Dear Ms. Karoly and Ms. Van Der Wiele:
Mr. Long has obtained our services to help resolve the violation that occurred at his property
located on the west side of NC Hwy 96, south of Zebulon, NC and described within your attached
letter dated April 4, 2006 (DWQ EXP# 06-0428).
I visited the property on May 18, 2006 to assess the violation and provide a recommendation to
Mr. Long on how best to proceed with the resolution of it. I made the following observations
during my site evaluation.
1. Soil Survey Feature "A" - An intermittent stream is depicted on the Wake County Soil
Survey (Sheet No. 54) that was not addressed in your letter. We have labeled this feature
as "A" on the attached map. I assume that this stream was not addressed in that it's ,
obvious that no surface water (intermittent stream, perennial stream, lake or pond) exists
in the field. No channel exists on Mr. Long's property. However, a channel does exist
north of his property. I evaluated this channel using the NC DWQ -Stream Identification
Form Version 3.1 and calculated a score of 4.5 points, obviously "ephemeral". A small,
man-made pond exists south of Mr. Long's property within this drainage. This pond has
no surface water (intermittent stream or perennial stream) entering it or exiting it, was
constructed within an ephemeral drainage and should therefore be considered an
"exempt" manmade pond. As such, I do not believe that any surface waters subject to the
Neuse River Buffers exist within this drainage and request that'you send Mr. Long an
exemption letter along with any future correspondence regarding this property. I've

attached photos of Mr. Long's property, the channel north of Mr. Long's property, and
the pond south of Mr. Long's property for your review.
2. Existing Culvert - In your letter you state that the stream had been culverted and that
this was not done in compliance with Water Quality Certification regulations. It
appeared to me that the culvert that I observed in the location of Soil Survey Feature "B"
had been in place for some time. The pipe is a 35" RCP approximately 17 feet long that
showed signs of weathering. Mr. Long told me that the pipe was installed in the 1960's
(prior to the Clean Water Act) as part of the construction of a farm road to gain access to
the property. If this is in deed the case (which I have no reason to assume otherwise,
given what I observed on site), then this impact is not in violation of the Water Quality
Certification rules and an "after-the-fact" application should not be required. Also, I
should note that the pipe was not "perched" and I believe had adequate flowing water
within it to allow for aquatic life passage. I've attached photos of the pipe and farm road.
3. Stream & Wetland Fill - The stream is an unnamed tributary of Snipes Creek (03-04-
06, 27-57-12, C NSW). It would most likely be classified as an "intermittent stream with
important aquatic function" or possibly a "perennial stream" by both the US Army Corps
of Engineers (USACE) and the NC Division of Water Quality (DWQ). I observed no
discharge of fill material to either the stream or adjacent wetland areas and as such an
"after-the-fact" application should not be required. However, clearing of the vegetation
within the protected 50-foot Neuse River Buffer was observed along approximately 75
feet of stream channel. As such, I did not observe a violation of DWQ Section 401 or
USACE Section 404 regulations on the property. I've attached a photo of the stream and
wetlands within Soil Survey Feature "B". (The trees shown in the photograph were
recently planted by Mr. Long in an effort to resolve the buffer violation.)
4. Neuse River Buffer Violation - I observed recent clearing of vegetation within the
entire 50-foot protected Neuse River Buffer associated with Soil Survey Feature "B" on
Mr. Long's property. The buffer clearing activity was contained from the farm road
along the southern property line to the northern property line and was approximately 75
feet long and 7,500 square feet.
Mr. Long had already replanted trees within Zone 1 of the protected buffer by the time of
my May 18a` site visit. I counted approximately 23 trees planted on the west side of the
stream and 20 trees on the east side of the stream. This is a planting density of
approximately 440 trees per acre within Zone 1. Of which, there were approximately 6
trees (greater than 20% of the total planted) on each side of the stream that were 1.5 to
2.0 inches dbh or greater. The trees planted included native transplants taken from
elsewhere on Mr. Long's property. At least two different native hardwood tree species
were used.
In an effort to provide temporary stabilization and control erosion and sediment, Mr.
Long will (or already has) install sediment fence along the protected buffer, plant grass
seed and mulch with straw within the disturbed areas of the buffer. (Fescue grass seed
will not be used.)
5. Future Owners - It is Mr. Long's intent to sell the property this summer and anticipates
that a residential subdivision will eventually be developed on the property. It will be the
responsibility of the future owner to identify any jurisdictional waters subject to Section
404 and 401 of the Clean Water Act and the Neuse River Buffer rules. The future owner

will responsible for complying with these regulations in both avoidance and minimization
of these waters and/or obtaining any required approvals. Mr. Long wishes to resolve the
current violation prior to selling the property.
Please contact Mr. Long if you have any additional questions or require additional actions be
taken in regards to this violation and your letter. If not, Mr. Long requests that you send him a
letter stating that the DWQ is satisfied with Mr. Long's response and that the violation has been
adequately resolved. Also, please provide confirmation that Soil Survey Feature "A" is "exempt"
from the Neuse Buffer Rule. We are notifying the DWQ Raleigh Regional Office and USACE
Raleigh Regulatory Field Office, by copy of this letter.
We appreciate your assistance in this matter and Mr. Long regrets that the unintentional violation
that occurred to the protected Neuse River Buffer.

