An accurate, dated work plat (including plan view and cross-sectional drawings) drawn to scale in black ink on an 8 112" by 11" white paper. (Refer to Coastal Resources Cemmission Rule 7].0243 for a detailed description.) Please note that original drawings are preferred and only high quality copies will be accepted. Blue-line prints or other larger plats are acceptable only if an adequate number of duality copies are provided by applicant. (Contact the U.S. Army Corps of Engineers regarding that agency's use of larger drawings.) However, DWQ must object because construction of a 10 slip open water docking facility in Bogue Sound, class SA;ORW waters is a violation of NC Water Quality Standards. Specifically, 15A NCAC 02B .0225(e)(7)(D) states the following: "In [the Western Bogue Sound Section of the Western Bogue Sound and Bear Island Area], the only new or expanded marinas that shall be allowed shall be those marinas located in upland basin areas, or those with less than 10 slips, having no boats over 21 feet in length and no boats with heads." If the applicant revises the proposed project in a manner that addresses the above Water Quality Standard, this Office will have no objection. This will be accomplished by constructing 8 finger piers and installing 10 boat lifts. Sunset Landing Page 02 9. Narrative Description: The Sunset Landing project is located at 9020 Crew Dr. in Emerald Isle, Carteret County. Crew Dr. is found by turning left off of Hwy. 58 as soon as the Emerald Isle Bridge is crossed. Sunset Landing is at the end of Crew Dr. The site lies on the southern side of Bogue Sound and was formally the location of Bridgeview Campground. The Sunset Landing property is 13.17 acres in its entirety and varies from 4' to 30' in elevation above NHW. The high ground portion of the site is currently being redeveloped to create a subdivision under State Permit #52-06. This permit authorized the construction of the access roads, utilities and associated grading and filling. At this time the roads are in place and utilities are being installed. There are 31 lots in Sunset Landing. The shoreline of the community access between lots 18 and 19 has been previously bukheaded and is 57' wide. Existing at the community access is a 6'X200' dock with a 6'X20' "T" platform authorized under State Permit # 44528C. Currently the dock extends 170' into the 970' water body and encompasses 1,110 ft2 of Public Trust Area. Water depths in the docking area are approximately-3' NLW. There is also an existing 15'X65' elevated boat ramp that runs parallel to the dock. Along Bogue Sound is a fringe of coastal marsh containing Smooth Cordgrass (Spartina alterniflora) and Salt Meadow Grass (Spartina patens). The substrate in this area is mostly silt and sand. The shoreline of the entire subdivision has a total length of 2,726ft. The Division of Water Quality classifies this area as SA-ORW waters. This area is not a Primary Nursery Area. This portion of Bogue Sound is open to the taking of shellfish. Emerald Isle's Land Use Plan dated 2004 classifies this area as Residential and Conservation within the AEC's. There are no shellfish leases in this area. There are no visual signs of shellfish resources although clams may be present. The developer has received their Stormwater permit (SWB 8060208) and their Erosion and Sedimentation Control permit (Carte-2006-24) 10. Project Description: In order to provide docking for the previously permitted single family lots the applicant proposes to add 10 boat slips to the existing dock. There would be 8 finger piers constructed along the dock that are 2'X6' each. A 15'X20' boatlift would be placed in each slip. Water depths in this area are 2'-3' at NLW. The developer has waived the 15' riparian setback for lots 18 & 19. 11. Anticipated Impacts: The proposed improvements at the Sunset Landing dock would result in 4,170 ft2 of open water incorporated of which 1,206 ft2 would be shaded by the docking facility. An increase in turbidity will occur during the construction process. There should be no hazard to navigation resulting from this marina, as the overall waterward extent of the dock will not change. No coastal marsh would be filled, excavated or shaded during this project. This area is currently heavily used for boating and has sufficient water depths. Singleton, III, has submitted a CAMA application on be4alf of JTW Investments which owns and operates the Bridgeview Family Campground, The project site is located within Block 42 and consists of 14,5 acres of wooded, highground property situated on Rogue Soynd just east of the Cameron-Langston Bridge in the Town of Emerald Isle, Carteret County, The property was developed in 1985 as a family campground providing drinking water and electricity-to each of the 112 camp sites. The system of gravel roads, camp sites and all associated facilities are located landward of the CAMA 75' estuarine shoreline AEC. There is, in fact, a 1001 wide vegetated. buffer zone between the indivi- dual camp sites alnn:q Nautulis Drive and the back side of the salt marsh fringe that runs the entire length of the project, some 5891. The marsh fringe is dominated by salt marsh cordgrass (Spartina al- terniflora) and Scirpus robustus, a.bullrush, _ The applicant proposes to develop a boat launching facility for the exclusive use of the campground residents. The plan involves con- struction of a wooden boat ramp, 161 wide and a total of 30' long, The elevated boat ramp will cross over the narrowest section of marsh measuring some 15-201 wide. The driveway accessing the boat ramp will occupy campsite No. 102, The 14' wide driveway will ap- proach the shoreline for a distance of about 801 before the roadway divides into a "horse-shoe" loop road near the ramp, In order to ac- complish the necessary grading and sloping of the hillside, a stan- dard wooden bulkhead will be constructed on the landward side of the marsh fringe. The bulkhead will be about 1001 long with a 20' return wall on the west end. The driveway and small parking lot will create approximately 4,100 sq.ft. of surface area to be covered with crushed and run type of marl. When compacted, this area will have a 90o closure factor for the absorption of runoff water. The applicant has designed the project to intersect the shoreline at a point where the existing bank elevation is lowest and at an eleva- tion of about 8' above mean sea level. Inside the driveway loop road the applicant plans to maintain the na- tural vegetation that centers around a very large live oak tree. A 40' retaining wall will help stabilize the natural bank around the in- terior of the loop road, The project plans also call for the construction of a wooden pier ex- tending 2001 into Rogue Sound, The pier will terminate with a T-head platform measuring 32' long by 6' wide. The water depths will vary from 1-21 during mean low tide along the pier alignment. The pier will provide pedestrian access as well as temporary tie-ups for those small class of boats using these shallow waters of Rogue Sound. The 1984 aerial photographs Strip No. 29, Frame 976, shows the project site and its relationshipship to Rogue Sound.. 10. Anticipated impacts The idea of bridging the salt marsh with an elevated wooden ramp is probably the only environmentally acceptable way the applicant -2- can obtain boating access to Bogue Sound. The limitations of the wooden ramp and the water depths of Bogue Sound should control the use of the proposed facility. The proposed pier and ramp will cast a foot- print shadow over 440 sq.ft. of salt marsh and 1,240 sq.ft. of Bogue Sound bottomland. Although there is no significant concentration of shellfish within the project area, this section of Bogue Sound is tra- ditionally used for the harvesting of shellfish. in addition, the DEM classifies these waters as SA.
