Dear Mr. Craver:
A review has been conducted of the Sanitary Sewer Overflow (SSO) 5-Day Report(s)
submitted by the City of Thomasville for the month of August 2018. This review has shown
the City of Thomasville to be in violation of the requirements found in the WQCS00057
collection system permit and/or North Carolina General Statute 143.215.1(a)(1). The
violations are summarized below:

Remedial actions, if not already implemented, should be taken to correct all conditions
which may have been deemed to have contributed to causing the above-listed violations.
The Division of Water Resources (DWR or Division) bases decisions concerning
enforcement actions for SSOs on volume spilled, volume reaching surface waters,
duration, gravity, impacts to public health, fish kills, and other factors. DWR may pursue
enforcement action for these and/or any additional violations of the WQCS00057
collection system permit. If violations are of a continuing nature, not related to operation
and/or maintenance issues, and you anticipate remedial construction activities, then you
may wish to consider applying for a Special Order by Consent (SOC).
Pursuant to NC General Statute (NCGS) 143-215.6A, a civil penalty of not more than
twenty-five thousand dollars ($25,000.00).may be assessed against any person who
violates or fails to act in accordance with the terms, conditions, or requirements of any
permit issued pursuant to NCGS 143-215.1. The incidents above constitute such
violations.
This office requests that you respond to this notice, in writing, within 10 business days
of its receipt. In your response, you should address the causes of non-compliance and all
remedial actions taken and planned to prevent the recurrence of similar situations. The
response to this correspondence will be considered in our decision-making process of
whether to proceed with enforcement action.