On March 28, 2006, Cynthia Van Der Wiele from the Division of Water Quality (DWQ) conducted a
stream determination at the subject property located on the west side of Hwy. 96 near Zebulon, in Little
Creek Township in Wake County. This site visit was conducted in response to a request by Ms. Brunetta
Taylor, Williams-Pearce and Assoc., to determination if the stream feature on your property was subject
to the Neuse Riparian Area Rules.
During the March 28`" site visit, Ms. Van Der Wiele observed and noted impacts to riparian buffers along
both sides of the unnamed tributary to Snipes Creek. Vegetation had been removed from the riparian
buffer on both sides of the stream, exposing bare soil and tree stumps. In addition, the stream had been
culverted at some point. The culvert was improperly sized and installed, resulting in the lack of aquatic
life passage as required by the 401 General Conditions of the Division of Water Quality. Vegetation had
been cleared from portions of the stream, and it appeared that grading of the site had occurred. At the
time of the site inspection, it was estimated that riparian buffers had been removed from along
approximately 100 linear feet of the perennial stream.
Based on review of DWQ files, we have not identified any Pre-Construction Notification or any Neuse
Riparian Area Authorization, US Army Corps of Engineers 404 Permit, or 401 Water Quality
Certification from the Division of Water Quality. As a result of the site inspections and file review, the
following violations are noted:
1) Neuse River Riparian Buffer Violations; and
2) Failure to Secure a 401 Water Quality Certification.

Item I. Neuse River Riparian Buffer Violations
The Neuse River Basin is a river basin that is subject to riparian (streamside) buffer rules. The purposes
of these rules are to protect and preserve riparian buffers in the Neuse River Basin. That is, these rules
help to maintain the nutrient removal functions of the streamside areas necessary to protect surface
waters. Specifically, this Rule applies to the 50-foot wide riparian buffer directly adjacent to surface
waters (intermittent streams, perennial streams, lakes, ponds, and estuaries).
The protected riparian buffer has two zones as follows: (a) Zone 1 [measured from stream bank landward
for 30 feet] shall consist of a vegetated area that is undisturbed except for uses provided for in
Subparagraph (6) of 15A NCAC 2B.0233, and (b) Zone 2 [the outer 20 feet, landward from the outer 30
foot edge of Zone 1] shall consist of stable vegetated area that is undisturbed except for activities and uses
provided for in Subparagraphs (4) and (6) of 15A NCAC 2B.0233.
The site visit and file review of this tract confirmed no Pre-Construction Notification was received for this
project and riparian buffer impacts associated with clearing of vegetation, grading and grubbing were not
authorized by DWQ. Specifically, no request, or a DWQ practical alternative determination, variance or
authorization had been issued for these impacts to the riparian zone.
As a result, the following riparian buffer rule violations are noted:
Neuse River Buffer Rule 15A NCAC 2B.0233: Vegetation has been removed from the riparian zone, a
violation of the requirement that Zone 1 and Zone 2 consist of a stable, vegetated area that is undisturbed
except for activities and uses provided for in Item (6) of the Rule. No variance or Practical Alternative
Request was received prior to the riparian zone impacts.
Item II. Failure to Secure a 401 Water Quality Certification
Unauthorized fill has been placed in the stream on the site, through land-clearing activities, culvert
installation, and the passage of heavy equipment through the stream. A road crossing, to gain access to
upland areas of the property, was not authorized by the Division of Water Quality. This constitutes a
violation pursuant to 15A NCAC 2H .0500 Water Quality Certification Rules.
The Division of Water Quality requires that violations, as detailed above, be abated immediately. This
Office requests that you respond to this letter, in writing, within 20 days of receiving this Notice. Your
response should be sent to the attention of: Ms. Cyndi Karoly, Manager, NC Division of Water Quality,
401 Oversight/Express Review Permitting Unit, 2321 Crabtree Blvd., Suite 250, Raleigh, NC 27604.
Your response should address the following items:
1. Please clearly explain why these impacts occurred without prior authorization.
2. Please provide a map that details the location and amount of streams, Neuse River buffers, and
wetlands on the tract.
3. Please provide the total amount of impacts to streams (in linear feet) and buffers (in square feet).
4. Please provide your plans to delineate and avoid any further buffer and stream impacts on the
site.

