This permit, issued on .Tune 26, 2006 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility 1) Unless specifically altered herein, this permit authorizes only the 5 ft.'x 400 ft.-pier, the 5 ft. x 65 ft. T- head, the four 3 ft. x 30 ft. finger piers, and the 21 mooring pilings, all as expressly and specifically set forth in the permit application and attached workplan drawings. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non- water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit shall be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work shall cease when the permit expires on December 31, 2009 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Stanley Friedman Permit # 84-06 Page 2 of 3 ADDITIONAL CONDITIONS NOTE: Should either adjacent property be sold prior to the initiation of construction, the permittee shall be required to obtain a signed shoreline dedication and riparian corridor waiver forms from the new property owner prior to the placement of any structures within the 15-foot riparian corridor. 3) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 4) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The -permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 5) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury that may be caused from existing or future operations undertaken by the United States in the public interest. 6) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 7) This permit authorizes a maximum of ten boat slips General 8) In order to be consistent with 15A NCAC 07H.0208(b)(6)(D) of the Rules of the Coastal Resources Commission, which require that the combined area of all "T's", finger piers, platforms, and decks not exceed a combined total area of four square feet per linear foot of shoreline, the permittee has proposed to dedicate the shorelines of the Knight and Hill properties towards this requirement. In order to ensure consistency with the requirement, deed restriction shall be placed on these two lots dedicating the entire shoreline of these lots to the proposed community access facility. The deed restriction shall further state that no T's, Finger piers, platforms, or decks shall be allowed off of these lots in the future as long as the permitted access facility is in place. These deed restrictions shall be recorded with the Beaufort County Register of Deeds, and copies of the recorded deeds provided to the Division of Coastal Management, prior to the initiation of construction of the access facility. 9) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 10) No vegetated wetlands shall be excavated or filled, even temporarily. Director Division of Water Quality DWQ Project # 06-0538 Beaufort County Approval of 401 Water Quality Certification (GC3400) with Additional Conditions Dear Mr. Friedman: You have our approval, in accordance with the attached conditions, to shade 0.0541 acres of non- vegetated wetlands (river bottom) to construct a community pier with 10 slips on the Pamlico River on the common lot of Pamlico Bluffs Estates Subdivision as described in your application dated October 26, 2005, and received by the Division of Water Quality (DWQ) 401 Oversight/Express Review Permitting Unit on March 29, 2006. After reviewing your application, we have determined that the Division of Water Quality (DWQ) General Water Quality Certification Number 3400 covers these water impacts. This Certification allows you to General Permit No. 198000291 when issued by the US Army Corps of Engineers (USACE). In addition, you should get or otherwise comply with any other federal, state and local requirements before you go ahead with your project including (but not limited to) erosion and sediment control regulations and LAMA. Also, this approval to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon expiration of the 404 or CAMA Permit. This approval is for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). Water Quality Certification The proposed project must comply with all of the conditions of General Water Quality Certification (GC) 3400. Violations of any condition herein set forth may result in revocation of this Certification and may result in criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application and as authorized by this Certification, shall expire upon expiration of the 404 or CAMA Permit. You must act within 60 days of the date that you receive this letter. PROJECT SUMMARY: Applicant proposes to build a community pier with 10 slips on the Pamlico River on the common lot of Pamlico Bluffs Estates Subdivision. Pamlico Bluffs Estates Stan Friedman Beaufort County, NC Project Setting The project area is located off SR1119 on the Pamlico River near the Town of Chocowinity in Beaufort County, North Carolina. Pamlico Bluffs is a residential housing subdivision consisting of 21 lots with 5 lots remaining to be sold. The project site is a± 0.73-acre lot that has been set out as a common lot. The majority of the ±62 acres has been cleared and grubbed but is starting to return to a more natural vegetative state. The access road is paved and terminates with a paved parking area on the common lot. The area adjacent the river is ±75' wide and is a sandy beach vegetated with pines and cypress many of which are down due to previous storms. A ±30' bluff exists landward of the beach. The upper portion of the bluff is vegetated with mixed hardwoods and grasses. Seasonal conditions limit the evaluation of submerged aquatic vegetation on the project site at this time. However, historical knowledge provided by staff indicates that significant beds of Valisenaria sp. are present at the project site during the growing season. The project site is bordered on the cast and west sides by undeveloped lots vegetated similarly to the common lot. The project site is ±2' to 3' above the normal water level. The Pamlico River has been classified as SB-NSW by the Environmental Management Commission along the project site. The Pamlico River at this location is not open to shellfishing. Project Description The applicant proposes to construct a 10 slip docking facility on the Pamlico River for community use by the subdivision residents. A ±5' X ±400' long pier with a ±5' X ±65' T-Head is proposed. The pier is proposed to be ±3' above the NWL. Four (4) ±3' X ±30' finger piers and 25 mooring pilings will create the 10 slips. The slips will measure ±40' long and ±15' wide. The pier will be accessed from the top of the bluff by the existing wooden staircase. Anticipated Impacts The construction of the pier and docking facility will result in the shading of ±2,360 ftz of river bottom that is vegetated with SAVs. The docking facility will result in a foot print of ±7,990 ft2 excluding the pier and T-Head. The project as proposed will result in localized turbidity as a result of the construction activities. Seven (7) lots, which were sold are on the waterfront. Five (5) interior lots have been sold. The rest of the property involving eight (8) lots are still owned by Stanley & Alma L. Friedman. Five of which ,will be kept for personal use involving a horse barn and pasture. There are easement rights to all Pamlico Bluff lot owners dedicated, in order to give access to the water and future boast slips. At the present time, the property and easement rights have not been turned over a neighborhood association, however, once incorporated, there will be a group of owners who will head up the association. The total length of the pier will be 400 feet with ten (10) boat slips. The tee head will measure 5 ft. x 65 ft. There will be four (4) finger piers, 30 ft. in length with an extension single piling totaling 40 feet in length. Each slip will be 15 feet wide, with electric and water supplied to each slip. Your receipt of this letter verifies your acceptance of a valid request for certification in accordance with Section 325.2(b)(ii) of our administrative regulations. - We are considering authorizing the proposed activity pursuant to Section 404 of the Clean Water Act, and we have detennined that a water quality certification is required under the provisions of Section 401 of the same law. A Department of the Army permit will not be granted until the certification has been obtained or waived.
