4a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application:*
Existing conditions consist of an assemblage of properties that are forested with some open agricultural fields, structures, driveways and CP&L easements. The properties are between
Purfoy Road and NC Hwy 55, south of Holland Road in Fuquay-Varina, NC. There are jurisdictional wetlands, streams and eight (8) ponds onsite that drain to Neills Creek or Kenneth
Creek in the Cape Fear River Basin. The general land use in the vicinity of the project is residential, forestry and agricultural.

The purpose of the proposed project is to construct a residential development and construct the infrastructure necessary to access the residential development.

The overall project consists of the construction of roadway infrastructure, utilities, single-family lots and stormwater BMP's. Specifically, there are eight (8) stream & wetland impacts
associated with road infrastructure, and seven (7) stream & wetland impacts associated with utilities. Equipment typically used for construction and earthwork such as backhoes,
bulldozers, excavators, graders, pavers etc. will be utilized for this project.

The proposed project is anticipated to be phased through construction. Per the project engineer, the exact order of what areas will be constructed has not been determined. There are
no anticipated future "phases" beyond what is shown on the Overall Site Plan map.
Are any other NWP(s), regional general permit(s), or individual permits(s) used, or intended to be used, to authorize any part of the proposed project or related activity?
There will be a future road infrastructure project that will connect Purfoy Road to Mvy 55. This future "Parkway" will be constructed within the proposed Purfoy South property
boundaries and will be a Town of Fuquay Varina project. The future parkway is shown within the Town of Fuquay Varina 2035 Community Transportation Plan. The details of this future
parkway have been discussed with the USACE and it has been determined that the future 'Parkway" will have independent utility.

E. Impact Justification and Mitigation �%'
1. Avoidance and Minimization
1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project:
S&EC completed a stream and wetland delineation for the entire property in order to identify natural resources so that impacts could be avoided &
minimized to the maximum extent practicable. The project is proposing fifteen (15) impact areas, eight (8) stream & wetland impacts associated with
road infrastructure, and seven (7) stream & wetland impacts associated with utilities. Impacts 1, 2 and 3 are proposed utility impacts to a wetland.
Proposed impacts include permanent, no permanent loss wetland impacts. The permanent, no permanent loss impacts are for the permanent
maintenance corridor and the change of wetland function. Impact 4 is a proposed road crossing to an intermittent stream and wetland. Proposed
impacts include permanent and temporary stream impacts, along with permanent and temporary wetland impacts. Headwalls and retaining walls have
been utilized to minimize stream and wetland impacts in this location. This impact is necessary to access the northwestern portion of the property, west
of Purfoy Road. Impact 5 is a proposed road crossing to a wetland. Proposed impacts include permanent and temporary wetland impacts. Headwalls
and retaining walls have been utilized to minimize wetland impacts in this location. This impact is necessary to access the property on the east side of
Purfoy Road, west of the 100' CP&L power line. Impact 6 is a proposed road crossing to a perennial stream and wetland. Proposed impacts include
permanent and temporary stream impacts, along with permanent and temporary wetland impacts. Headwalls and retaining walls have been utilized to
minimize stream and wetland impacts in this location. This proposed crossing was also designed at the narrow point of the wetlands to minimize
wetland impacts. This impact is necessary to access the northeastern portion of the property, east of Purfoy Road. Impact 7 is a proposed road
crossing to a perennial stream and wetland. Proposed impacts include permanent and temporary stream impacts, along with permanent and
temporary wetland impacts. Headwalls and retaining walls have been utilized to minimize stream and wetland impacts in this location. This proposed
crossing was also designed at the narrow point of the wetlands to minimize wetland impacts. This impact is necessary to access the southeastern
portion of the property, towards Hwy 55. Impact 8 is a proposed road crossing to a wetland. Proposed impacts include permanent and temporary
wetland impacts. Headwalls and retaining walls have been utilized to minimize wetland impacts in this location. This impact is necessary to access the
property on the east side of Purfoy Road, east of the 100' CP&L power line. Impact 9 is a proposed road crossing to a perennial stream and wetland.
Proposed impacts include permanent and temporary stream impacts, along with permanent and temporary wetland impacts. Headwalls and retaining
walls have been utilized to minimize stream and wetland impacts in this location. This proposed crossing was also designed at the narrow point of the
wetlands to minimize wetland impacts, and below the confluence of two stream to minimize stream impacts. This impact is necessary to access the
eastern portion of the property, connecting the land adjacent to Hwy 55. Impact 10 is a proposed road crossing to a perennial stream and wetland.
Proposed impacts include permanent and temporary stream impacts, along with temporary wetland impacts. Headwalls and retaining walls have been
utilized to minimize stream and wetland impacts in this location. This proposed crossing was also designed at location to avoid permanent wetland
impacts. This impact is necessary to access the northern area of the eastern portion of the property adjacent to Hwy 55. Impacts 11,12 & 14 are
proposed utility crossings to a perennial stream and wetland. Proposed impacts include temporary stream impacts, along with permanent, no
permanent loss wetland impacts. The permanent, no permanent loss impacts are for the permanent maintenance corridor and the change of wetland
function. This utility crossing has been minimized by crossing the stream & wetland at a perpendicular angle. Impact 13 is a proposed utility impacts to
a wetland. Proposed impacts include permanent, no permanent loss wetland impacts. The permanent, no permanent loss impacts are for the
permanent maintenance corridor and the change of wetland function. Impact 15 is a proposed road crossing that is impacting wetlands. Proposed
impacts include permanent and temporary wetland impacts. Headwalls and retaining walls have been utilized to minimize wetland impacts in this
location. This crossing was designed in a location where there are uplands between two wetlands to minimize impacts. This impact is necessary to
access the property in the southwest portion of the property. Soil borings were taken throughout the properties, the borings primarily targeted open
field areas to avoid stream and buffer intrusion during the boring activities. Of these borings approximately 15% encountered rock or other hard (>50
bpf) materials at varying depths. Therefore during construction of the project, it is expected to encounter rock in some of the deeper utility trenches
and potentially at stream crossings. As such, it was determined that Bore & Jack or Directional Drill construction methods for utility crossings are not
practicable and are proposing to utilize the open -cut utility construction method. All temporary wetland impacts will be brought back to pre -construction
contours and re -vegetated with a wetlands seed mix All temporary stream impacts will be brought back to pre -construction elevations and the stream
banks will be stabilized. Compensatory mitigation is being proposed for all permanent -no permanent loss wetland impacts for utilities.

