SHPO No. LR 17-1757; Tip Project U-5536. Reference your correspondence dated October l, 2018 in which you req�lested comments for the referenced project. Prelimii�ary analysis of tl�e project reveals tl�e potential for multiple impacts to streams and jw-isdictional wetlauds in the project area. If mitigation is necessary as required by 15A NCAC 2H.0506(h), it is preferable to present a conceptual (if not finalized) mitigation plan wifli the environmental documentation. Appropriate mitigation plans will be required prior to issuance oFa 401 Water Quality Certificatioi7. Enviroml�ental impact statement alternatives shall consider design criteria that reduce the impacts to streams and wetlands fi-oiT� storm water runoff. These alternatives shall include road designs that allow for treatment of the storm water runoff through BMPs as detailed in the most recent version of the North Cnrolina Depar•tnze���t of Trar�sportatior� Storn�iwuter• Best Matiager�zent Practices Tool box manual, such as �-assed swales, buffer at-eas, prefor-med scour holes, retention basins, etc. ln accordance witl� fl1e Envu•onmental Management Comnussion's Rules (15A NCAC 2H.0506[l�]), mitigation will be required for impacts of greater than 3001inear feet to any perennial stream. ln the event t� ���� �:�_,�.� y�� North Carolina Department of Environmental Quality I Division of Water Resources 512 North Salisbury Street I 1617 Mail Service Center � Raleigh, North Carolina 2 7 699-161 7 919.707.9000 that initigation is required, the i�itigation plan shall be designed to replace appropriate lost fiinciioi�s and values. The North Caroliva Division of Mitigation Services may be available for assistance with stream initigation. 4. Future documentarion, including the 401 Water Quality Certificarion Applicarion, shall conrinue to include an itemized listing of the proposed wetland aild sn•eam impacts witl� corresponding mapping. 5. The NCDWR is very concerned with sediment and erosion impacts that could result from this project. The NCDOT shall address these concerns by describing the poteiltial impacts that u7ay occur to tl�e aqliatic environmeuts aud any mitigati»g factors tl�at would reduce tl�e iir�pacts. 6. The NCDOT is re�spectfully reillinded tl�at all impacts, includi»g but not limited to, bridging, fill, excavation and clearitlg, and rip rap to jurisdictioual wetla�lds, strea��ls, and riparia» buffers need to be included in the final in�pact calculatioi�s. Tllese impacts, in addition to any consh-uction impacts, te��nporaiy or otherwise, also neEd to be i�lcluded as part of tl�e 401 Water Quality Cerrification Applic�tion. 7. Sediment and erosion control measures should not be placed in wetlands or streams. 8. Bon-ow/waste areas should avoid wetlands to the maxiinum extent practical. Impacts to wetlands in bon-ow/waste �reas will nEed to be presented in the 40l Water Quality Certification and could precipitate compensatory mitigation. 9. The 401 Water Quality Certificltion applicatioi� will need to specifically address the proposed methods for stormwater managen7eilt. More specifically, stormwater s1�aLl not be peru�itted to disch�rge directly into streams or surface waters. To meet the reqLiicements of NCDOT's NPDLS permit NCS000250, please refer to the most reeent version of the North Curoli��a Departrner�t of �Tt•nnspoNt�rtior� StoNm���crter� Best M«ric�gernef�t Practice.s Toolbox manual for approved measures. 10. Based on the inforn�ation �resent�d in the document, the inagnitude of impacts to wetlands and streains m�y require a Nationwide (NW) application to tl�e Coips of Engineers and con•esponding 401 Water Qliality Certification. Please be advised that a 401 Water Quality Certification requires s�tisfactory protection of water quality to enslire that water quality stanclards are met and no wetland or stream uses are lost. Final perilut authorizatioil will require the slibmittal of a formal application by the NCDOT ancl written concun•ence fronl the NCDWR. Please be aware that any approval will be contingent on appro�riate avoidance and minimization of wetland and sTream impacts to the maximum extent practical, the development of an acceptable stormwater management plan, aild the inclusion of appropriate mitibation plans where appropriate. 