It is required that you secure an "After-the-Fact" 404 Permit from the US Army Corps of
Engineers, as well as an "After-the-Fact" 401 Water Quality Certification and Neuse Riparian
Buffer Authorization from the Division of Water Quality. You will need to submit a Pre-
construction Notification Application

plans, and maps.
For the Neuse Buffer Impacts, please submit the following Restoration Plans to this office for
review and approval.
a.) Riparian Buffers - A planting plan must be developed and implemented in order to
ensure that at least three native tree species are planted at a density sufficient to provide
320 trees per acre at maturity. This density is usually achieved by planting
approximately 436 trees/acre on a 10 x 10 ft. grid or 681 trees/acre on an 8 x 8 ft. grid.
Please see the Guidelines for Riparian Buffer Restoration (January 2001) for assistance in
developing your plan (available on the web site at
http://h2o.enr.state.nc.us/wrp/pdf/buffers.pdf). This plan must include the types of native
woody vegetation selected, methodology of planting, and a site map indicating
the location of the replanting efforts. Also, the plan must address the measures that will
be used for temporary stabilization/sediment control while this work is under way.
In addition, DWQ requests that at least 20% of the trees planted be balled and burlapped,
1.5 - 2.0-inch caliper nursery stock, to provide variation in the size of the trees in the
restoration area.
b.) Please indicate in your response a detailed schedule with dates explaining when the
restoration will be accomplished. As a part of this schedule you should detail/include a
three-year monitoring plan.
In addition, as discussed on the site, please provide written details regarding the protection of the
riparian buffers (both Zones 1 and 2) through capture of all buffers within common
property/homeowners association areas as a means to resolve both the previous violation and the
current violation. This should include plans for deed restrictions specifying protection of the
buffers and/or placement of a conservation easement on the buffers.
7. It is required that you contact the Raleigh Regional Office of the Division of Land Resources at
(919) 571-4700, and the U.S. Army Corps of Engineers at (919) 876-8441. These contacts are
necessary to ensure that your restoration efforts are in compliance with Land Resources and
Section 404 of the Clean Water Act requirements.
You are encouraged to secure a consultant to assist you with your development plan, permit, water quality
certification and authorization necessary achieve compliance.

Thank you for your attention to this matter. This Office is considering sending a recommendation for
enforcement to the Director of the Division of Water Quality regarding these issues and any
future/continued violations that may be encountered. Your above-mentioned response to this
correspondence will be considered in this process. This office requires that the violations, as detailed
above, be abated immediately. These violations and any future violations are subject to civil penalty
assessment of up to $25,000.00 per day for each violation. Should you have any questions regarding

On-Site Determination for Applicability to the Neuse Riparian Area Protection Rules (15A NCAC
2B.0233)-EXPRESS REVIEW PROGRAM
On March 28, 2006, at the request of Ms. Brunetta Taylor of Williams-Pearce and Assoc., an on-site
determination was conducted to review a stream feature located on the subject property for applicability
to the Neuse Buffer Rules (15A NCAC 2B .0233). The feature is labeled as "A" on the attached USGS
map, initialed by Cynthia Van Der Wiele, Ph.D. on March 28, 2006. The Division of Water Quality
(DWQ) has determined-that the feature labeled as "A" on the attached maps is subject to the Neuse
Buffer Rule. This on-site determination shall expire five (5) years from the date of this letter.
While conducting the field assessment of the stream feature, it was observed that construction/clearing
work had been performed. The stream buffer had been removed. This work has not been authorized by
the Division of Water Quality and will necessitate a Notice of Violation.
Landowners or affected parties that dispute a determination made by the DWQ that a surface water exists
and that it is subject to the buffer rule may request a determination by the Director. A request for a
determination by the Director shall be referred to the Director in writing c/o Cyndi Karoly, DWQ 401
Oversight/Express Review Permitting Unit, 2321 Crabtree Blvd., Raleigh, NC 27604-2260. You must act
within 60 days of the date that you receive this letter. Applicants are hereby notified that the 60-day
statutory appeal time does not start until the affected party (including downstream and adjacent
landowners) is notified of this decision. This determination is final and binding unless you ask for a
hearing within 60 days.
This letter only addresses the applicability to the buffer rules and does not approve any activity within the
buffers. Nor does this letter approve any activity within Waters of the United States or Waters of the

Long tract" for acceptance into the Express Review Program. This letter advises you that your project will be
accepted into the Express Review Program once the following items are received:
1) The application fee of $200.00 [for Stream Origin Determination services], made payable to the North
Carolina Division of Water Quality;
2) Four (4) complete and collated copies of the most recent versions of the NRCS Soil Survey map and the
1:24,000 USGS Topographic map for the site, both with the property boundaries located; and
3) A vicinity map clearly marking the location of the site.
Due to staff availability, please so not send your package prior to Thursday, March 23, 2006. Please keep in
mind that the clock for this project will not start until receipt of the completed application package and required
