Shoreline Stabilization
1) • The alignment of the permitted bulkhead ° hall be staked by a permittee and approved by a representative
of the Division of Coastal Management within a maximum of 30 days prior to the start of any
• construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse
weather conditions, will require the alignment to be restaked by DCM within a maximum of 30 days
prior to the new expected start of construction.
2) The bulkhead shall be constructed an average of 2 feet, and a maximum of 5 feet, from the Normal
Water Level.
3) The bulkhead shall be constructed prior to, any backfilling activities.

ADDITIONAL CONDITIONS
4) A silt fence shall be properly installed immediately landward of the bulkhead cap immediately following
completion of backfilling activities, and shall remain until the disturbed areas are vegetated and
stabilized:
S) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the
structure.
6) The bulkhead shall be solid `and constructed of treated wood, concrete slabs, metal sheet piles or other
suitable materials. approved by department personnel. No excavation is permitted except for that which
may be required for the construction of the bulkhead wall; riprap, deadmen cables, etc. This permit does
not authorize any excavation waterward of the approved alignment.
7) No backfill material shall be placed within 30 feet of the normal high water line, except that which will
be used to backfill the area behind the permitted bulkhead.'-
8) All fill material to be placed below normal water level will be confined behind the permitted bulkhead.
9) All backfill material shall be obtained from a high ground source and confined behind the permitted
bulkhead.
10) - The fill material shall be clean and free of any pollutants except in trace, quantities.
11) The riprap material used for the check dams shall consist of clean rock or masonry materials such as but
not limited to granite or broken concrete.
Upland Development
12) Unless specifically altered herein, this permit authorizes only the land disturbing activities associated
with the development of the Grandview Estates Phase II Subdivision, including the construction of the
associated asphalt roads, all as expressly and specifically set forth in the permit application dated
2/20/06 (MP-1) and 3/1/06 (MP-2 & MP-3), and depicted on the attached workplan drawings dated
revised 3/21/06. Any additional land disturbing activities and/or construction within an Area of
Environmental Concern shall require a modification of this permit. The applicant shall contact the
Division of Coastal Management at (252) 264-3901 for any modification request.
Sedimentation and Erosion Control
NOTE: An Erosion and Sedimentation Control Plan will be required for this project. This plan must be
filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this
plan to the Department of Environment and Natural Resources, Land Quality Section, 943
Washington Square Mall, Washington, NC 27889.
13) Appropriate sedimentation and erosion control devices, measures or structures must be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, etc.).

Stormwater Management
14) The N.C. Division of Water Quality approved this project under stormwater management rules of the
Environmental Management Commission under Stormwater Permit No. SW7051030 on 12/7/05. Any
violation of the permit approved by the DWQ will be considered a violation of this CAMA permit.
General

Approval of 401 Water Quality Certification (GC3400) with Additional Conditions
Dear Mr. Harrington:
You have our approval, in accordance with the attached conditions, to fill or otherwise impact 0.0544
acres of Public Trust Area (PTA) estuarine waters, to construct a bulkhead and overflow ditch to rock
weir outfall as described in your application dated March 1, 2005, and received by the Division of Water
Quality (DWQ) 401 Oversight/Express Review Permitting Unit on March 31, 2006. After reviewing
your application, we have determined that the Division of Water Quality (DWQ) General Water Quality
Certification Number 3400 covers these water impacts. This Certification allows you to General Permit
No. 198000291 when issued by the US Army Corps of Engineers (USACE). In addition, you should get
or otherwise comply with any other federal, state and local requirements before you go ahead with your
project including (but not limited to) erosion and sediment control regulations and CAMA. Also, this
approval to proceed with your proposed impacts or to conduct impacts to waters as depicted in
your application shall expire upon expiration of the 404 or CAMA Permit.
This approval is for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application. If the property is sold,
the new owner must be given a copy of this Certification and approval letter and is thereby responsible for
complying with all conditions. If total fills for this project (now or in the future) exceed one acre of
wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A
NCAC 2H .0506 (h). This approval requires you to follow the conditions listed in the attached
certification and any additional conditions listed below.

2. Certificate of Completion

Buffer Rules, and any subsequent modifications, the applicant is required to return the attached
certificate of completion to the 401 Oversight/Express Review Permitting Unit, North Carolina

3. Water Quality Certification
The proposed project must comply with all of the conditions of General Water Quality
Certification (GC) 3400.
Violations of any condition herein set forth may result in revocation of this Certification and may result in
criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct
impacts to waters as depicted in your application and as authorized by this Certification, shall expire upon
expiration of the 404 or CAMA Permit.
If you do not accept any of the conditions of this Certification (associated with the approved water
impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the date that you
receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the

Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a
hearing.

