline of a manmade canal to Pasquotank River and extends along 840 feet of Pasquotank River shoreline near to and south of Cobb Point and north of the U.S. Coast Guard Air Station. The entire canal is approximately 5,000-foot long running from west to east, then turns to the north where it opens into an approximate 500-foot long by 400-foot wide basin with a 34-foot wide opening to Pasquotank River. The majority of the canal running from west to east is between 150-feet to 200-feet wide. The property is mostly flat with an approximate 9-foot elevation, and the field proposed as River Glen Phase II Subdivision is currently planted soybeans. There are two bulkhead sections on the property. An 840-foot wood bulkhead exists at the mouth of the manmade basin along Pasquotank River and extends to the property line to the north. Another 50-foot section of bulkhead exists around the elbow of the canal where it makes a sharp turn to the west. The tract consists of Roanoke soil type. The canal shoreline on the property consists of low banks (0-5 feet) with no presence of 404 or coastal wetlands adjacent to the proposed bulkhead. The west bank of the basin has a 404 wetland fringe shoreline delineated by Atlantic Environmental Consultants, LLC, and confirmed by a U.S. Army Corps of Engineers representative on April 6, 2006. The proposed bulkhead will terminate at the south end of the wetland fringe where the canal makes an elbow turn to the north into the basin. There is a thin line of native trees, predominantly wax myrtle, red bay, sweet gum, and red maple near to and along the bank. The bank also has a line of cypress trees that were planted along the water's edge. The property on River Glen Phase II has an irregular shoreline that is approximately 3,576 linear feet. The water depths in the canal range from -4 feet in the western portion of the canal and gradually deepen to -7 feet as it approaches Pasquotank River. The water depths adjacent to Phase II of the project are -4 feet to -5 feet in the middle of the canal. The adjacent property to the west is Grandview Estates Phase II (an authorized 52-lot subdivision), then Grandview Estates Phase I (a 38-lot developed subdivision). The riparian property adjacent to the mouth of the manmade basin to Pasquotank River are two a single-family residence lots, then Breezewood Subdivision to the north. River Glen Phase I (96-lots) is located north of River Glen Phase II, but is not adjacent to the water. The canal borders the property to the south and Pelican Pointe Subdivision (213 lots) lies south of the canal. 2 ` 3-N-1, Inc., c/o Phillip Harrington, River Glen Phase II (MP#93-06MM) Field Investigation Report r Page 3 Division of Water Quality Stormwater Permit and Division of Land Resources, Land Quality Section, Sedimentation and Erosion Control Plan for River Glen Phase II are currently being applied for. There were no observed presence of submerged aquatic vegetation or shellfish in the vicinity of the canal or Pasquotank Riaver shoreline on August 16, 2006. Reviews of available information suggest that there are no known archeological sites or geologic formations associated with the applicant's property. The waters of Pasquotank River in this area are classified as SC by the Division of Environmental Management and are closed to shellfish harvesting. DEVELOPMENT PROPOSAL In order to prevent further erosion, the applicant proposes to construct a 3,646-foot long vinyl bulkhead that will tie into an existing bulkhead to the west and terminate with a 20-foot wing wall after replacing the 50-foot section of bulkhead at the elbow of the canal adjacent to 404 wetlands. Another 840-feet of vinyl bulkhead will replace the existing wood bulkhead along Pasquotank River and wrap around a proposed excavated area at the mouth of the basin. The total linear feet of bulkhead for the entire project will be 4,486-feet. The proposed bulkhead alignment will have a maximum distance of 5-feet and an average distance of 2-feet waterward of normal water level (NWL). The bulkhead replacement sections, will have a maximum distance of 2-feet waterward of the existing bulkhead. Clean, dry fill will be used for backfill from excavation of storm water retention ponds and onsite grading. The only excavation proposed is 28-foot long by 54-foot wide tip of high ground to a depth of -6.5-feet below NWL off the tip of the peninsula where the mouth of the basin meets, Pasquotank River. The applicant proposes to excavate the tip off the peninsula to widen the only entrance/exit to the canal system, which is currently 34-foot wide. A wider opening will provide safer conditions for increased