Per the project engineer, this project will have an Erosion control plan approved by the Town of Fuquay Varina. Measure will be installed to avoid and
minimize any runoff. Silt fence, check dams, diversion ditches, sediment basins, erosion blankets and standard practices will be utilized.

We have reviewed the "Draft Internal Policy, Cumulative impacts and the 401 Water Quality Certification and Isolated Wetlands Programs' document
prepared by the NC Division of Water Quality on April 10, 2004, version 2.1. The draft states that many private developments are unlikely to cause

The purpose of this letter is to notify you that the NCDEQ Division of Mitigation Services (DMS) is willing to
accept payment for compensatory mitigation for impacts associated with the above referenced project as
indicated in the table below. Please note that this decision does not assure that participation in the DMS in -
lieu fee mitigation program will be approved by the permit issuing agencies as mitigation for project impacts.
It is the responsibility of the applicant to contact permitting agencies to determine if payment to the DMS will
be approved. You must also comply with all other state, federal or local government permits, regulations or
authorizations associated with the proposed activity including G.S. § 143-214.11.
This acceptance is valid for six months from the date of this letter and is not transferable. If we have not
received a copy of the issued 404 Permit/401 Certification within this time frame, this acceptance will
expire. It is the applicant's responsibility to send copies of the permits to DMS. Once DMS receives a copy
of the permit(s) an invoice will be issued based on the required mitigation in that permit and payment must

Thank you for your letter transmitting the above-referenced archaeological survey report. We have reviewed
the report and offer the following comments.
Archaeological survey resulted in the identification of nineteen archaeological sites (31WA2173 –
31WA2191). In addition, one historic cemetery was documented at site 31WA2189. None of the identified
sites are considered eligible for listing in the National Register of Historic Places. Based on the information
provided, this office concurs with these assessments. While the historic Johnson Cemetery (31WA2189) is
not considered eligible for listing in the National Register, it is protected under North Carolina General
Statute Chapter 65, and should be avoided if possible. We concur with the recommendation provided in the
report for a minimum 10-meter (33-ft) buffer to be established around the cemetery, beyond the existing
chain link fence. This buffer area should be marked with high-visibility construction fencing to ensure the
cemetery is not affected by ground disturbing activities.
While we find the submitted draft report sufficient to make the above recommendations, we request the
document be revised and a final report be submitted with the following additions:
Description of soils encountered at site 31WA2185
Inclusion of site 31WA2185 and the Johnson Cemetery in the conclusion of the report