8. PROJECT SUMMARY:
The applicant proposes to construct a 1,185-ft. long vinyl bulkhead and a storm water basin with a
1,020-ft. long by 10-ft. wide overflow ditch to a rock weir outfall over the proposed bulkhead into a
manmade canal to Pasquotank River on his property located on an existing farm field east of existing
Grandview Estates Subdivision (Phase I) off River Road, Elizabeth City Community, Pasquotank
County.
PROJECT SETTING
The location of the proposed Phase II development site is within a 26.48-acre tract of farmland that is
being converted to a 53-lot residential subdivision with no common access area, located off River Road
(SR 1169) in the Grandview Estates Subdivision, Elizabeth City community of Pasquotank County.
Individual lots vary in size from 15,000 square ft. to 24,330 square ft. The development site is located
on the northern shoreline of a manmade canal to Pasquotank River near to and south of Cobb Point and
north of the U.S. Coast Guard Air Station. The canal is 30-ft. wide at its narrowest point and 130-ft
wide at its widest point in the Phase II portion of the project. The width of the canal at the proposed
ditch outfall is approximately 110-ft. The entire canal is approximately 4,100-ft. long running in a
northeasterly direction, then turns to the north where it opens into an approximate 500=ft. long.by 400-ft.
wide basin with an approximate 20-ft. wide opening to Pasquotank River.
The property is mostly flat with an approximate 9-ft. elevation, and the field is currently vegetated with
indigenous weeds and field grasses that was historically planted in corn and soybeans. There are
currently no manmade features on the Phase II tract and it consists of Roanoke soil type. The canal
shoreline on the property consists of low banks (0-5 feet) with no presence of 404 or coastal wetlands and
has a thin line of native trees, predominantly wax myrtle, red bay, sweet gum, and red maple along the
bank. The property on Phase II has an irregular shoreline that is approximately 1,185 linear feet. The
water depths in the canal range from 4-ft. in the western portion of the canal and gradually deepen to 7-ft.
as it approaches Pasquotank River. The water depths adjacent to Phase II of the project are 4-5-ft in the
middle of the canal.
The adjacent property to the west is Grandview Estates, Phase 1, a 38-lot developed subdivision, to the
north are River Road Middle School grounds, and to the east is undeveloped farmland of similar type.
The manmade canal borders the property to the south and Pelican Pointe Subdivision lies south of the
canal.
Division of Water Quality Storm Water Permit No. SW7051030 was issued on December 7, 2005 for
grassed swales and a wet detention pond to serve Grandview Estates Phase II. Division of Land
Resources, Land Quality Section, Erosion Control Plan No. Pasqu-2006-009 was issued on November
16, 2005 for Grandview Estates Phase II. There was no observed presence of submerged aquatic
vegetation or shellfish in the vicinity of the canal on March 14, 2006. Reviews of available information
suggest that there are no known archeological sites or geologic formations associated with the applicant's
property. The waters of Pasquotank River in this area are classified as SC by the Division of
Environmental Management and are closed to shellfish harvesting.

DEVELOPMENT PROPOSAL
In order to prevent further erosion, the applicant proposes to construct a 1,185-ft. long vinyl bulkhead
with two 20-ft. wing walls into uplands on each end of the bulkhead. The proposed bulkhead alignment
will have a maximum distance of 5 ft. from the shoreline and an average distance of 2 ft. Clean, dry fill
will be used for backfill from the proposed basin and ditch excavation areas. No excavation will be
required for installation of the bulkhead. The erosion rate of the mamnade canal adjacent to Phase II is
approximately 0.5 ft./year and the adjoining shorelines are natural with no shoreline stabilization.
In order to properly handle the stormwater, the applicant proposes to construct a 36,395 sq. ft. basin,
6-ft. in depth, located approximately 400 feet landward of the proposed bulkhead. The stormwater basin
will overflow to the proposed 10-ft. wide drainage ditch, which runs in a southerly direction to the canal.
The stormwater will then pass through a check dam, located approximately 180-ft. landward of the
proposed bulkhead, in order to catch any debris. The stormwater will encounter a rock weir immediately
landward of the proposed bulkhead, prior to flowing into the canal. The proposed bulkhead section
adjacent to the rock weir will be approximately 1-ft. higher than normal water level in elevation and
10-ft. wide. The rock weir will consist of Class B stone set at a 2:1 slope. Sediment cloth will be used
landward of the rock weir until the ditch has established vegetation sufficient enough to prevent sediment
from entering the canal.
ANTICIPATED IMPACTS
The proposed bulkhead alignment with backfill will result in the filling of approximately 2,370 sq. ft.
of Public Trust Area (PTA), Estuarine Waters (EW) Area of Environmental Concern (AEC).
Approximately 265 cubic yards of fill material will be placed below NWL for the backfill. Land
disturbance for installation of the bulkhead tiebacks will occur over approximately 11,850 sq. ft. on
upland Estuarine Shoreline (ES) AEC.
Excavation for the stormwater basin and outflow ditch outside the ES AEC will be approximately
45,845 sq. ft. Excavation of the stormwater ditch within the ES AEC will be approximately 750 sq. ft.
Approximately 70 sq. ft. of riprap will be placed in the ditch in the excavation area within the ES AEC
immediately landward of the proposed bulkhead to form a rock weir. Excavated material from the
stormwater basin and ditch will be used for bulkhead backfill, and the remaining soil will be spread on
approximately 30,750 square feet of upland lots west of the proposed ditch, outside the 30-ft. buffer.
Temporary water turbidity will occur during construction. The use of a filter cloth behind the
bulkhead will minimize future erosion and turbidity.

Grandview Estates Phase II _
CAMA Major Permit - 3-N-1, Inc. - Phillip Harrington
Elizabeth City, North Carolina, Pasquotank County
The proposed improvements are requested by 3-N-1, Inc. Phillip Harrington for
improvements to his property Grandview Estates a single-family residential subdivision
located on a manmade canal, which adjoins the Pasquotank River, in Elizabeth City,
Pasquotank County, North Carolina.
The proposed improvements include the construction of 1,185 linear feet of bulkhead at
the normal water level (NWL) along the manmade canal of Grandview Estates Phase ll.
In addition, an overflow ditch is proposed for construction, which will allow the permitted
existing retention basin to properly drain to the proposed ditch, which will enter the
adjacent canal. The stormwater basin will overflow to the proposed drainage ditch and
pass through a check dam, which will catch any additional debris that may pass through
the treatment stormwater basin, after which stormwater will be directed to a two (2) foot
diameter culvert at the end of the drainage ditch, which will pass through the proposed
bulkhead along the shoreline.
The proposed drainage ditch and land disturbing activities have been approved by the
Division of Water Quality and The Division of Land Resources with the condition that a