number of boaters that will be utilizing the canal. The spoil from the excavation will be temporarily placed at least 30-feet landward of normal water level, on high ground, and surrounded by silt fence, until it is dry. The spoil will then be placed behind the bulkhead as fill after it has dried (see Sheet 3). The erosion rate of the manmade canal adjacent to River Glen Phase II is less than 0.5 feet/year. The adjoining shoreline to the west makes a sharp turn to the north and has a natural 404 wetland fringe with no shoreline stabilization. The applicant proposes to remove trees along the shoreline that interfere with the installation of the bulkhead and will be grading and seeding the entire shoreline in the Estuarine Shoreline Area of Environmental Concern (AEC). In order to properly handle storm water, the applicant proposes to construct four separate detention ponds outside the Estuarine Shoreline AEC. The nearest pond to the canal is approximately 300-feet landward and north of the canal and is 2.31 acres in size. North of that pond is another 3.02-acre detention pond, and the other two ponds are in the upper northwest corner of the subdivision and are 1.45 acres and 0.92 acres in size. Impervious road surface will cover 5.9 acres of area in River Glen Phase II, all of which is outside the Estuarine Shoreline AEC. A series of impervious roads (256,148 square ft.) and associated swales will be constructed within the subdivision outside the Estuarine Shoreline AEC. Sediment cloth will be installed landward of the bulkhead to prevent sediment from entering the canal when backfill is brought in behind the bulkhead. A sediment curtain will also be installed immediately landward of the bulkhead and held in place until vegetation has been established. 3-N-1, Inc., c/o Phillip Harrington, River Glen Phase II (MP##93-06MM) Field Investigation Report Page 4 ANTICIPATED IMPACTS The proposed bulkhead alignment with backfill will result in the filling of approximately 8,972 square feet of Public Trust Area (PTA), Estuarine Waters (EW) Area of Environmental Concern (AEC). Approximately 595 cubic yards of fill material will be placed below NWL for the bulkhead backfill. Land disturbance for installation of the bulkhead tiebacks and grading in the Estuarine Shoreline AEC will occur over approximately 235,202 square feet of uplands. A total of 392 cubic yards will be excavated from the peninsula tip located at the opening of the basin and Pasquotank River. This area will be 1,237 square feet in size, and 300 cubic yards will be excavated below NWL to a depth of -6.5-feet. Connecting depth adjacent to proposed excavation area is -7-feet, and the excavation will widen the basin opening to Pasquotank River from 34-feet to 62-feet. Excavation for the four storm water basins outside the ES AEC will be approximately 245,092 square feet. Excavated material from the storm water basins and grading of berms in the Estuarine Shoreline AEC will be used for bulkhead backfill. Impervious road surfaces over an area of 256,148 square feet will be installed outside the Estuarine Shoreline AEC. Temporary water turbidity will occur during construction. Phillip Harrington for improvements to his property River Glen II, a single-family residential subdivision located on a manmade canal, which adjoins the Pasquotank River, in Elizabeth City, Pasquotank County, North Carolina. The proposed improvements includes bulkhead construction 4,486 linear feet at the normal water level (NWL) along a manmade canal. The proposed bulkhead is a continuation of the bulkhead in the Grandview Estates (Permit #93-06) subdivision directly to the south of the subject property. The upland area on the west side of the entrance to the existing manmade basin will be widened in order to accommodate the increase in boat traffic associated with development along the existing canal. An excavator will be used to remove 300 cubic yards below the normal water line and the spoil material will be placed inside a silt fence barrier and dewatered prior to being graded landward of the proposed bulkhead replacement. The proposed excavation within the canal will require a turbidity curtain around the excavation area if the work will be done between February 15 and October31. In addition, a 155 Lot subdivision is proposed for subject property River Glen II. The proposed land disturbance includes the use of an excavator and bulldozers to properly grade the site as designed in the stormwater plan designed and submitted by Hyman & Robey PC. There are no wetland impacts proposed for this project. There are no 404 or coastal wetlands within the area of the proposed project.
