Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. 1) Unless specifically altered herein, all work shall be carried out in accordance with the attached workplan drawings (5), 2' dated amended 7/18/05, 1 dated 10/27/05, 1 dated amended 11/21/05, and 1 dated revised 12/6405. NOTE: It should be noted that the portions of the workplan drawings referencing the new docks and access piers are not to scale. Excavation 2) In order to protect juvenile shrimp and finfish populations, no excavation or filling shall be permitted between April 1 and September 30 of any year without the prior approval of the Division of Coastal Management, in consultation with the Division of Marine Fisheries. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2009 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Asbury Beach Home Owners Association Permit 1176-06 Page 2 of 4 ADDITIONAL CONDITIONS 3) Excavation in the boat basin shall not exceed -3:6rfnrbelow the -normal-to""water level (NLW), excavation in the 1,050-foot long canal shall not exceed -4 feet below the NLW, and excavation in-the 1,210-foot long access channel shall not exceed -4.4 below the NLW. In no case shall the depth of excavation exceed the depth of connecting waters. 4) No excavation shall take place outside of the area indicated on the attached workplan drawings. 5) No excavation shall take place within 5 feet of any area of coastal wetland. Spoil Disposal 6) 4"77e spoil disposal area shall- be inspected and approved by a representative of the Division of Coastal Management prior to the commencement of.any dredging activities. - 7) All excavated materials . shall be confined above normal high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. --- -8) No spoil material shall be placed within 30 feet of the normal-high water. line, even temporarily: --- -- - - 9) The disposal area shall be properly graded and provided a ground cover sufficient to restrain erosion within 30 working days of project completion. 10) In order to protect water quality, runoff from construction shall not risibly increase *the amount of suspended sediments in adjacent waters. Docking Facility 11) The permitted new docks shall be no greater in size than 6' X 20' and the access piers built over coastal wetlands shall be no larger than 6' wide X 7' long. 12) All material resulting from the removal of the existing pier shall be placed on an approved upland disposal site. 13) Any portion of the permitted access piers built over coastal wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as measured from the bottom of the decking. 14) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. 16) • The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this. permit. The permittee is not relieved of 'this requirement, if he abandons the permitted activity. without having it transferrQd to a third party... 1-7) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 18) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. -19)-- The permittee shall -install and maintain at his expense any signal-lights or signals prescribed by the-U.S:--. - Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 20) The construction and/or operation of the authorized facilities shall not directly result in any closure of any waters that are open to the taking of shellfish.. Any such closure directly attributable. to the authorized facility may require that the permittee undertake remedial actions to remedy the situation. 21) This permit authorizes a maximum of two (2) new boat slips and the removal of three jet ski lifts, resulting in a total of ten (10) slips on-site, all as referenced in the attached workplan drawings. General 22) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 23) No vegetated wetlands or marsh grass shall be excavated or filled, even temporarily, without permit modification. 24) The temporary placement or double handling of excavated materials within waters or vegetated wetlands is not authorized. In order to -protect the West Indian manatee all work should be done during the period from November 1 to May 31. If work must be done during the period from June through October the enclosed guidelines, entitled "Precautions for General Construction in Areas Which may Be Used by the West Indian Manatee in North Carolina" shall be followed. NOTE: NOTE: This permit does not eliminate the need to obtain any additional state, federal or local per approvals or authorizations that may be required. `Future development of the permittee's property may require a modification of this permit. Contact a representative-of the Division..at (252) 808-2808 prior to the commencement of any such activity for this determination. NARRATIVE DESCRIPTION: Project Setting The applicant's property is in a residential subdivision (Asbury Beach) located on East Fort Macon Road (NC Hwy. 58), adjacent to Bogue Sound, in the Town of Atlantic Beach, in Carteret County. Bogue Sound, the access channel, the canal and the boat basin lie to the north of the subdivision. There are large expanses of coastal wetlands to the east and west of the canal and,basin. Fort Macon Road is to the south. The size of the entire tract is 15 acres. There is an existing boat basin and canal that is for the use of the subdivision. The sub-division is developed with houses, a bulkhead, and piers within the basin. There are currently eight docks and three jet ski lifts on site. Applicant proposes to remove the three jet ski lifts as part of the project. Applicant states that the elevation of the tract is from 1'6" to 8' above MHW, and has been confirmed by DCM topographic maps. There are large areas of Spartina alterniflora to the east and west of the canal that reaches south to the existing bulkhead. There are also several patches of marsh that are developing in front of the bulkhead in the boat basin. These are narrow, from V to 7'. The existing boat basin measures 90' x 125' and connects to a canal that is approximately 1210' long and 45' wide. This canal leads to an access channel that is approximately 1050' long and 40' wide. The existing canal and basin were dug through Coastal Wetlands prior to permit requirements and the proposal to perform maintenance excavation would impact no wetlands. Existing depths in the canal and basin are -1.0' to -1.4' at MLW. The bottom-consists of soft organic muck. The Division of Marine Fisheries does not designate the project site as a PNA. It is classified as SA waters by the DWQ, and is open to shellfishing. The Atlantic Beach LUP classifies the site as Developed, with all AECs Classified Conservation. CAMA Major Permit #53-88 was issued on 3-8-88 and authorized the dredging of the access channel. On May 5,1993, CAMA Major Permit # 52-93 was issued authorizing three new docks. This Major Permit #52-93 was renewed three times, the last expiring December 31, 2002, with only part of the authorized work occurring. The basin has had changes such as marsh fringes growing since the last renewal, necessitating review for minor changes such as access lengths to the new docks. Project Description The project consists of the maintenance excavation of the 1050' long channel, the 1210' long canal, and the 90' x 125' boat basin. The excavation would be accomplished with a clamshell bucket on a barge, with the spoils offloaded directly to a truck at the landing on the south side of the basin. These spoils would then be hauled to a high ground site that would be approved by DCM before construction. Two new docks are proposed on the east side of the basin. There is currently a 7' fringe of Spartina alterniflora at the site of the proposed docks. Since excavation may not occur within 5' of the marsh, access docks to the 6' x 20' platforms are necessary to make the docks functional. The existing access channel ties into the Triple S Marina channel and runs 1050' to the mouth of the canal. This channel is 40' wide and is currently approximately 44" deep at NLW. The channel was originally permitted to a depth of -3'6" at NLW. Applicant states in his proposal a final project depth of 44" NLW. This would result in the removal of 4667cy of material from the channel. The existing canal is approximately 1210' x 45' in width. The existing depth is -1'4" at MLW and applicant proposes a final project depth of -4'. This would result in the removal of 3576cy of bottom material. The existing boat basin is 125' x 90'. It is bordered by a bulkhead, however the actual dredging footprint allowed would be determined by the fringes of coastal wetlands waterward of the wall. The current depth in the basin is -Vat MLW. The proposed finished depth is -3'3". This would result in the removal of 1042cy of bottom material. The two new docks would each have a 6'x 7' access dock over coastal wetlands to reach the 6'x 20' platforms. This should make the two new docks functional after excavation of the basin. The three existing jet ski lifts are to be removed prior to new construction. 10. ANTICIPATED IMPACTS: The proposed excavation of the channel, canal, and basin would disturb 89,500sf of previously disturbed bottom area and would result in the removal of approximately 9,285 cy of bottom material. The two new dock accesses would shade 84sf of coastal wetlands. The two 6'x 20' dock platforms would shade 240sf of shallow water bottom habitat. The total number of slips in the docking facility would be 10, including the removal of the jet ski lifts, resulting in no overall change in slip numbers. There would be turbidity in the dredge areas while digging is occurring, however this should be short in duration.
