Salisbury Street Raleigh, NC 27604 On behalf of Classic, LLC (applicant and owner) please find attached a complete application and supplemental information requesting written concurrence from the US Army Corps of Engineers (USACE) and North Carolina Division of Water Resources (NCDWR) that the activities associated with the proposed office space described herein may proceed under Nationwide Permit (NWP) 39 and the associated General Certification (GC) 4139. Please find attached a complete application and supplemental information. Project Summary and Purpose The project consists of a +/- 4.27 -acre parcel (Property) located in western Wake County and is located northeast of the intersection of Aviation Parkway and RDU Center Drive in Morrisville, NC. Representative coordinates for the approximate center of the Property are 35.8531440N, 78.795972°W. The corresponding Wake County PIN for the property is: 0766-05-4573. The purpose of the proposed project is to construct a mixed-use facility that provides office space and a fueling center to meet the demand in this part of Wake County. Project History The wetlands were delineated in March 2018 and a request for a preliminary jurisdictional determination (PJD) was sent to Ms. Tasha Alexander of the USACE. Based on a subsequent conversation with Ms. Alexander, the project area was part of a larger property that was previously developed. The 4.27 -acre Property was purchased by the current owner in 2017. As per the conversation with Ms. Alexander, USACE Action ID #2010-02075 corresponds to the previously approved 0.05 acre of permanent wetland impact and the 0.08 acre of temporary wetland impact associated with the past development of a now separately owner parcel. Because no streams are 1111 RDU Center Drive Page 1 of 3 on the Property or depicted on the USGS or Soil Survey maps as being on the Property, a site meeting with the NCDWR was not conducted. The Property is currently undeveloped and with the exception of the northern and eastern property lines, was cleared between 2005 and 2010. At the time of the clearing temporary sediment basins were installed on the Property. Land usage of adjacent properties consists of undeveloped, forested land, retail, commercial / services, utilities, transportation, and industrial. Project Detail The overall proposed project is a mixed-use office space and fueling station. Stormwater will be directed into existing SCM's. The project will tie into an existing sanitary sewer connection located to the south of the project. The proposed fill slopes, mechanized land clearing, and grubbing activities will result in minor permanent impacts to wetlands. Heavy equipment typically used for utility installation projects (e.g. back hoes, bull -dozers, etc) will be utilized. No federally threatened or endangered species are listed on the Site according to the NC Natural Heritage Program (NHP) Database (March 2018). One high -accuracy occurrence of a bald eagle (Haliaeetus leucocephalus) is listed for Wake County. The species, documented within 1 -mile of the Site in 2009, is listed under the Bald and Golden Eagle Protection Act. See attached letter from NHP. No ponds or lakes are located on the Site and no individuals or nesting trees were observed during the fieldwork effort earlier in 2018. Some trees will be cut in order to conduct work in waters of the U.S. The project does not involve any bridge maintenance or removal and does not include the construction of wind turbines. The need for trlasting or other percussive activities and the use of jackhammers, mechanized pile drivers, etc. is not expected. No recorded historic properties are located on the project site according to the State Historic Preservation Office (SHPO) HPO Web Online (October 9, 2018). One SHPO Site is listed within 0.5 miles. Site WA -0718 is located approximately 0.3 -miles SW from the property north of Gateway Center Blvd and east of Aviation Parkway. The historic property is listed as SD (Surveyed Gone) prior to 1993. Avoidance and Minimization A wetland delineation was conducted in March 2018 to identify the potential wetland areas to avoid where practicable in the site design. Retaining walls are being constructed to avoid additional impacts from fill slopes. Construction fencing will be used to define the construction corridor and prevent any accidental additional impacts. Silt fencing will be installed to provide additional protection from runoff. Project Impacts The project does not contain any jurisdictional and/or buffered streams. Proposed wetland impacts will result from permanent wetland fill. Proposed permanent wetland impacts totaling 0.049 acre will result from slope fill. Total proposed permanent impact including previous impacts under Action ID# USACE 2010-02075 will be less than 0.10 -acre. 1111 RDU Center Drive Page 2 of 3 Mitigation No stream or buffer impacts are proposed therefore no stream or buffer mitigation is proposed. No wetland mitigation is proposed due to the overall permanent wetland impacts having been minimized and avoided to total less than 0.10 -acre. Describe the overall project in detail, including the type of equipment to be used: The overall proposed project includes a primary building used for office space and retail convenience store with fuel services including pump islands and associated infrastructure. A variable height retaining wall will be constructed along the eastern property boundary within the required setback. The project will tie into an existing sanitary sewer connection and stormwater system located near the southern .parcel tip along RDU Center Drive. The proposed mechanized land clearing, grading and grubbing activities will result in permanent impacts to wetlands.