11. If concrete is used during cor�strLiction, a dry work area shall be �naintained to prevent direct contact between curing concrete and strea�r� water. Water that inadvertently contacts uncLired concrete sha11 not be discharged to surface waters due to the potential for elevated pH and possible aquatic life and fish kills. Concrete shall be handled in accordance with the NPDES Constniction General Pern�it NCGO l 0000. 12. If temporary access roads or detours are constructed, the site shall be graded to its preconstr�ution contours and elevations. Disturbed aseas s11a11 be seeded or mulcl�ed to stabilize the soil and appropriate native woody species shall be planted. When using temporary struct�tres, the area sl�all be cleared b�it not gr��bbed. Clearing the area witb chain saws, mowers, bush-l�oas, or other mechanized equipment and leaving the st�unps and root mat intact allows the area to re-vegetate nat�ually and mininuzes soil disturbance. 13. Unless otherwise authorized, placement of culverts and other structLn-es in waters and streams shall be placed below tl�e elevation of the streambed by one foot for all culvei-ts with a diameter greater than 48 inches, and 20 percent of the culvert diameter for culverts having a diameter less than 48 inches, to allow low flow passage of water and aquatic life. The applicant is required to providz evidence that the equilibrium is being maintained if requested in writing by the NCDWR. If tl�is condition is unable to be met due to bedroc�k or othe�r limiting features encountered during coi�struction, please contact the NCDWR for guidance on how to proceed and to detennine wl�ether or not a pernlit modification will be required. 14. lf i�nultiple pipes or ban�els are required, they shall be designed to ivimic nahu�al stream cross secrion as closely as possiblE including pipes or barrels at flood plain elevation, floodplain benches, and/or sills may be required where appi•opriate. Widening the stream cl�a»nel should be avoided. Streain cham�el widening at the inlet or outlet end of stillctm-es typically decreases water velocity causing sediinent deposition that requires inereased maintenauce and disiupts aquatic life }�assage. 15. If foundation test borings are necessary; it shall be noted in the docun�ent. Geotechnical work is approved Lmdei- Genera1401 Certification Number 4085/Nationwide Permit No. 6 for Suivey Activities. 16. Sediment and erosion control measures sufficient to protect water resources nnist be implemented and maintained in accordance with tl�e most recent version of North Carolina Sediment aild Erosion Conh-ol Planning and Design Manual and the most recent version of NCS000250. 17. All work in or adjacent to strea�n waters shall be conducted in a dry work area. Approved BMP measures from the most ciu•rent version of the NCDOT Construction and Maintei7ance Activities manual such as sandbags, rock berms, cofferdan7s and other diversion structLires shall be used to prevent excavation in flowing water. 18. While the use of National Wetland Inventory (NWI) maps, NC Coastal Region Evaluatioi� of Wetland Significance (NGCREWS) maps and soil sLu�vey maps are useful tools, their inherent inaccuraci�s require tl�at qu�lified personnel perfoi�rn onsite wetland d�lineations prior to pet�nit approval. 19. Heavy equipment should be operated fi•om the banlc rather than in stream cl�annels in order to miniinize sedimentation and reduce the lil<e;lihood of introducing other pollutants into sh•ea�ns. This equipment shall be inspected daily and n�aintained to prevent contamination of stuface waters fi-om leaking fi�els, lubricants, hydraulic fluids, or other toxic materials. 20. Riprap shall not be placed in flle active thalweg channel or placed in the sh•eambed in a manner that prechides aquatic life passage. Bioengineering boulders or structures should be properly designed, sized and installed. 21. Riparian vegetation (native trees and shr�il�s) shall be preserved to the maxiin�ml extent possible. Riparian vegetatior� must be reestablished witl�ii� the construction liinits of the project by the end of the growing season following completion of co»struction.
